Mr. McNaughton stated that this variance is a setback from the property line, but it actually per- tains to the easement, or driveway, Mr. Jack Byrd inquired as to the nature of the structure which is close to the property line. Mr. McNaughton said that it was a garage which was closed off by the people who were living in it before in order to make additional bed- rooms. Mr. McNaughton presented pictures for the Board's review. These pictures were various views of the house as it sits on the pro- perty as well as the house in its relationship to other homes in the area. Mr. McNaughton concluded his statements by stating that the house was a "dump" when he bought it and.that this would certainly make improvements on the house and the property. Ms. Nelson said that she was informed that they had requested a professional -re -survey and she was wondering whether this had been done. Ms. Luster stated that this was in a turnaround area and was a portion of the property. She also said that as far as the re -survey is concerned, it was done and it was determined that Mr. McNaughton would need a 6 inch v4ri- ance. The public portion of the hearing was closed. Mr. Bill Leraas stated that he felt this was a reasonable request because of the fact that the applicant has the required number of feet in a 8,000 zone and that if he so desired to use the lot in the back, he could remove the one wall and that is all it would take without a variance. Ms. Medina stated that this is 6 legal subdivi- sion which has already been approved by the Planning Department and we are addressing ourselves to a variance of 6 inches that exists within the subdivision. She went on to say that she could not see where it would be detrimental to the neighborhood. She further stated that this request was for an ex- tension on a previously granted Conditional Use Permit. Ms. Luster noted the particular details on this hearing stating that in 1976 the applicant had originally been granted a Conditional Use Permit to oper- ate his business from a temporary structure for eighteen months. In November of 1976, the applicant requested a longer period of time and the Board approved a 21-� year Conditional Use Permit at that time. This period of time will expire this month and the applicant is asking for another extension of two years. Ms. Luster showed slides of the busi- ness which is the manufacturing of crab pots and stated that this busi- ness has been in operation for some time and the staff does not feel that it is detrimental to the health, welfare or safety of the public. Ms. Luster stated that there are some screening requirements which wouldhave to be met by the applicant and that these requirements were not enforced previ ' ously because it was a temporary structure. She went on to say that the staff has received information from other people that this business has grown considerably since the original applica- tion for a Conditional Use Permit was approved. Since August of 1978 when the staff was made aware of the intensity of the business, the staff has been keeping a watch on the site and it appears that there is a very large amount of business going on. There are definite plans, Ms. Luster stated, by the Port for the area in which the applicant is located and the Port feels they will implement these plans before the year is out. Ms. Luster went on to state that a structure of this nat ure should be required to come into all of the requirements of the code as far as where this fabrication is done, the screening, the specific storage of it is apparen t that the actual structure is his products, etc. located at 311 Admiral Way, but his business actually spreads out into quite a larg e area. Because of the area t hat his business covers, and because of the apparent growth of his business since hi s initial application, the staff feels that a two-year extension would be excessive. Mr. Peter Musland, owner of the Norsol Company, spoke stating that there is one thing that appears to be unclear regarding the nature of the temporary building. He went on to say that the building is temporary for one reason only a nd that is the fact that it is 10- cated on temporary ground. Mr. Musland said that the Port has not made plans for the area to date and, therefore he cannot Put up had �een looking for an- a permanent structure. He stated that he he other area which would be permanent, but until such time as can locate another site, he feels he should be able to operate in the area he is now in. He stated that he received a "teaser" from the Port inquiring as to how much property he would require in the area. After checking into it further Mr. Musland stated that he found out that he shouldn't plan on havi ng his business on that property. He went on to say that these crab pots are only used in the state of Alaska at certain times during the year, so there are peri- ods of time when they have to be stored. He said that there are live in the City of Edmonds other people in the fishing industry who and also have offices in Edmonds. He said that people who live in e Edmonds and are in the industry have tried to g t the City oriented whereby they would become more interested in the marine industry which he could bring in more money to the City. Mr. David Crow spoke again and said that Mr. Musland does have a good payroll. He hires many young people who are just getting started and provides a good opportunity for the young people in the area . Mr. Bill Leraas inquired as to leasing from the port and Mr. Musland stated whether Mr. Musland was that he was. The public portion of the hearing was closed.
