Gordon Hyde, Engineering Coordinator qa SUBJECT: McLaughlin sidewalk waiver request Joyce & Merle McLaughlin have requested a waiver from the requirement for a sidewalk at their building site on lot two of short plat S-10-90, located at t 69101174th St. S.W. In order for a sidewalk waiver to be granted, one of the following must be shown: (1) a traffic or pedestrian hazard; (2) a physical limitation due to slope, surfacing water or other physical limitations; (3) a situation in which future street improvements would make this improvement unusable; (4) evidence that another solution is preferable for the time being and will not interfere with future installation of a sidewalk at this location. In this case the requested sidewalk waiver meets the aforementioned criteria (2) for approval, as follows: 1. Traffic or pedestrian hazard. The proposed sidewalk would not interfere with, nor impede vehicular or pedestrian traffic. 2. Physical limitation. The terrain slopes down from the road steeply. Due to this limitation, it is not practically possible to place a sidewalk on the north side of the street. 3. Consistency with future street improvements. Future street improvements would not make a sidewalk at this location unusable. 4. Evidence that another solution is preferable at this time. At this time it is preferable to require the applicant to sign a waiver of protest of an L.I.D. in order to insure that this property joins an L.I.D. when that option becomes available. The signed waiver of protest must be recorded with the Snohomish County Auditor, and a recorded copy must be retue'rred to the City Planning Division. Conclusion: The terrain of the property on the north side of 174th St. makes the placement of a sidewalk in that location practically impossible. The terrain of the south side of the street also prohibits a sidewalk. Therefore, the sidewalk on the north side of the street is waived, and it is not required that the sidewalk requirement be moved to the south side of the street. In order to insure that this property joins in an L.I.D. to install sidewalks when this method becomes available, the owner must sign an L.I.D.waiver of protest. The si'g-ned waiver of protest must be recorded with the Snohomish County Auditor, and a copy of the recorded document must be returned to the City Planning Department.
