I am writing regarding sight -blocking vegetation at the entrance/exit of the Marine View
Apartments located at 408 Third Avenue South in Edmonds. I have enclosed a copy of
the Edmonds City Code section that addresses sight obstruction, for your. reference. You
are requested to trim the hedge so that the public traveling onto Third Avenue South can
see the approaching pedestrians, bicyclists and vehicles. Maximum height is 3feet for the
hedge at this location to give a clear zone sight triangle of.125 feet to the centerline of
Third Avenue South in both directions.
This task Will need to be completed within five days from receipt of this letter. If not
completed within five days, the Public Works Department crews will be asked to
complete the task and a charge for the work will be forwarded to the owner of the above
referenced property.

dangerous or hazardous condition of any side-
walk as hereinbefore specified, or by the pres-
ence of accumulation of ice or snow thereon,
or by lack of proper guards or railings on or
along the property abutting on any public way,
then the abutting property owner where such
injury or damage occurs shall be liable therefor
including liability to the city for all damage,
injury, costs, and disbursements including
court costs and attorney's fees, which the city
may be required to pay or incur to any person
injured or property damaged as aforesaid; pro-
vided, no claim shall be paid by the property
owner unless by agreement of the parties to
such actions or after a judgment is entered by
a court of competent jurisdiction; provided
further, this chapter shall not be interpreted to
require indemnification from the property
owner for injury or damage to any persons
and/or property which is the result of thesole

9.25.010 Violations.
A. It is unlawful for any person who either
owns.or has the right to possession, or both, of
abutting real property.to permit the erection or
maintenance of any sign, device, structure or
vegetation in the following. circumstances
herein set forth, and in the event of circum-
stances presently existing which, by reason of
this section are now in violation of the
Edmonds City Code, said person shall imme-
diately remove the same:
1. In such. manner that it obscures or
conceals any traffic control sign, signals or
other device as to interfere with the full and
effective use and visibility of the same to the
.motoring or pedestrian public,
2. In such manner thatit obscures the
visibility of the motoring or pedestrian public
as such persons approach a street intersection
for a distance of greater than 50 feet in any
direction from the intersecting existing rights -
of -way lines upon which the property abuts;
3. In such manner that it encroaches
upon any part of a sidewalk, or within five feet
of the improved or traveled portion of a public
roadway, for a vertical distance of 10 feet
above said sidewalk or public roadway;
4. In such manner as to cause the break-
ing or otherwise cracking of any. sidewalk
within the city of Edmonds.
B. In the event any sign, device, structure or
vegetation prohibited by this. section is not
removed by the person. who either owns or has
the right to possession, or both, of the abutting
real property, the director of public works may
cause the same to be removed. In the event the
director of public works notifies the owner or
person in possession of the abutting property

in writing to remove any of said obstructions
five days in advance and said property owner
fails to remove the same within said five-day
period, the director of public works may
charge said person for.the cost of removal of

9.25.100 Penalties.
Any person or persons who violate or fail to
comply with any of.the provisions of this chap-
ter, hereafter referred to as "Street and Side-
walk Obstruction", or any part thereof, shall
upon conviction be punished by a fine or by
imprisonment in jail, or by both fine and
imprisonment as set forth in ECC 5.50.020.

During review and inspection of the subject site, it was found that the site appears to contain
and/or is adjacent to a Wetland pursuant to Chapter 20.1513 of the Edmonds Community
Development Code (ECDC). The wetland immediately adjacent to this property requires a
buffer from the edge of the wetland and a building setback from the edge of the buffer. It is
possible that the buffer or building setback will encroach onto the subject property.
Based on the above findings, a Critical Areas Study is required to delineate the approximate
boundaries of the potential wetland and identify its buffers. All critical areas studies shall be
performed as three party agreements with the city selecting the consultant and the property owner
or applicant paying the fees.
If the property owner wishes to apply for a specific development permit which they feel
would not impact the Critical Areas located on or adjacent to the site, they may submit
their proposal to the Planning Department for review. If the Planning Department finds
that the proposed development permit will not adversely impact a Critical Areas or its
buffers, a conditional waiver may be issued on a project by project basis.
