Thank you for submitting a building permit application for a at in the
RS-12
zone. I have re-reviewed the above building permit application for the Planning Division and it was found
that the following information, corrections, or clarifications will need to be addressed before the Planning Division
review can continue. Please provide a written response to the items mentioned below…
1.Fence:
The new photos submitted appear to show a tall fence (over 6’) along the eastern side of the site –
please confirm the height of this fence and review ECDC 17.30 (enclosed) which requires a 6’ fence max plus
the possibility of up to two additional feet of “trellis.” Please submit fence details for review.
2.Site Plan:
The new photos show that the proposed deck is not aligned with the south wall of the house as is
indicated on the site plan. Please review the site plan that was submitted and make the site plan consistent with
the proposed deck (if the proposed deck protrudes further south than the south wall of the house, please show
this bump-out on the site plan). Please revise the measurements indicated on the site plan if necessary. The
minimum south setback is 25’.
3.Deck:
Thank you for providing additional information on the proposed enclosed deck. It is shown 22’ from the
south property line when 25’ is required. However, the code may allow it to protrude up to four feet into the
required setback (so, a distance of 21’ from the south property line) if it is unenclosed (having no guard rail or
fence around it).
ECDC 16.20.040.C
states: “Uncovered and unenclosed porches, steps, patios, and decks may project into a
required setback not more than one-third of the required setback, or four feet, whichever is less; provided, that
they are no more than 30 inches above ground level at any point.”
So, please either (1) please remove the fenced enclosure around the perimeter of the deck so that it is
“unenclosed” and can remain as close as 21’ from the south property line, or (2) please remove the south three
feet of the deck so that it is 25’ from the south property line.
