This letter is in response to your letter dated December 29, 2008. As explained during our
conference call with you on December 23, 2008 (with City Engineer, Assistant Building
Official and Building Official in attendance), approved Fire Department access•roads to
buildings are regulated under the 2006 International Fire Code (ECDC 19.25.050) and
enforced by the City of Edmonds Fire Marshal- The Fire Marshal approved the design of the
access road improvements and surface material as part of the 4 -lot subdivision. to service the 4
future homes. The Fire Marshal has confirmed that the approved access road must be
installed in order to provide adequate Fire Department access as required by code. This
information was also explained to you in a conference call on January 13, 2009 with the.
Development Services Director, Building Official and Engineering Program Manager.:
You have chosen to construct two houses prior to finishing the road improvements that are
required for adequate Fire Department access to serve those houses. As explained to you
during the conference calls, a new single family residence must have a current valid building
permit until a Certificate of Occupancy is issued by the Building Official. The Certificate of
Occupancy cannot be issued by the Building Official until the access to the building is
approved by the Fire Marshal. Since the building permit has expired, a new building permit
must be obtained.
Edmonds Community Development Code (ECDC) 18.80.060 requires driveway approaches
to be paved from the edge of the existing street a distance of 20 -feet or to the edge of the
property line, whichever is greater. This code requirement is enforced by the Engineering
Division and therefore was noted on the correction notice issued by the Engineering inspector.
However, the more stringent requirement to pave the entire access road, as required by the
Fire Department, supercedes the Engineering Division requirement to pave only a portion of
the road.

On December 17, 2007 a performance bond was posted by Zimmerlund Construction,
providing a guarantee to the City that all subdivision improvements would be completed
within 12 months or by December 16, 2008.
Prior to issuance of your civil construction drawings the City worked with you in an effort to
allow construction of the curb, gutter and sidewalk on 96th Ave W_ After several meetings
and a considerable amount of staff time in 2007, agreement could not be made_ However, the
City was willing to revisit the issue and you agreed to submit a revised cost estimate for
review. As you were informed in our telephone conversation on January 16, 2009,
Engineering reviewed your revised cost estimates and determined that $6,900 would be the
correct amount to apply toward walkway improvements on 96th Ave. W., in -lieu of installing
sidewalks on 981h Ave. W.
You have agreed that you will now proceed with installing the frontage improvements on
224`h St S.W. along with the private access road into the subdivision, per the short plat civil
drawings approved July 26 2007, and that the improvements will be completed within two to
three months.
To resolve these issues, you agreed to the following:
• By January 28, 2009, you will obtain a new building permit for the subject house and
pay for all remaining individual inspections for Building and Engineering Divisions to
grant final approval of the house ($60.00 per inspection), as well as administrative and
surcharge fees. You will install the required Fire access road, call for all remaining
inspections and obtain final occupancy approval. The new building permit will expire
on March 31, 2009. If the permit expires without obtaining final occupancy approval,
a new building permit is required, including new fees as set forth in ECDC
19.00.005(7).
• You will contribute $6,900 towards walkway improvements on 96th Ave. W., The
walkway improvements on 96th Ave W are being constructed as a joint project with
several other developers. Mr. Jinn. Henricks of BDZ Construction is taking the lead to
build the improvements within the next few weeks. You will need to contact Mr.
Henricks and coordinate payment of your contribution with him.
• You will install all required right-of-way improvements and the private access road no
later than March 31, 2009, and
• You will provide a typical cross-section including a thickened asphalt edge for the
drainage improvements to be installed in the 98'h Ave. W. right-of-way. Please submit
this detail for engineering review and approval by January 30, 2009.
