The following are my comments 1. I observed no new cracks in the neighbor's property to the north. 2. The buttress is in good condition and performing properly. 3. Erosion control is performing well and no erosion is moving off site. 4. After a thorough discussion of alternatives, the owners have elected to submit a redesign of the house that will not require steep or deep cuts on the property - and so no temporary shoring of any kind will be required to complete construction. 5. The existing excavation will be filled in - we intend to start this process as early as tomorrow and finish it up by next Tuesday/Wednesday. As much as practical the owners intend to restore the previous grades (prior to any excavation). 6. A filter fabric fence will be installed along the entire roadway. 7. The site will be left to sit over the wet winter season while the redesign in submitted and approved. It is hoped to begin construction anew in April of next year. I have asked Mark Dodds to respond with the view to prepare a report for you on this Friday. Our Builder met with a contractor this afternoon "Pile King " in Kent WA ( one of the top companies in Washington state who install these type of retaining wall, who have accepted the work in an expedited mode next week to install a pile shoring wall in next week (Scheduling for this is our 3 weeks right now ). I have also asked Mark Dodds to go to the site and inspect the site tomorrow , from the city supplied photo below can you indicate where this crack is? We are moving as fast as possible and have responded to all requests, though we need more information from you to respond expeditiously . It is not clear to me if you are asking for another Geotech engineer's report or can Mark Dodds provide this — please clarify You state This independent review shall be performed by a qualified technical consultant selected by the City with all costs passed through to the property owner. And then ask me to supply a report by Friday . So are you ordering a report from another Geotech engineer independently and passing the cost on ? in which case you are in control of the report for Friday. Or can we have Mark Dodds supply this report, who has studied this lot extensively over many years. I will call your office first thing to get clarity on this. The soils crack appeared after the construction work on 932 Olympic had begun and heavy cuts had been made into the steep slope near the shared property line, below the location of the soils crack. In light of this development, it is the opinion of the City that the current approach to stabilizing the slope may be insufficient. As a condition of further construction activity on the site, the City shall require a new geotechnical report outlining a new approach for slope stabilization. The report shall address site mitigation necessary to meet short term and long term protection of the steep slope consistent with Edmonds Community Development Code Title 23: Natural Resources. The report must be provided to the City prior to 4 pm Friday, September 25, 2015. The City intends to exercise its right under ECDC Chapter 23.40.090 Section B (see below) to require an Independent Review of the report once submitted. This independent review shall be performed by a qualified technical consultant selected by the City with all costs passed through to the property owner. 23.40.090 B. Independent Review ot Critical Areas Reports. Critical areas studies and reports on geologically hazardous areas and those developed by an applicant representative or consultant not as part of a three -party contract may, at the discretion of the director, be subject to independent review. This independent review shall be performed by a qualified technical consultant selected by the city with all costs borne by the applicant. The purpose of such independent review is to provide the city with objective technical assistance in evaluating the accuracy of submitted reports and/or the effects on critical areas which may be caused by a development proposal and to facilitate the decision-making process. The director may also have technical assistance provided by appropriate resource agency staff if such assistance is available in a timely manner. Please understand that our intent is to protect the stability of the soils and structures located on your site as well as on adjoining properties by administering the City development code. Please send the new slope plan to me directly prior to 4 pm Friday, September 25, 2015. Thank you.
