20110919110127255.pdf0006.900000 WSS/gjz 8/3/00 ORDINANCE NO. 3321 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF EDMONDS TO CHANGE THE ZONING DESIGNATION OF CERTAIN REAL PROPERTY LOCATED AT 300 SECOND AVENUE SOUTH FROM NEIGHBORHOOD BUSINESS (BN) TO PUBLIC (P) AND FIXING A TIME WHEN THE SAME SHALL BECOME EFFECTIVE. WHEREAS, after public hearing and deliberation by its Planning Board, the Planning Board has recommended to the City Council amendment of the official zoning map to change the zoning of a functional wetland located adjacent to the City's sewer treatment plant and in the ownership of the City of Edmonds from neighborhood business (BN) to public (P); and WHEREAS, the site is designated on the City's Comprehensive Plan as devoted to public use; and WHEREAS, following public hearing, the City Council finds that the review criteria of ECDC 20.40.010 have been met in that, due to certain changes in the character and ownership of the land, i.e., such property is in public ownership and has now been classified a wetland, it is not therefore subject to further development or change under current federal and state law and local ordinance; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. The official zoning map of the City of Edmonds is hereby amended to change the zoning classification for the property legally described on the attached Exhibit A and {WSS443748.DOC;1/00006.900000/} - 1 - shown on the site map, Exhibit B, from Neighborhood Business (BN) to Public (P). The legal description and site plan shown on the attached exhibits are incorporated by this reference as fully as if herein set forth. Section 2. The Planning Director is hereby instructed to effectuate the necessary amendments to the official zoning map of the City of Edmonds pursuant to this ordinance. Section 3. If any section, sentence, clause or phrase of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this ordinance. Section 4. Effective Date. This ordinance, being an exercise of a power specifi- cally delegated to the City legislative body, is not subject to referendum, and shall take effect five (5) days after passage and publication of an approved summary thereof consisting of the title.
