the Elderly (CU-49-86 & CU-50-86)
Dear Mr. Morgan:
I am writing to notify you that the conditional use permit applications
that you filed for an 80 unit elderly project at 348 - 406 3rd Ave. S.,
Edmonds are being rejected as they do not conform to the provisions of
the Edmonds Community Development Code (ECDC).
The Edmon'ds City Council, in their findings on your previous elderly
housing application, has interpreted the ECDC to exclude projects such
as that proposed as qualifying for reduced parking and increased
density, as allowed under Chapter 20.25 of the ECDC. A copy of the
Council findings is enclosed for your information.
Until such time as the ECDC is amended to allow projects such as the
one you are proposing, the City cannot process your permit
applications. Your application fees will be refunded to you.
You may appeal my decision on this matter. Any appeal must be filed no
later than 5:00 p.m., on December 4, 1986. If you have questions
regarding this matter, you may call me at 771-3202.

I.
INTRODUCTION
1.1 The above named Applicants have requested approval of a
proposed project under the Housing for the Elderly provisions of
ECDC Chapter 20.25. The above -referenced applications request
approval in the nature of a conditional use permit to construct a
96 unit congregate care facility. A iegal GescripLiull — %_Ll�-
project is shown on attached Exhibit A and incorporated by this
reference as if herein set forth. The application requests the
maximum density waiver (one-half of the minimum area required)
and approaches the maximum reduction in parking (five -sixths of
the minimum spaces required) available under ECDC 20.25.010.
1.2 This matter was heard by the city Council on June 3, 1986,
and the record herein shall consist of the Exhibits received at
that hearing, the testimony received at the hearing and any ex
parte matters revealed on the record and thereby incorporated
therein.
Ii.
DISPOSITION OF MOTIONS
2.1 Applicants have filed two motions in this matter. Prior to
the hearing applicants, through their attorney Richard Chapin,
filed a motion to withdraw application V-4-86 for height
variance. This motion was granted at hearing by majority vote of
the Council, and is hereby confirmed. Applicants by their
counsel, filed a motion for reconsideration dated June 5, 1986.
The motion was filed prior to the Council's adoption of these
written Findings of Fact and Decision and therefore prior to its
final decision. Such motion for reconsideration is hereby ruled
to be premature and therefore out of order and in violation of
the provisions of ECDC 20.105.070 relating to the finality of
decision and appeal. The Council finds that only a Councilmember
voting on the prevailing side has the prerogative to initiate
reconsideration of a Council decision and that no such motion has
been made.
2.2 In the interest of fairness to prevent any prejudice to the
Applicants and to dispose of the Applicants' request for a
conditional use permit for grading, the Council has on its own
motion set continued deliberation on the grading permit issue for
July 15, 1986,. The Council acknowledges that its oral motion
failed to address this issue and will dispose of that issue
following deliberation, motion and vote on the record of the July
15 hearing.

FINDINGS AND DECISION C 20.25
DENSITY AND PARKING WA
3.1 FINDINGS: The Council hereby makes and enters the following
this
general Findings of Fact applicable to all phases of
Decision:
3.1-1. The subject property is located on the west side
of Third Avenue South at the west end of Walnut Street in
Edmonds, Washington. The site contains approximately 16,700
square feet of land and slopes westerly to State Route 104. The
western third of the subject property is a wetland area. The
site currently is developed with two single family homes and
the
accessory buildings slated for removal on development of
proposed facility.
3.1.2. The subject property and all contiguous properties
are zoned RM-2.4 in accordance with the provisions of ECDC
Chapter 16.30.
3.1.3. The Comprehensive Plan designates the subject
property for a mixture of low and high density residential uses.
3.2 The proposed project differs significantly in its impacts on
both the public and the surrounding neighborhood from an
apartment use or other multifamily development authorized by the
general provisions of ECDC Chapter 16.30.030, even if dedicated
exclusively to use by persons authorized under ECDC 20.25.020.
Those differences are found to be:
3.2.1. In addition to One and two bedroom apartments with
an average area of 650 and 900 square feet respectively, the

3.2.1.2 Certain facilities to be included will
require staffing, maintenance, supply and/or the services of
outside personnel:
- A central dining room, kitchen and storage facilities
designed to provide at least two (2) meals a day to
the residents and their guests.
- Provisions for medical care through on site
visitations of Doctors, nurses and paramedics;
- A gift shop;
- A supplies commissary;
- A social room with stage;
- A juice bar;
- A beauty shop;
- A bank for limited banking services; and
- A kennel for dogs and cats.
3.2.1.3 Facilities also will be included for the
benefit of residences that may require delivery services but
which will not require unusually heavy service, maintenance or
staffing:
- exercise room and spa;
- sun rooms; and
- library.
3.2.2. The facilities described above will require
staffing to be provided in part by volunteers but primarily by
full and/or part time paid professional staff. Some of the staff
will serve on site and others, such as maintenance and lawn care

personnel will visit the site from time to time to provide
particular services.
3.2.3. Additional, significant traffic will be generated
by this facility over and above that normally associated with a
multifamily residential development.
3.2.3.1 Twenty-four hour staff will generate around -
the -clock traffic to provide services. Staff parking fo.r
personnel and service vehicles will be required.
3.2.3.2 The dining facilities, gift shop, juice bar,
supplies commissary, beauty shop, kennel, bank and library can be
reasonably anticipated to require the delivery of goods from a
variety of different sources, by constant or periodic deliveries.
Such deliveries will include deliveries by large commercial
vehicles - including large trucks. Such deliveries will
therefore increase noise and traffic over and above the traffic
normally associated with multifamily development.
3.2.3.3 The apartment units will contain kitchen
facilities in addition to commercial facilities. Residents
therefore can reasonably be anticipated to go on shopping trips
despite the presence of service facilities.
3.2.3.4 In addition the project will provide van and
limousine service for its residents, generating additional
vehicle trips and parking requirements.
3.2.3 . .5 The applicants initially proposed to provide
49 parking spaces. The Hearing Examiner's decision called for 70
spaces based upon the problems of adjacent elderly housing
projects known as Puget Sound View Apartments and Olympic View

Apartments. Evidence before the Hearing Examiner (and
incorporated in our record) shows that in each case, the elderly
residents of the complex had a number of vehicles equal to or
greater than the spaces made available. The subject property, by
its nature, is designed to attract relatively wealthy, active
senior citizens and those who can be reasonably anticipated to
utilize any additional spaces for their personal vehicles. The
applicant has agreed to provide the 70 spaces called for by the
Hearing Examiner.
3.2.4. The subject property is located convenient to
Harbour Square and downtown Edmonds, both providing shopping,
dining and recreation facilities. Public facilities such as the
library, City parks and public transportation are within walking
distance and accessible by public transportation.
3.3 Based on the Findings set forth in Sections 3.1 and 3.2, the
Council makes the following Conclusions and Decisions. Each
Decision is and shall be severable and serves as a separate
distinct basis for this decision.
3.3.1. The Council denies the Applicants' request for
decreased parking and increased density finding that the proposed
project is a retirement home not eligible for the relaxed density
and parking provisions of ECDC Chapter 2 . 0.25.
3.3.1.1. Retirement home is defined in ECDC 21.85.050.
This definition provides in part that a "Retirement home means a
place of residence for several families or individuals in
apartment -like quarters, which may feature services such as
recreation programs and facilities." (Emphasis added.] The

proposed project incorporates almost every imaginable facility
desirable or necessary for the project to be a self-contained
dwelling place for well-to-do, active senior citizens and is a
retirement home within the definition of ECDC 21.85.050.
3.3.1.2. We find that a retirement home and a project
eligible for the benefits of ECDC Chapter 20.25 were intended to
be and are mutually exclusive because:
3.3.1.2.1 ECDC 16.30.010(A) describing Primary
Permitted Uses establishes Retirement homes as a separate and
distinct category from Housing f or the Elderly; and/or
3.3.1.2.2 The Council takes official notice of the
provision of the prior City code which in Chapter 12.12, Zoning
Definitions, specifically section 12.12.090 "H" terms,
incorporated Retirement Home and Homes For The Aged in the same
generic category, making "facilities" available to each, to wit:
HOME: RETIREMENT, FOR THE AGED. "Retirement home" or
"home for the aged" means a place of residence for
several families or individuals in apartment -like
quarters, rented, cooperative or condominium, which may
feature services to retired persons such as limited
nursing facilities, minimum maintenance living
accommodations, and recreation programs and facilities.
Provisions of the prior zoning code are incorporated by reference
for limited use in the current Edmonds Community Development Code
by ECDC 17.00.050. We conclude that removal of references to
Homes for the Aged from the Retirement Home definition in the
recodification of the Edmonds Community Development Code
evidences a clear intent to distinguish a retirement home from
projects eligible for the provisions of Chapter 20.25; and/or

3.3.1.3 The purpose of the density and parking
provisions of ECDC Chapter 20.25 is to recognize the reduced
impact on the general environment and the immediate neighborhood
brought about by the decreased number of persons in eligible
elderly housing projects and because such projects, due to the
proximity of services required by ECDC 20.25.040 and its
4 vehicle trips and
locational requirements, will generate fewer
deliveries. We find that ECDC Chapter 20.25 is intended for use
only by elderly housing projects which do not incorporate the
extensive "facilities" incorporated in the subject project.
3.3.2 As an alternative, separate basis for denial of
the requested parking and density waivers, we find and conclude
that:
3.3.2.1 In order to approve increased density and
decreased parking under ECDC Chapter 20.25, ECDC 20.25-030
requires review as a conditional use permit.
3.3.2.2 ECDC Chapter 20.05 requires that "no
conditional use permit may be approved" unless it meets the four
criteria of ECDC 20.05.010.
3.3.2.3 We find that the proposed development
violates ECDC 20.05.010(C) in that it is detrimental to both the
public health, safety and welfare and to nearby private property
and improvements, to wit.
3.3.2.3.1 The subject development will generate
significant traffic from onsite staff, offsite staff, deliveries,
visits by visiting professionals and guests as set forth in
findings 3.2.

3.3.2.3.2 In addition, significant traffic will be
generated by the residents themselves because of the relatively
wealthy, active nature of its projected residents.
3.3.2.3.3 We find that the proposed project will
generate as much, if not more traffic than a multifamily
apartment building built in accordance with the standards adopted
by ECDC Chapter 16.30. As such, any reduction in the
requirements of ECDC Chapter 16.30 through Chapter 20.25 would be
contrary to the clear intent of Chapter 20.25, constitute a
detriment to the general public by increasing traffic and parking
without a corresponding or offsetting benefit and constitute a
detriment to the immediate neighborhood by increasing total
vehicle trips, heavy truck and other traffic by delivery
vehicles, vehicle traffic at night due to 24 hour staffing and by
forcing overflow parking onto adjacent neighborhood streets.
3.3.2.4 We further find that because the subject
development is designed for relatively well-to-do senior citizens
rather than low income elderly, no public necessity exists within
the meaning of ECDC 20.05.010(C). While there may exist a need
for housing for low income elderly, we find no evidence in the
record that such a lack exists for the category of senior citizen
who would reside at the proposed development.
3.3.2.5 We further find that the proposed development
does not satisfy criteria ECDC 20.05.010(A) in that it violates
the Comprehensive Plan, to wit:
3.3.2.5.1 It fails to make adequate provision for
offsite or offstreet parking in the downtown area, thereby

forcing parking onto public streets. ECDC 15.30.010(A) and ECDC
15.25.000(D)(4).
3.3.2.5.2 The development would increase traffic
and noise without corresponding benefit. ECDC 15.20.060(B)(4)(d).
3.3.2.5.3 The development imposes burdens from
noise, traffic and parking on the surrounding neighborhood. ECDC
15.20.005(B)(5)(d).
IV
CONDITIONAL USE PERMIT - GRADING
We find that our conclusion as set forth in section 33.1, et seq
compels a decision that the proposed project is not an
appropriate use under ECDC Chapter 20.25 and therefore the zoning
Code. We therefore find and conclude that the proposed
conditional use permit for expanded grading fails to satisfy
criteria of ECDC subsection 26.05.010(3). As issuance of a
conditional use permit requires satisfaction of all four criteria -
of ECDC section 20.05.010, we find the requested grading permit
must be denied. In the event that our decision as set forth in
Article III of this Decision is overturned by a Court of
competent jurisdiction, we reserve judgment regarding the
remaining criteria of ECDC subsection 20.05.010(4)(B) and (D)
because of a lack of adequate factual presentation and record on
the substantive issues raised by those criteria.

EFFECTIVE DATE
This decision is authorized by the Council for execution by the
Mayor on July 15, 1986, and shall be final and effective ten days
after that date.

RE: Rejection of Conditional Use Permit Applications for Housing for
the Elderly (CU-49-86 & CU-50-86)
Dear Mr. Morgan:
I am writing to notify You that the conditional use permit applications
that you filed for an 80 unit elderly project at 348 - 406 3rd Ave. S.,
Edmonds are being rejected as they do not conform to the provisions of
the Edmonds Community Development Code (ECDC).
The Edmon'ds City Council, in their findings on your previous elderly
housing application, has interpreted the ECDC to exclude projects such
as that proposed as qualifying for reduced parking and increased
density, as allowed under Chapter 20.25 of the ECDC. A copy of the
Council findings is enclosed for your information.
Until such time as the ECDC is amended to allow projects such as the
one you are proposing, the City cannot process your permit
applications. Your application fees will be refunded to you.
You may appeal my decision on this matter. Any appeal must be filed no
later than 5:00 p.m., on December 4, 1986. If you have questions

SUBJECT: Refund for Ray Gregor
On October 22, 1986, Ray Gregor submitted two conditional use permit
applications (CU-49-86 and CU-50-86) as part of a proposed elderly
housing project. An interpretation of the ECDC has since been made
which indicates that the project is not allowed and therefore the
applications are being returned to the applicant. The original receipt
number was 6034 and the fee paid was $500.00.
