X r Subject: Revised TESC, Street and Utility Plans for Emerald Place Condominiums Dear Gordy: CIF The revised plans submitted with this letter have been modified based on your letter of August 4, 1999, the redline markups of our previous drawings and redline comments on my letter to Don :Fiene dated July 20, 1999. In addition to the revised drawings, reference is made to my letter of July 20, 1999 since many of the comments are addressed in that letter. In my letter of July 20, I indicated that the "Runoff Calculations" drawing is part of the calculations submittal and not part of the construction plans. Please reorganize your files so that the drawing is attached to the calculations document. As indicated in the July 20 letter, the downstream system that will receive our discharge consists of a creek that was piped several years ago. The piped portion discharges into a remaining portion of the creek. Since our system will discharge to a creek system, as stated in the letter of July 20, the detention system Was designed for the 2-year, 10-year and 100-year storm. is : h ri (2 ,,( As stated in the July 20 letter, the amount of outside pavement is less than 5,0KOsqua�re'f!t; thus now ter quality facilities are needed for this pavement. The majority of parking, as shown on the plans, is q h' P J h' P g, underground. An oil/water separator has been added to the underground garage system. This system will d. discharge to a sump pump that will lift garage water up to a discharge structure located outside the9 5- builluqg. The discharge structure will be connected to the building side sewer by a 4" PVC gravity pipe. 1 The locations of the construction entrance and the silt fence have been graphically added to the TESC r, rinh drawing where they had previously been called out. An additional side sewer has been added north of the building. This side sewer and the one previously shown have had a cleanout added near the property line. OF EDMONDS The revised plans were developed in accordance with the Department of Ecology Stormwater Management Manua! for the Puget Sound Basin and the City of Edmonds Stormwater Management Ordinance. The calculations for sizing the detention system are enclosed with this letter. A drawing entitled Runoff Calculations is part of the calculations documentation and is not part of the construction drawings. The existing site consists of two abandoned single family houses and associated residential vegetation. The site does not have any existing sidewalks. The proposed project will consist of a condominium building, underground parking and associated landscaping. The nearest catch basins to the site are at elevations that will not allow discharge of detained site runoff without pumping. We have modified -the previous drainage plan so that a gravity discharge system can be used. We have discussed this option with you. The proposal will entail constructing a discharge pipe across adjacent private property to the south to a piped enclosure of a natural stream. The stream was enclosed in pipe sometime ago and is actually located under the building that occupies the property to the south. The pipe that crosses the property discharges to a natural stream course west of the adjacent property. Our proposed point of connection to the pipe on the property to the south would be to an existing storm drain manhole. This manhole :is downstream of the building on the property, so our project would not be contributing more flow under the building. The pipe is located approximately 20 feet under the building. The proposed project site presently drains to this same drainage course but empties at a location further downstream. Since the site already drains to this drainage course, our proposal does not result in a bypass situation to another drainage basin. The total increase in new exposed pavement area, including pavement in the right-of-way is less than 5,000 " square feet. Therefore, no biofiltration facilities are required. The detention system is designed for the'£ year, 10-year and 100-year storms. The existing site was modeled as if the site consists of meadows. The V10 proposed detention system will attenuate developed flows to match those from the site as if it were an existing meadow. Since the total pavement area is less than 5,000 square feet, no biofiltration facilities are required. The detention system is designed for the 10-year and 100•-year storms. The existing site was modeled as if the site consists of meadows. A pump will be required to transfer runoff from the drives to the detention system. An emergency overflow to a catch basin system in the garage will be used in the case of mechanical failure of the driveway runoff pump. The garage catch. basin system is also designed to be pumped to the anitary sewer system since water in a garage is considered to be contaminated and thus requires s�treatment. Grind and remove, to a depth of 2-1/2", the existing concrete at the north entrance so additional concrete can be keyed in. 4. Paint one 8.5' x 18' parking stall on the west side of the road, centered between Walnut Street and the apartment driveway entrance. 5. We have been advised that Mr. Robin Michel, the owner of an apartment complex adjacent to Emerald Place has complained to the City about the construction of improvements on .41h 'Avenue South. Mr. Michel apparently contends that he has a "written agreement" with Emerald Place Investors requiring Emerald Place to construct the improvements in a manner different than that which has been approved by the; City. This is not the case. At the time the Emerald Place project was originally approved by the City, the plan provided that the grade of 41h Avenue South would remain unchanged. In the late summer of 1999, Emerald Place submitted a revised plan to completely re -grade the street. Since the major re -grade would lower the surface of the street nearly 4 feet and would thus require major modifications to Mr. Michel's property, the City required our client to obtain the approval and cooperation of Mr. Michel. Consequently, Emerald Place entered into a letter agreement with Mr. Michel, a copy of which is enclosed for your review. As you can see, the agreement assumes as a starting point that the re -grade would be performed and provides that Emerald Place would mitigate damage to Mr. Michel's apartment complex by installing substantial improvements on his property. Due to the cost of the re -grade and the likelihood of damage to utilities located with the right of way, our client subsequently decided to abandon its plan to re -grade 4" Avenue South. Instead, it submitted (and the City then approved) a plan to modify the street slightly so that it slopes approximately 4 % toward Emerald Place. The contemplated damage to Mr. Michel's property will therefore noi-occur. Infact; no' modifications bf any kind will.' be made to the'sidewalks and curb City of Edmonds January 29, 2001 Page - 2 cuts which are adjacent to the apartment complex. Under such circumstances, Emerald Place has no duty to carry out the mitigative measures contemplated under the letter agreement. The Emerald Place Condominium Project is nearly completed and the owners expect to be closing condominium sales in the near future. Obviously, any delay in completing the 41h Avenue South improvements will cause substantial economic damage to :Emerald Place. We understand Mr. Michel's disappointment over the fact that he will be unable to substantially improve his property at the expense of Emerald Place. However, he has no legal basis whatsoever for modifying the plans approved by the City. In light of this fact, we trust the City will immediately allow construction to resume. This decision will have a major impact on all development in the future for the City of Edmonds. The previous City Engineer, Mr. Jim Walker, in his attached letter to Mr. Sheperd insured that the City of Edmonds Community Development Codes would be enforced and the developer would be put on notice of his responsibilities, as he intended to alter the existing design of the roadway to benefit his development. (Exhibit A) More specifically in paragraph #3, Mr. Walker clearly states, "If a developer of this property chooses to revise the design of the existing roadway, she/he must design the road to MEET ALL STANDARDS for public roadways." Enclosed also find Exhibit B and C. Exhibit B is page 18 — 35 of the Edmonds Community Development Code which clearly states in the first paragraph at the top left of the page; "All streets and access easements must be paved to a minimum of 16 feet unless other wise provided herein and developed in accordance with the city of Edmonds street standards..." Exhibit C is those standards adopted by the City of Edmonds in 1989. Coupled with the specific construction criteria, is an even higher level of concern. Safety. Mr. Walker in his letter addresses this issue in the very first paragraph in the following sentence; "... complies with the requirements of the Edmonds Community Development Code (ECDC) and accepted standards for safety." I also place a high priority on safety. As a landlord I am required by the state to provide a safe place for tenants to live. I was also required to follow the ECDC upon the development of my adjacent property. Construction of a road with a 2% side slope clearly provides for that Safety which the city code embodies. Edmonds Community Development Code 1.8.00.020 (C) emphasizes in the final sentence; " No application may be approved that conflicts with any portion of the community development code, unless that portion is specifically subject to waiver or variance." (Exhibit D) Allowing the developer to not strictly adhere to the ECDC in this instance clearly sets a precedent for all future road development in the City of Edmonds. At the same time the City of Edmonds is now accepting the responsibility for any future injury to persons or property. Dave, I plead to you once more to evaluate the documentation I have provided, and to enforce the Edmonds Community Development Codes as they are written, such that the Safety, Welfare and Well being of all individuals is preserved and that the integrity of the Codes is maintained now and in the future of Edmonds, as it has been in the past. The Safety and Welfare of the Public is enough to render your new decision to require the developer to adhere to the existing ECDC. I, as an adjacent property owner, am asking for nothing more than what was required of myself at the time of my development and would be required of any other development in the City of Edmonds. The Engineering Division reviews the civil site design to ensure that it complies with the requirements of the Edmonds Community Development Code (ECDC) and accepted standards for safety. The section of Fourth Avenue South south of Walnut Street is presently public right-of-way and must meet road standards for access. The Engineering Division staff has reviewed the earlier designs with regard for this public access. If a developer of this property chooses to revise the design of the existing roadway, s/he must design the road to meet all standards for public roadways. Some examples of standards that must be adhered to are slope of roadway, slope of crown and roadway width. If the developer proposes to alter the slope of the roadway, any impact to neighboring property owners must be mitigated. This could involve reconstruction of existing driveways, relocation of existing sidewalks and regrading of property. This work would be performed at the expense of the developer, and any work outside of right-of-way will require permission of neighboring property owners. If the developer chooses, s/he could apply to the City to have the right-of-way vacated. All streets and access easements must be paved to a minimum width of 16 feet unless otherwise provided herein and developed in accordance with the city of Edmonds' street standards, on file in the city engineer's office. This paving requirement does not pertain to alleys as defined in ECDC 21.05.025. The right-of-way and paving requirements will apply to any property upon subdivision or for multi -family or commercial purposes. They shall not be required for the development of a single residential (RS-single-family) lot on an existing street or access easement unless devel- opment impacts are required to be mitigated as a condition of SEPA approval or of issuance of a variance, conditional use permit, or other grant of permit requiring compliance with the provisions of the Edmonds Comprehensive Plan. Original ground line; 2. Stationing intervals of 100 feet; 3. Control elevation on border of sheet; 4. Grade line showing percents and ver- tical curves; `i. A release of the city from all damages arising from any action or inaction of the city based on false, misleading or incomplete infor- mation furnished by the applicant; 9. Permission to city staff to inspect the property involved to determine whether the application should be approved. C. Date of Filing. The public works direc- tor shall review all applications and accept for filing only those which include all the informa- tion required by paragraphs B(1) through B(7) of this section. The date of filing shall be the date the application is accepted for filing. When an environmental impact statement or a proposed negative declaration is required, the date of filing shall be the day on which the final environment impact statement or final negative declaration is available to the public. 18.00.020 Review. A. Other Departments. The public works director shall promptly send copies of the application to each department which has requested copies of the type of application that has been filed, and to other departments which may have an interest in the individual applica- tion. B. Staff Analysis. The staff may use a sum- mary form or checklist to review application, with written conclusions as to whether the pro- posal meets the standards and criteria of the community development code. C. Decision. The public works director shall decide whether to approve, conditionally approve, or deny the application, based on the staff analysis and comments from other city departments. The decision shall be in writing and shall be appealable to the hearing exam- iner under ECDC 20.100.010 for final deci- sion, appealable to the city council. As I understand your letter, you have two basic concerns: 1) We have allowed a 4% cross slope (rather than the 2% indicated in City Standard Details); and 2) You believe this 4% slope will create a traffic safety problem. In your letter, you mentioned that we should hold developers to the standards set forth in the Edmonds Community Development Code and City Street Standards. Let me assure you that our intent is clearly to enforce the City's Code requirements. However, situations occasionally arise where minor deviations to design standards need to be addressed, and, after careful review, may be approved at the discretion of the City Engineer. In this specific case, the 2% cross slope requirement is included in the City's Standard Details. It is not a specific requirement of the City code. Therefore, the City Engineer has the authority to approve this minor deviation based upon the specific circumstances and sound engineering judgement. As you know, there have been a number of revisions to the proposed improvements to Fourth Avenue South. The original plan involved lowering the street, curb and gutter, and sidewalk on the west side of Fourth Avenue South. This original plan, which I understand was acceptable to you, also included cross slopes of 4% on a portion of the street east of the right-of-way centerline. However, Cargill Construction had concerns with utility impacts if the street was lowered, which led to a series of revisions. Based on the circumstances, the prior City Engineers used their authority to allow minor deviations from the standards in the original plan as well as - several revisions. After reviewing the developer's latest revision and applying sound engineering practices, I have determined that the cross slope of 3.75% to 4% does not create 'a problem for motorists to navigate, nor does it increase safety risks. The City's Traffic Engineer has looked at the site and, based on her observations, this cross slope does not present a traffic safety problem. In addition, according to the 1992 Edition of the ITE Manual on Roadway Geometric Design, cross slopes (super elevations) of 4 or 6 percent are common in urban areas. The specific focus of our evaluation was the vertical sight distance relative to the cross slope of the newly installed improvements to Fourth Avenue South. We conducted a "drive test" using various combinations of large vehicles (Ford Expedition and full size pickup truck) and small vehicles. We also used various size drivers, including a smaller driver in a large vehicle. Our conclusion is that vertical sight distance/visibility is acceptable. With regard to the cross slope on Fourth Avenue, we have checked the grades of the pavement recently installed and found them to comply with the latest approved plans. However, to help us evaluate the vertical sight distance at your driveway, we also checked the grades of your driveway and found that the slope of your driveway exceeds 25% at some points, rather than the 14% depicted in the diagram you provided last week. Your letter of February 13 questioned the revisions to the parking spaces on the west side of Fourth Avenue. Previously there were two parking spaces in this location. Your concern about the vertical sight distance at your driveway prompted us to review also the horizontal sight distance at your driveway and the intersection of Fourth Avenue and Walnut Street. The Edmonds City Code authorizes the Traffic Engineer to prohibit parking within 30 feet on either side .of private driveways entering onto any street. In applying the standard sight distance triangles from the Institute of Traffic Engineers (ITE) Traffic Engineering Handbook, we concluded that any parking spaces in this location obstructed the horizontal sight distance at your driveway and at Walnut Street. Dear Mr. Carrol, The investigation of the cracked concrete was done at a condominium project located in Edmonds, Washington at the southeast corner of Walnut and 4'h on May 14, 2001 at approximately 10:00 a.m. and in the presence of project foreman, Mr. Eric Hanson. The singular crack is in an approximate 10-foot length of curb -gutter section that adjoins the new asphalt pavement of the entrance to the condominium and abuts the concrete entrance way of the neighboring property. The crack runs transversely (at a right angle) through the curb and than proceeds diagonally (at about a 45 degree angle) through the gutter section. It is my opinion that the crack in no way denotes a structural failure, that it occurred within a short time of the curb -gutter section being constructed, that it has remained virtually unaltered from the time of formation and, that under the current service conditions, the curb -gutter will continue to function in the intended manner for as long as it exists. The back side of the curb section is visible and the full depth of the section can be seen by removing the abutting gravel/dirt fill. At the point of the crack in the curb, a vertical line in the concrete, representing the start of a vertical face running transversely into the curb, is visible in the backside of the curb. It is located about half way between the ends of the curb -gutter section; the abutting concrete driveway on one end and the asphaltic fiber board embedded in the curb with a grooved transverse joint continuing into the gutter on the other end. This vertical face line is also visible in each of the continuing curb -gutter sections at approximately mid length of each section. This vertical face is a weakened plane or cold joint and is a result of the way the curb -gutter section was constructed. Typical construction with forms appears to be what was used to monolithically cast the curb and gutter. The vertical lines -faces in the curb were formed by transverse steel spacer plates that are placed between back and front curb forms in order to keep the forms stable and in alignment during placement and hardening of the concrete. The forms are left in place until the concrete has hardened sufficiently such that the forms can be removed without the concrete slumping. When the plates are removed, the straight lines are left. A weakened plane, sometimes called a cold joint, now exists in the curb concrete. Such a weakened plane is often the cause and/or origin of unplanned cracks. Unplanned or random cracks in concrete are not necessarily evidence of a failure of the concrete. Since concrete will always crack, the unplanned cracks are a result, more often than not, of inadequate control joint design and layout by the designer or builder. The unplanned crack in this curb -gutter section has emanated from the "cold joint" ®N created by the aforementioned forming procedure. The crack is an old crack that probably occurred within (�D a relatively short time (weeks to months) of the concrete being placed. A straight edge placed along the curb line and centered on the crack shows there is no space below the straight edge, in other words there is no deflection of the structure. The crack is currently tight which indicates virtually no movement of the concrete since the crack occurred. Because of the confinement by the abutting concrete sections and asphalt pavement, the crack should continue to remain tight. By the crack being tight, there is what is called "aggregate interlock" across the crack which allows a load, such as from a vehicle, to be transferred from one side of the crack to the other without a loss of load carrying capability. Thus, this particular crack does not cause a loss of the structure's ability to carry load. The analysis will address trip generation, distribution, and mitigation in accordance with the City of Edmonds SEPA review guidelines for traffic analyses. „,a Wa"l""a Project Description The proposed development is planned to include a total of 14 condominium units to be completed in 1998/99. The project, site is located within the southeast quadrant of the 4th Avenue South and Walnut Street intersection. Figure 1 depicts the project site vicinity. Access to the existing street system will be provided by a new site driveway along the east side of 4th Avenue South. Figure 2 shows the proposed site plan for parking and access to the development. The trip distribution of ;project generated traffic for the proposed development is 'based on existing travel patterns in the project vicinity and the primary access routes to the regional arterial system from the project site. Figure 3 shows the trip distribution percentages, aphdaily�and p.m. peak hour assignment used to determine the traffic impacts. Level of Service Impacts A level of service (LOS) analysis was conducted for the study intersections identified by the City of Edmonds. In 'accordance with the City`s transportation :impact analysis guidelines., all identified study intersections require a LOS analysis for the p.m. peak hour under existing and / future conditions. All p.m. peak hour LOS calculations follow the methodology outlined in the 1994 Highway Capacity Manual, Special Report 209, Transportation Research Board and HCM support software developed by McTrans, University of Florida Transportation Research Center and the Federal Highway Administration. Congestion is generally measured in terms of Level of Service (LOS). In accordance with the updated 1994 Highway Capacity Manual, facilities ,are rated with a value between 'LOS A and F, with LOS A being free flow and LOS F being forced flow or over capacity conditions. The LOS at all intersections is calculated in terms of second of delay per vehicle. The LOS at stop controlled intersections is measured and reported for each stop controlled movement and each left turn movement on the uncontrolled approaches. Geometric characteristics and conflicting traffic movements are taken into consideration when determining LOS values.. Level of service analyses were conducted for three unsignalized intersections during the p.m. peak hour under 1998 existing conditions with a & wtthou h proposed. development. The results of the LOS analyses for the three intersections are summarized in Table 2.
