ORDINANCE NO. 3105
AN ORDINANCE OF THE CITY OF EDMONDS,
WASHINGTON, REZONING CERTAIN REAL PROPERTY
LOCATED AT 8629 - 238TH STREET S.W. FROM SINGLE-
FAMILY RESIDENTIAL (RS -8) TO MULTIPLE RESIDENTIAL
(RM -1.5), PROVIDING THE DESCRIPTION OF THE
PROPERTY, AND FIXING A TIME WHEN THE SAME
SHALL BECOME EFFECTIVE.
WHEREAS, on July 2, 1996, the Edmonds City Council held a hearing regarding
the rezone of the property described in File No. R-96-59 from single-family residential (RS -8)
to multiple residential (RM -1.5), and
WHEREAS, the property located at 8629 - 238th Street S.W. in the City of
Edmonds, Washington was recently annexed from unincorporated Snohomish County, and
WHEREAS, the subject property is completely surrounded by land zoned multiple
residential (RM -1.5) and is developed with multi -family residential development, and
WHEREAS, the City Council finds that the staff report and the evidence
submitted indicates that the rezone is in compliance with the State Environmental Policy Act,
the Edmonds Community Development Code (ECDC) and the Edmonds Comprehensive Plan,
and

WHEREAS, the Edmonds City Council finds that the evidence introduced at the
hearing establishes that the criteria of the ECDC for a rezone have been satisfied, NOW,
THEREFORE,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. Certain real property located at 8629 - 238th Street S.W., Edmonds,
Washington, containing 8,127 square feet more or less and legally described in File No. R-96-59
and Exhibit A attached hereto and incorporated herein by this reference as if set forth in full,
is hereby rezoned from single-family residential (RS -8) to multiple residential (RM -1.5).
Section 2. Severability. If any section, sentence, clause or phrase of this
ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction,
such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other
section, sentence, clause or phrase of this ordinance.
Section 2. Effective Date. This ordinance, being an exercise of a power specifi-
cally delegated to the City legislative body, is not subject to referendum, and shall take effect
five (5) days after passage and publication of an approved summary thereof consisting of the
title.
