AN ORDINANCE OF THE CITY OF EDMONDS,
WASHINGTON, REZONING CERTAIN REAL PROPERTY
LOCATED SOUTH OF 220TH STREET SOUTHWEST, NORTH
OF 224TH'STREET SOUTHWEST, EAST OF 76TH AVENUE
WEST AND WEST OF THE EXISTING "CG" ZONING,
COMPRISING APPROXIMATELY 10.5 ACRES FROM
MULTIFAMILY RESIDENTIAL (RM 2.4) TO GENERAL
COMMERCIAL 2 (CG2), PROVIDING A DESCRIPTION OF
THE PROPERTY AND FIXING A TIME WHEN THE SAME
SHALL BECOME EFFECTIVE.
WHEREAS, on December 5, 1995, the Edmonds City Council
held a hearing regarding the rezone of property described in File
No. R-95-143 from multifamily residential 2.4 to general commercial
2 (CG2), and
WHEREAS, the City Council finds that the staff report and
evidence submitted indicate that the rezone is in compliance with
the State Environmental Protection Act, the Edmonds Community
Development Code and the Edmonds Comprehensive Plan, and
WHEREAS, the evidence introduced at the hearing indicated
that the criteria of the Code were met and no contrary evidence was
presented to the City Council, the Edmonds City Council therefore
finds that all the criteria established by the Edmonds Community
Development Code to rezone the real property described herein have
been met, NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:

Section 1. Certain real property located at south of
220th Street Southwest, North of 224th Street Southwest, East of
76th Avenue West and West of existing CG zoning in Edmonds,
Washington, and consisting of approximately 10.5 acres as legally
described in File No. R-95-143 and Exhibit A, attached hereto and
incorporated herein by this reference as if set forth in full, is
hereby rezoned from multifamily residential (RM 2.4) to general
commercial 2 (CG2).
Section 2. Effective Date. This ordinance, being an
exercise of a power specifically delegated to the City legislative
body, is not subject to referendum, and shall take effect five (5)
days after passage and publication of an approved summary thereof
consisting of the title.

EXCEPT
Any portion of said westerly 337 feet of said Section 29 lying east of the
following described line: Beginning at the southwest corner of Swan's Addition,
as recorded in Volume 16 of plats, Page 110, records of Snohomish County, WA;
thence southerly, parallel with the west line of said Section 29, a distance of
306.09 feet to a point lying 62 feet north of the north line of the condominium plat
of Westwood, as recorded in Volume 39 of plats, Page 102, records of Snohomish
County, WA and the terminus of said described line.
AND EXCEPT
Any portion of said westerly 337 feet of said Section 29 lying east of the
following described line: Beginning at a point on the southerly line of the
condominium plat of Westwood, as recorded in Volume 39 of plats, Page 102,
records of Snohomish County, WA, lying 285 feet easterly of the west line of said
Section 29; thence South 0°44' West, parallel with said west line 125 feet; thence
North 89°05'58 West 20.00 feet; thence south 25° 44' West 154.22 feet to the
north line of the south 100 feet of the southwest quarter of said Section 29, thence
southerly 75 feet more or less to a point on the northerly right of way margin of
224th St. S.W., lying 151.87 feet easterly of the west line of said Section 29 and
the terminus of said described line.
The intent of this legal description is to include the following Assessor's Tax Parcels, all
lying within the northwest quarter of the southwest quarter of Section 29, Township 27
North, Range 4 East, W.M. as existing on December 20, 1995.
