the Seattle Skating Club. The contractor doing this remodelingtfor the
skating club- Lauren Wade, mentioned the City of Edmonds had a�;new sewer
plan coming along the E elevation of Fighway 99N.
i spoke to !-1r. Jerry Bauth yesterday about the plan, and suggested that I
c-rant an easement to the City of Edmonds to allow a pipe to traverse our

property to The PVD right of way, and across that to hook into the conjoined
Ldro.onds-Moi,ntlake Terrace sewer system.
3 Years ago, Pat Wilson of the City of Edmonds Engineerin Dept.

contactinF Joel Birchman of the City of Mountlake UUerrace Enpineering Dept.,
and the Snohomi8h County PUD for a letter of aDproval with the use of a
variable flow meter. At about tlUs time period, Mr. Britain desired space
on top of Consolidated Beverages, but was so undecided as to what his reoirements
might be, that my appearance before the Edmonds Architectural Board.put
everything on hold. An extensive file was presented to 114r. Finke of the
Architectural Design Board$ which is immediately available to you. In April
of 1-986, the PUD asked for an easement along 220th for their power poles,
and I met with Bob Thompson of the Sno. Co. PITD discussing an easeme-nt for a
-sewer line crossing the PUD right of way to x join the main sewer on the E
elevation of the right of way. His retort- "Whatts the TroblemIll. He provided
me with all of the details to accomplish this, and I herewith hand over all
�hese papers to you for your perusal, Since nothing was firmed up with Mr.'
Britain, everything bas been placed on hold.
I granted the RM an easerrent of 5' to the S of Prairie �-iarket, and they
obtained another 59 easement from the Alaska Way Motel to bring the power
lines to Britian's steel warehouse in 1978. 1 mention this,, as it -A.ght be
a simple ap.-proach to bring a pipe from Highway 99N through the property
following the S property linesq since there are no utilitien or obstructions
for trenching. A clear, clean shot. Or you could go between Prairie I'Viarket
and the Cameo building, or between the Cameo builing and Britianla and thence
dumn to the PUT) right of wayg except for consideration of disrupting parking
for a time period,
I request help from the Edmonds Engineering Dept. to expand parking in the
SE and SW corner behind now the Seattle Skating Club for their use. I will
be happy to meet with you on site, and go over varions possibilities,

A. Description of the Subject Property and Surrounding Area
The Applicant is seeking a conditional use permit to allow
the construction of a temporary parking lot for the Seattle
Skating Club at 22025 Highway 99. The property is
undevel oped.
The lot slopes moderately to the east and south. It is
situated below the Seattle Skating Club building and behind
the Consolidated Beverage building..
Surrounding development is primarily commercial, with the
exception of multiple family to the south.

As conditioned, the requested conditional use permit does
not appear to conflict with the purposes of the Zoning
Ordinance or the CG zone.
D. Comp-ehensive Plan
The subject property and surrounding area is designated as
Highway 99 Commercial.
The proposed conditional use permit does not appear to
conflict with the purposes of the Comprehensive Plan.
E. Not Detrimental
The proposed use should not be significantly detrimental to
the public nor to nearby private property or improvements.
A declaration of nonsignificance has been issued on this
project.
F. Transferability
The permit should not be transferable.
V. STAFF RECOMMENDATION:
Staff recommends approval of CU-59-87, subject to the following
conditions:
1. The Applicant shall submit a parking plan to the City showing
exact parking stall configurations.
2. The Applicant shall submit a drainage plan for review and
approval by the City Engineer.
3. The Applicant shall be responsible for cleaning up all fill
material on site.
4. The Applicant shall submit a landscaping plan to the
Architectural Design Board (ADB) for review and approval.

1) Granting of easement to the City of Edmonds through our property for
a main trunkline sewer system. (Per letter to Mr. Bob Alberts,
City Engineer 3/17/8?)-
1 2) Allow ingress/egress to the undeveloped vacant land for:
a) Roofing repairs and other maintainance for CBI annex.
b) Helping security for CBI (check with Edmonds Police Dept.).
c) Removal of graffiti- S. wall CBI annex (done).
d) Removal of the dope den, and closure of the old road from the PUD
right of way as a source of vandalism to CBI and the Millpark
Condominiums (check with LowZ-1 Ingrahm at Millpark Condos and the
Edmonds P61ice Dept.)(Not completed due to dusty conditions from
a hot dry summer).
e) Removal of rubbish and general cleanup (not completed due to dust).
This is why, years ago, I placed a berm from Britain's steel
building to behind SSC to prebent the general public from dumping
garbage on our proDerty.
f) Easing of encroachmant of overload -parking of SSC on Cmmeo Realty,
Britiin's, and CBI.
On removin- trees and brush, it was found the Millpark Condominiums
are draining their roof scuppers onto our property. Erosion and
scouring could occur, which would change ythe situation as it stands
now. Observation and inspection during our rainy season, any snow
or freeze -thaw cycle will determine what action to take.
3) Request by CBI to expand their warehouse facilities with semi -truck
loading and unloading in the SE property area.

4) Request by Britain's to build on top of CBI's expansion for more
warehouse space and garage their vehicles, removal of Britaints
steel building, and provide more parking 6or SSC, Britain's, and CBI.

FINDINGS OF FACT
1. The Applicant has requested approval of a conditional use
permit for a temporary parking lot to be located at 22025
Highway 99, City of Edmonds, Washington. (Staff Report)
2. The subject property is used by the Applicant who operates
the Seattle Skating Club on site. Also on the subject property
is the Consolidated Beverage building and the Cameo Properties
building. (Exhibit 4)
3. The area that is proposed to be the temporary parking lot
is immediately to the west of the Skating Club building, in the
northwest corner of the subject property. It is an undeveloped
parcel of land that is projected to provide parking for the
customers of the skating club. (Behla Testimony)
4. The subject property is zoned general commercial (GC). The
property to the south is zoned RM 1.5.
5. The Edmonds Community Development Code (ECDC) 17.50.090
requires that a temporary parking lot may be constructed and
maintained only with the use of a conditional use permit.
(ECDC)
6. Conditional use permits within the City of Edmonds are
reviewed with the criteria as set forth in ECDC 20.05.010.
These criteria include:
a. The proposed use must be consistent with the
comprehensive plan of the City of Edmonds;
b. The proposed use and its location must be consis-
tent with the purposes of the zoning ordinance in
which the property is located; and
C. The proposed use must not be significantly

CONCLUSIONS
1. The application is for the approval of a conditional use
permit for the construction of a temporary parking lot at 22025
Highway 99, Edmonds, Washington. The temporary parking lot
would be for the use of the Seattle Skating Club.
2. In order for a conditional use permit to be granted within
the City of Edmonds, the criteria of ECDC 20.05.010 must be
satisfied. With conditions, the criteria are satisfied.
3. A conditional use permit is required for the temporary
parking lot pursuant to the terms of ECDC 17.50.090.
4. The Applicant is required to meet the public improvement
and dedication requirements for permanent use, of the Director
of Community Services. These requirements are set forth in the
recommended conditions of approval.
5. The requested conditional use permit is consistent with the
purposes of the GC zone as set forth in ECDC 16.60.005. These

purposes have been reviewed and are satisfied by the Applicant.
6. The requested conditional use permit is consistent with the
comprehensive plan designation of Highway 99 commercial. It
will provide a parking area that is clearly defined to eliminate
confusion of driveways, streets and parking areas. This is in
conjunction with the provisions of ECDC 15.15.03OB(2.a).
7. The requested conditional use permit will not be detri-
mental to the public nor to nearby private properties or
improvements.
DECISION
Based upon the preceding Findings of Facts and Conclusions, the
testimony and evidence submitted at the public hearing, and upon
the impressions of the Hearing Examiner at a site view, it is
hereby ordered that the requested conditional us ' e permit,
CU-59-87, for the approval of a temporary parking lot at 22025
Highway 99, Edmonds, Washington, is granted subject to the
following conditions:
1. The Applicant shall submit a parking plan to the city
showing the exact parking stall configurations. In this sub-
mittal the exact number of parking spaces shall be identified.
2. The Applicant shall submit a drainage plan for review.and

A property owner just east of the Seattle Skating Club has obtained a
conditional use permit for a parking lot to handle overflow parking for
the Skating Club (see location on attached map). The property owner is
hesitant to complete the conditions of approval imposed by the Hearing
Examiner for the use permit (e.g., paving, landscaping, drainage
improvements), because of a proposed sewer line planned in the vicinity
of the property. He suspects the sewer line will run through his
property.
Jerry Hauth tells me that the sewer line location has been determined,
and that it is proposed to run in/adajcent to 220th east of Highway
99, and then to turn south in a PUD right of way east of the Skating
Club property. Apparently, you are handling this project.
I need a drawing or statement which indicates the final location of the
sewer line to show to the property owner. With this information, I can
then work with the property owner to get the parking lot improved as
required by the Hearing Examiner. Any information you can provide
which I can pass along would be appreciated. Thanks.

Dear Mr. Behla,
This letter is a follow up to our meeting at your property east of the
Seattle Skating Club. You mentioned that you were waiting to make
certain improvements to the property, including installing landscaping
and a drainage system, until the City installs a new sewer line in the
area. Your concern is that the sewer line will run through your
property, and that you do not wish to make permanent improvements until
this occurs.
I have checked with the City Engineer on the location of the sewer
line. The location of the line has been determined. The new sewer
line will not run through your property at all. It will run in an
east -west direction along 216th St. SW, and then turn south in the PUD
right of way. In the vicinity of your property, the line will be
installed in the PUD right of way. The sewer line will not run through
your property at all.
As noted in the enclosed Edmonds Community Development code section
regarding temporary parking lots, the conditional use permit approved
by the Hearing Examiner is valid for one year, expiring on November 23,
1988. A one-year extension may be approved with a written request if
the request is filed before the expiration date. After the expiration
date, if you wish to continue using the property as a parking lot,
paving, a permanent drainage system, a permanent parking plan and
landscaping throughout the park,ing lot will be required.
Because the sewer line is no longer an issue, you need to improve the
parking lot as required by the Hearing Examiner. A copy o� the
November 23, 1987 decision is attached. The two most important items
of the decision are landscaping a nd drainage. The city's Architectural
Design Board must approve a landscape plan for the parking lot, and,
for this approval, a proposed landscape plan must be submitted. The
plan will also need to depict the location and size of each parking
space, as called for in Condition 1 of the Hearing Examiner's decision.
An Architectural Design Board application, including guidelines for
landscaping, is enclosed. If you have any questions on the ADB
submittal, please call Bruce Finke of the Planning Division at 771-3202.

Thank you for your letter of January 14, 1988, in which you have clarified
the fact that the proposed new sewer line for the City of Edmonds will not
even run through our property. That solves one problem regarding permanent
improvements, but it does not solve the main problem of the tenants, desires
for future usage of the property; our lease commitments from the tenants
involved regarding terms and conditions have not been confirmed and validated
at this point in time.
Any permanent plans of grade, drainage, plantings at this time without
having bonafide leases is not workable. Development may occur that may do
away with a large part of the parking area. We are expecting an answer and
some resolution to these questions by the middle of this year.
