Subject: Request for Information Regarding Tree Cutting at 8001 Talbot Road
Ms. Schuetz and Mr. Schlecht:
It has come to the City's attention that a tree cutting occurred on the property located at
8001 Talbot Road. The site of the tree cutting occurred on property that includes slopes in
excess of 40% and adjacent to a stream. This area is classified as a critical area pursuant to
Edmonds Community Development Code (ECDC) 23.40, 23.80, and 23.90 including potential
landslide hazard area and fish and wildlife habitat for the stream. Since the site of the tree
cutting activity was located within and adjacent to critical areas, a tree cutting permit and critical
area review would have been required pursuant to ECDC 18.45.020 and ECDC 23.40. No such
review was requested from the City of Edmonds in conjunction with the subject tree cutting.
This action constitutes a code violation which may be subject to treble penalties due to the
location within critical areas and their associated buffers in accordance with ECDC 18.45.070.
In order to rectify the situation, mitigate impacts to the critical areas, and inform enforcement
actions including potential fines, please respond to the following:
1. Please provide a report from a certified arborist detailing the extent of the cutting activity.
The report must include a site plan identifying the location of all cutting activity, the
species of the trees and other vegetation that was cut, the diameter of the vegetation that
was cut, an assessment of the health of the trees that were trimmed and likelihood of
survivability.
2. Please provide a geotechnical report assessing the impact of the tree cutting on the slope
and recommendations regarding the cutting debris that was left on the slope and in the
stream bed.
3. Please provide a mitigation plan consistent with the minimum performance standards for
restoration detailed in ECDC 23.40.240.C. Additionally, the site was subject to a
mitigation plan associated with the Talbot Road wash out in 2008. If the tree activity
impacted the mitigation area, the mitigation site must be restored consistent with the
Terrace Creels Culvert Replacement & Stream Restoration Plan (enclosed).
Since cutting activity occurred on property owned by other parties, authorization must be
received prior to entering the site to conduct restoration activities.
This letter is addressed to the parties believed to be responsible for the tree cutting activity. Ms.
Shuetz as the party requesting the cutting and Edmonds Tree Service as the company carrying
out the action. Please coordinate the responses to the above requested items and designate a lead
contact for moving towards restoration of the site.
