Dear Mr. Larsen,
I discussed with Jeanie McConnell today the conversation we had at the counter
regarding the retaining wall at Woodridge Park.
She felt that due to the topography between the two lots the 8ft encroachment could be
approved.
The other issue of the surcharge on the wall is more difficult. Since there is pavement up
to the south side of the wall on your neighbor’s property and there is parking on the north
side of that duplex, it is conceivable that a vehicle can be parallel parked close enough to
the wall to create a surcharge. The parameters of our code don’t allow for any exceptions
to the engineering requirement in this case.
The only options available to avoid submitting engineered calculations and plans for the
retaining wall permit would be to somehow permanently prevent the surcharge. In
similar instances some have made a pavement cut equal in distance from the wall to the
height of the wall along the surcharged side and then used that area for landscaping.
Another possibility is adding extruded curb along that side to assure that no surcharge is
created. Of course all options would require cooperation with your neighbor.
