This inspection was conducted as a result of a complaint registered in our office by the City of Mountlake Terrace regarding an oily sheen observed in Halls Creek. As I discussed with you over the telephone, the storm water from your facility eventually drains into Halls Creek. . Our observations during the inspection indicated that your facility was very poorly managed in term's of potential water quality problems. There were open containers full of petroleum products lying,in the yard area. We saw an overturned barrel with hydraulic fluid running out of it onto the ground. The whole yard area looked very messy. It appeared that the management practices at your facility would result in severe surface and groundwater pollution. The State Water Pollution Control Law, RCW 90.48.080, prohibits discharge of pollutants into state waters. The law provides for enforcement action including monetary penalties by the Department of Ecology for violations of RCW 90.48. The monetar3i penalties for intentional or negligent discharges of oil into state waters could be as high as twenty thousand dollars for each violation. During my phone conversation with you, you had indicted that your facility would soon be moving to 12626 Evergreen Drive, off Mukilteo Speedway. I strongly recommend that the management practices at your facility be modified to prevent discharges of pollutants from your facility into state waters. This may require that the trucks are not washed at your facility. All the containers that contain petroleum products or other chemicals must be stored in a roofed and bermed area. Any containers stored outside must be tightly covered to prevent contamination of stormwater. Also, they must be stored as far away from storm drains as possible. HAHN DIRECTOR Visual inspection of the storm drains adjacent to your place of business has indicated that significant amounts of pollution are entering the storm conveyance system that is tributory to Halls Creek and Lake Ballinger. This is in violation of City, State, and Federal ordinances and laws. We would appreciate the opportunity to discuss measures designed to correct the problem.
