ORDINANCE NO. 2487
AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON,
AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF
EDMONDS, WASHINGTON, BY CHANGING THE ZONING
CLASSIFICATION OF CERTAIN PROPERTY FROM RS -12 TO
RS -8, AND FIXING A DATE WHEN THE SAME SHALL BE
EFFECTIVE.
WHEREAS, the Planning Board of the City of Edmonds,
Washington, held a public hearing to consider rezoning a certain
parcel of real property in the City of Edmonds from RS -12 to RS -8
and after said hearing, forwarded its recommendations to the City
Council in Planning Board Decision #R-2-84, and
WHEREAS, the City Council of the City of Edmonds,
Washington, considered the Findings of Fact, Conclusions and
Recommendations of the Planning Board as contained in its
decision, public testimony at public hearing, and the report from
the City staff, and
WHEREAS, based on the foregoing, the City Council
determined as follows:
1. That the Council finds the following facts and reaches
the following conclusions of law based upon its review
of the public testimony, the staff reports, and the
recommendations of the Planning Commission that:
A. The proposal to rezone herein described
property from RS -12 to RS -8 is consistent
with the comprehensive plan;
B. The proposal is consistent with the purposes
of the zoning ordinance and with the purposes
of RS -8 zoning as set forth in the Community
Development Code;
C. The proposed RS -8 zoning is consistent with
the size and use of the tracts immediately
surrounding it, as well as with the zoning of
said tracts;
D. Due to the nonconforming nature of the lots
immediately north of the subject tract being
RS -8 in character and use, despite their RS -
12 zoning, a significant change in the
character of the immediate area justifies the
rezone;
E. Council specifically finds that the property
is economically and physically suited for
RS -8 zoning and residential use; and
F. Council further finds that the relative gain
to the public health, safety and welfare
justifies the rezone, and there is no
potential decrease in value threatened to the
property of any person in the area of the
rezone.
2. There are no significant adverse environmental impacts
to the surrounding properties either within or without
the jurisdiction of the City of Edmonds which will -be
affected by the proposed zoning classification of the
property or the proposed uses, now, therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS;
Section 1. The official zoning map of the City of
Edmonds, Washington, is hereby amended by changing the zoning
classification from RS -12 to RS -8 of certain real property, all
situate in the City of Edmonds, Snohomish County, Washington, and
more particularly described on Exhibit "A", attached hereto and
incorporated herein as if set forth in full.
Section 2. The Planning Department Director is hereby
instructed to effectuate the necessary amendments to the official
zoning map of the City of Edmonds, Washington, consistent with
this ordinance.
Section 3. This ordinance shall be in full force and
effect five (5) days after passage and publication by posting as
provided by law.
