During review of the above noted application, it was found that the following information, corrections, or
clarifications are needed. Please submit three (3) sets of revised plans/documents with a written response
to each of the items below to an Engineering Technician.
Engineering cannot approve the revision of the location of the wall until the requirements of the
Encroachment permit are inet. The following are the outstanding items still needed from the original
comments sent on August 13, 2007 (copy included).

Please revise the site plan and section view to show the limits of paving in the alley to the east of the proposed upper
retaining wall. If the paved surface is located within 6' of the proposed wall (this distance based on the height of the wall
being 6') then it will need to be designed by a licensed engineer to support a surcharge. Design and calcs would need to
be submitted to the City and would be sent out for peer review. Please refer to City standard detail E8.12.1 Surcharge for
rnore information on surcharges.

The width of the alley is 15'. The proposed encroachment into the alley will only be considered at half the width of the
alley. The site plan submitted with this application shows an encroachment into the alley of 9' 6". Please revise the
plans to reflect a retaining wall encroachment of no more 7' 6" or consult with the neighbor and have them apply for an
encroachment permit for the portion of the wall that crosses the north half of the alley.

The site plan submitted showing the encroachment will be Exhibit "B" of the encroachment agreement. The cross
section of the retaining walls will also be considered Exhibit "B". Both of these documents will be recorded at
Snohomish County and must meet County recording requirements. Please revise as follows:
• Provide I" margins
• Clearly indicate area of encroachment on the site plan

The encroachment permit application states under description of encroachment: Two retaining walls across vacated
alley. It is my understanding that this alley is not vacated, but simply undeveloped, I will revise the application
accordingly.
8. Slill Need.
The encroachment permit agreement also states vacated alley. I will ask that you revise this page of the agreement to
reflect undeveloped alley versus, vacated and also ask that you provide it more detailed description of the encroachment.
The description of encroachment should include how many feet into the alley the retaining walls are encroaching as well
as the height of the walls.
** It has been discussed and approved by our City Engineer that it would be possible to draw up it private agreement
between you and your neighbor instead of requiring your neighbor to obtain an encroachment permit. This would
probably be a much more amenable idea and definitely less costly for your neighbor. A private agreement could be
drawn up, notarized and recorded that (to describe it in bareboncs terms) grants permission by your neighbor to you to
build your retaining wall in "his fialf" of the right of way. The agreement would hold Your neighbor harmless from
liability from any claim, maintenance, repair etc. in connection to the retaining wall. The agreement would be recorded
and run with the land.
If you decide that this is how you would prefer to handle the situation, Our City Engineer would write up the
agreement once we received the following;
1) A signed note from your neighbor giving his approval and intention of signing at) agreement as
described.
2) Your neighbor's name and address and phone number for the document.
Once the document has been completed a copy will be provided to You and your neighbor for review. If both pal -ties
approve then;
1) Both parties will be required to sign the document with a notary present (usually there is a notary
available in our office, call ahead to check if you want to sign here).
2) A recording fee will be required (amount to be determined). Currently Recording fees are $55 for the
first page and $1 for each additional page. Both parties will need to pay the recording fee as the
document will be recorded against each property separately.
