During rereview of the plans for the above noted project, it was found that the following
information, clarifications or changes are still needed. Provide written responses to each comment
and where changes can be found on the plans. Please resubmit to Theresa Umbaugh, Permit
Coordinator.
Previous Item 1: The imaginary property line is not permitted to go through the existing exit
stair for the adjacent multifamily building. The exterior stairway is part of the Exit Discharge
for the multifamily building and must meet fire separation distance requirements of IBC Chapter
6 and 7. Per IBC 1023.3, the exterior stairways "...shall be located at least 10 feet from adjacent
lot lines and from other buildings on the same lot unless the adjacent building [R3 occupancy]
exterior walls and openings are protected in accordance with Section 704 based on fire
separation distance".
The only exception to placing an imaginary property line between buildings and meeting fire
separation distance requirements is 1BC 704.3 exception (discussed at the preapplication
meeting), which allows separate buildings on the same lot to be considered one building if it
meets Chapter 5 (for allowable area and height). Since the multifamily building is of Type VA
construction, the single family would also need to the of Type VA construction, and allowable
area calculations would be required to show the two buildings combined meet allowable area.
