When reviewed against the current RM -1.5 code this extra unit was found t� o bei excess of what the zoning allows The parcel is approximately 26,571 square feet and each dwelling unit reauires 1,500 sauare feet of lot area resulting in 17.7 possible dwelling units for the parcel (17 units practically since the City rounds down). In looking at the history of the parcel, the Mariner Apartments were legally constructed as two buildings in 1964 under building permit number BLD -1964-0220 Building A (533 Alder) contained eight units and Building B (555 Alder), nine. The parcel was zoned R -6A at construction which allowed the construction of multiple family dwellings. At some point after the original 17 units were constructed in 1964 and prior to when The Mariner was incorporated as a condominium in 1974 the additional unit was added to the basement of BuildingBB without a buildingep unit. The City was unaware of the additional dwelling unit until the pre -application for remodel was received in 2008 prior to application for building permits to complete the remodel work (BLD -2008-0456 and -0457) Due to the length of the use and the inability to establish when and how it was created the unit is considered to be a legal non -conforming unit It will be allowed to continue subject to the Homeowner's Association hiring a registered architect to perform a life -safety inspection to 2006 IBC dwelling unit codes and submittal of a report to the Building Official for review. If the report calls out building code life -safety issues the Homeowner's Association will be required to obtain a permit to correct the deficiencies. This determination was made based on the following information and documentation: The original building pgnnit for the structures was reviewed (BLD -1964-0220) as was the zoning code applicable at that time. The Condominium Plan for The Mariner front 1974 was also reviewed Date Annexed: NA Date Constructed: 1964 Zoning at Time of Annexation: NA Occupancy Group: NA No. of Storles: Building_B (Three plus basement) No, of Units: 10 units in Building B This determination is made with the understanding that the status of the parcel may be altered by amendments to the Edumnds Community Development Code (ECDC) adopted subsequent to the issuance of the determination and provided that the City shall not be liable for damages for its action to amend the ECDC affecting this determination. This determination shall be null and void if any activity, action, or omission as listed in ECDC Chapter 17.40 occurs which would terminate the nonconforming status.
