Our goal is to provide a multi -tenant commercial building in lieu of the older existing single -tenant building while providing both site improvements and easier access to and from Lake Ballinger Way. A significant portion of the north end of the property contains a steep slope (landslide hazard) as well as a sewer easement. Our intent for this meeting is to determine the best economic use of the property within the parameters defined by the municipal and building codes. In preparation for the above referenced meeting we have the following specific questions/comments for discussion: Development in Hazard Area: What is the feasibility and criteria for development within the defined hazard area? ECDC 23.80.070 Development Standards indicates that construction within these hazard areas is possible if the building meets the criteria outlined in section A.4. We would like to clarify how these apply to the proposed building and site. Geotechnical: A geotechnical study was conducted for this property in 2006. This report included borings at the top and bottom of the hazard area and indicates that the "north facing slope of the property ... appears to be stable". The report also details parameters and recommendations for construction. Would these qualify as the "design standards" required to meet the section referenced above? 3. Easement: The subject property contains a sewer easement with the City of Edmonds. Does this easement restrict development of the property on or within a set distance of this easement? Or is development simply restricted not to materially affect the use of this easement by the city? 4. Setbacks: The subject property is zoned BC and is adjacent to BC and BN zoned properties. According to ECDC 16.50.020 Site Development Standards, Table A, the side and rear yard setback are defined as "none". We would like to confirm this interpretation. Additionally are there additional setback requirements within the hazard area insofar as the potential impact to adjacent poperties/buildings? 5. SEPA Review: What are the specific thresholds for SEPA review for development of a commercial building on this site? WAC 197-11-800.1.a.iv seems to provide for an exemption except for "construction of an office, school, commercial, recreational, service or storage building with 4,000 square feet of gross floor area". Would a commercial building under 4,000 square feet, therefore, be exempt from SEPA review? Are there any other triggers that would require SEPA review? Thank you for your review and consideration.
