application for the Planning Division and it was found that the following information,
corrections, or clarifications will need to be addressed before the Planning Division review can
continue. If you have any questions, please do not hesitate to contact me. I look forward to

Please provide a written response to the items mentioned below…
1.Reasonable Accommodation:
The proposed covered carport/ramp addition does not meet
the required north, east, or west setbacks for the zone. Please review the enclosed
“reasonable accommodation process” (ECDC 17.05) and understand that, when approved,
the owner will need to file a notarized covenant with the county auditor’s office (including
their recording fee) that outlines the requirements of the code. This type of land use permit is
called a “staff decision” – please submit the following to the Planning Division for the land
use file so that I can begin working on the permit…
a.
Completed and signed land use application.
b.
Review fee ($130).
c.
Notarized APO list (see handout, enclosed).
I already have a copy of the note from the doctor, which explains that this new construction
is medically necessary. In the mean time, I will begin drafting the covenant that will need to
be recorded. Please understand that a required condition of approval for the proposed new

addition is that it will need to be removed when Mr. Tauber no longer resides on the
premises (ECDC 17.05).
2.Height Calculations:
Please revise the height calculations on the site plan and elevations –
I’m sure the project will remain under the required 25’ height limit because it is one single
story, however, this needs to be clearly shown on both plans. Right now your site plan
shows an actual height of 0’ (100.8). Please revise accordingly – see handout, enclosed.
