I am writing this as a follow-up to Mayor Fahey's April 1, 1998 letter to you regarding the
required curb installation on your property. As stated in that letter, the curb installation
must have been completed within sixty days of your receipt of the April 15t letter. To
date, you have not notified the City that this work is complete and we have not received
any verbal or written response to the Mayor's April 1 st letter.
In reviewing your file, we find that your permit application will expire on August 9, 1998,
unless an extension is granted. If your curbing is not installed, the City will not be able to
grant you an extension. Without a permit extension, your short plat will be in violation.
The city will then have no choice but to initiate procedures to void your recorded short
subdivision. All of this was clearly explained to you in our April 1st letter.
I would appreciate your response to this letter by noon, Monday, June 8th. If you have
questions, please call me at 771-0220. Thank you for your prompt attention to this
important matter.

I am writing in response to your telephone call of March 91h regarding the City's requiring
you to install curbing at your property. Our staff has reviewed your file on this issue. As
I understand it, the landscaping at the front of your property is located in the City's right-
of-way. When you applied for your subdivision, the City cited the following as one of the
conditions: "Concrete curbs or thickened asphalt edge to be constructed on the
south side of 24e St. S.W. across entire property frontage. Curb face to be
located behind existing catch basins." This was contained in our engineering
requirements form that was signed by City Engineer Jim Walker on May 30, 1996 and
was part of the conditions that were deemed fulfilled, via your posting of a bond, for
recording your subdivision.
While it is true that you posted a bond for this and other conditions, enabling the
subdivision to be recorded, you have not fulfilled the engineering requirement of the
frontage improvements, namely the curbing. Furthermore, the bond that you posted
expired on January 9, 1998. In order for the City not to initiate procedures to void your
recorded subdivision, you must install the curbing within the next sixty days. I fully
understand your frustration in having to tear up the landscaping. However, the fact is
you were aware of the engineering requirement in 1996, yet you still proceeded to put in
the landscaping in the City's right-of-way and not construct the curbing. The City has to
equitably enforce its rules and conditions upon which your subdivision was recorded.
These conditions remain with the property, whether or not you remain the owner. ,The
City therefore has no choice but to require you to install this curb before'g
anting a .

With respect to the issue of the sidewalk, you did not have to install a sidewalk as a
condition of recording the subdivision. My staff made an honest mistake and informed
you of this mistake as soon as they recognized it. However, a sidewalk may be required
as a condition of the building permit. Our Engineering staff will make that determination
during their review of your building plans.
With respect to your perception that the City is harassing you, I would have to have more
facts to make this determination. My staff has tried to explain to you in a diplomatic yet
professional manner why the curbing is required. If you feel our insisting that the curbing
requirement be met constitutes harassment, I will have to respectfully disagree with you.
Staff enforcement of established requirements does not equate to harassment. If you

feel that staffs interactions with you have been harassing, please provide me with
specifics and I will investigate this further.
The Engineering staff visited your property last week and confirmed that the rockery
portion of your landscaping is indeed located in our right-of-way. They have conceived
several options on how you can install the curbing with minimal disruption to your
landscaping. Staff will work cooperatively with you in developing an acceptable plan for
the curbing installation, which must be completed within the next sixty days.

Dear Mr. Elliot:
The City has reviewed your request to remodel the existing accessory building located on your property at
24006 92"d Avenue West. As you may recall, the building was the subject of the following condition of
subdivision file number S-96-71:
"The existing accessory structure located on lot "B" must be removed prior to recording. If the
applicant chooses to retain the structure the applicant must comply with the following:
1. A monetary security equal to the cost of removing the structure must be posted with the
City.
2. A fully complete building permit application to remodel the structure into a single family
residence must be submitted to the City of Edmonds Buildings Division OR A fully
complete building permit application to construct a new single family residence on lot
"B" must be submitted to the City of Edmonds Building Division. "
At the time of recording of the subdivision, you chose to post a bond equal to the cost of removing the
structure and to apply for a fully complete building permit application to remodel the structure into a single
family residence. The City is still holding the posted bond, however the aforementioned permit application
has expired. The City staff has interpreted that by failing to complete the construction indicated on the
aforementioned building permit application, you have failed to comply with the conditions as stated above.
Typically failure to comply with the conditions to complete the required construction would mean that the
accessory structure must be removed. However, since you have submitted a new plan in good faith with
compliance, and since the City continues to be in possession of the posted bond, we have determined you
are not required to remove the accessory structure so long building permit plan check 97-28 and the
subsequent building permit are active. If, at any time, building permit plan check 97-28 and the subsequent
building permit become inactive, you will be required to remove the accessory structure to be in
compliance with subdivision file number S-96-71. No further permit submittals will be accepted for this
site until the completion of building permit plan check 97-28 and the subsequent building permit, or the
removal of the accessory structure.
