The hearing on the application was opened at 10:43 am., June 19, 1997, in the Plaza Room, Edmonds Library, Edmonds, Washington, and closed at 10:45 a.m. Participants at the public hearing and the exhibits offered and entered are listed in this report. A verbatim recording of the hearing is available in the Planning Division. HEARING COMMENTS: The following is a summary of the comments offered at the public hearing. From the City: Jeff Wilson, Current Planning Supervisor, reviewed the staff report and recommended approval with conditions. From the Applicant: Rick Brater, Agent for the Applicant, said he concurred with the conditions of approval recommended by staff. From the Community: No one from the general public spoke at the public hearing. CORRESPONDENCE: A "Letter of Permission" was received from the Army Corps of Engineers (Exhibit B which provides authorization from the Corps to do the proposed work. II. FINDINGS OF FACT AND CONCLUSIONS A. SITE DESCRIPTION l . Site Development and Zoning: a. Facts: (1) Size and Shane: The subject property, which is Washington State Ferries right-of-way, is approximately 37,800 square feet (.87 acres) in area and comprised of upland and waterward property; and is generally rectangular in shape with frontage on- Main Street (see Exhibit A, Attachment 4). t U C Brackett's Landing North public park. The site is zoned Public Use - "P" (see Exhibit A, Attachment 1). (2) South: The property is owned by the City and is currently undeveloped, however, the site will be developed with a public park (Brackett's Landing South). The site is currently zoned "CW" (see Exhibit A, Attachment 1). (3) East: The properties are currently developed with the Burlington Northern Railroad Tracks immediately to the east of Railroad Avenue which lies adjacent to and east of the subject property. To the east of the Burlington Northern Railroad tracks, the area is developed with a mixture of commercial uses and restaurants. The area is zoned Community Business - "BC" (see Exhibit A, Attachment 1). (4) West: Puget Sound (see Exhibit A, Attachment 1). B. STATE ENVIRONMENTAL POLICY ACT (SEPA) 1. a. Facts: (1) Pursuant to Washington Administrative Code sections 197-11-922 and 197-11-924 the Washington State Department of Transportation (WSDOT) has the ability to act as the lead agency for the purposes of issuing an environmental determination on the proposal. (2) A Determination of Nonsignificance (DNS) was issued by WSDOT on Ma 14, 1997. The Environmental Checklist, Determination and additional environmental information are included as Exhibit A, Attachments 6 and 7. b. Conclusion: The applicant and the City have satisfied the requirements of SEPA. C. EDMONDS COMMUNITY DEVELOPMENT CODE (ECDC) COMPLIANCE 1. a. Facts: (1) The subject property is subject to review under ECDC Chapter 20.15.B (Interim Critical Areas) as part of the application process. Lo C7 0 2. a. b. 3. a. 4. a. t } _ 1 (2) The applicant had submitted a Critical Areas Checklists, and the City has issued a "Waiver" of the requirement to prepare a Critical Areas Study, under CA File No. 94-227. Fact: By state statute, the ferry dock is part of the Washington State Highway System. Additionally, the ferry dock is designated as an unzoned right-of-way on the City's Official Zoning Map, therefore the proposed development is not regulated under the City's zoning provisions (see Exhibit A, Attachment 8). Conclusion: Even though the subject property may be exempted from specific performance standards under the City's zoning ordinance due to the fact that the proposal lies within a right-of-way, the project must still comply with the general development standards and policies set forth in the State Shoreline Management Act (see Section ME below). Fact: ECDC Section 20.55.030 sets forth the procedural standards for review of all Shoreline Substantial Development Permit applications. Specifically, it provides that in addition to the procedures and criteria set forth in ECDC 20.100.010, review of all Shoreline Permit applications shall also use the criteria and standards established in the City's Shoreline Master Program (ECDC Chapter 15.35). Fact: ECDC Section 20.100.010 stipulates the procedures to be used by the Hearing Examiner in the review of all Shoreline Permit applications. Fact: Pursuant to ECDC Section 20.55.060, "No construction authorization by an approved shoreline permit may begin until 30 days after the final City decision on the proposal. This restriction shall be stated on the permit " D. SHORELINE MASTER PROGRAM (SMP) 1. a. Facts: (1) The subject property is designated as an "Urban" shoreline environment on the City's adopted Shoreline Environment Map. (2) Pursuant to ECDC Section 15.36.010.B, the marine waters of the site from the MHHW line to the outer harbor line are designated as "Urban - Marine". (3) The proposed project will occur waterward of the MHHW line, in the "Urban - Marine" shoreline environment. A description of the proposed project is provided in Section I.A.3 above (see Exhibit A, Attachments 2 through 5). b. Conclusion: The proposed developmentluse of the site appears to be consistent with the "Urban - Marine" Shoreline Environment designation. 2. a. Fact: ECDC Chapter 15.37 sets forth the "Goals and Policies" by which all Shoreline Substantial Development Permits are to be reviewed. 0 E. 3. a. Facts: ECDC Section 15.37.000 outlines the "Economic" goal and policies set forth in the Edmonds Shoreline Master Program (SMP). (1) Section 15.37.000.A. defines the parameters of the "Economic" element of the SMP. The specific definitions which are applied to this element are: z 1-; w wy U N_jj= (2) � =1 LU x Ul iu cnr o ~r (3) Go (4) (a) "This element is concerned with the location and design of industries, transportation facilities (emphasis added), port facilities, tourist facilities, commercial and other developments that are particularly dependent upon or oriented to shoreline locations." (b) "Shoreline dependent .uses shall mean those developments requiring shoreline location by the nature of their activity." (c) "Shoreline oriented uses are those that realize comparative benefits from shoreline locations, are consistent with existing and planned use patterns, and in the public interest." Section 15.37.000.13. states that it is the goal of the "Economic" element of the SMP to, "Provide the development of "shoreline dependent" and "shoreline oriented" commercial and industrial activities with the minimum disruption of Edmonds shoreline." ECDC Section 15.37.060.C.I Lb identifies "Ferry and passenger terminals" as a "shoreline dependent use". Section 15.37.000.C. provides the general policies to implement the goal of the "Economic" element of the SMP. The relevant policies that apply to the proposed development are provided below. (a) Section 15.37.000.C. states the following as a general policy of the SMP: "In commercial development, priority should be given to shoreline dependent uses." (b) Section 15.37.000.C.3.states the following as a general policy of the SMP: "Prevent the potential adverse effects of commercial and industrial development on the environment through compliance with environmental quality regulations." (c) Section 15.37.000.C.4 states the following as a general policy of the SMP: "Prevent the potential adverse effects of commercial and industrial development on other activities through local performance standards." Section 15.37.000.D.1. provides specific policies related to the implementation of the "Economic' element in the "Urban" shoreline environment. Specifically, it states the following: "Industrial and commercial developments shall be encouraged in these areas at the locations designated, planned for, and . zoned in accordance with the intensity of uses expected in these areas." 0 r, C { Hearing Examiner Decision Case No. SM 97-66 Page 6 (5) The ferry terminal facility and all related improvements to ensure the safe operation of the system is very clearly a "shoreline dependent use". The ferry loading and unloading facilities, both vehicular and pedestrian, could not occur in any other location other than the shoreline. i b. Conclusion: The proposed in -water safety improvements to the ferry terminal, through the installation of addition dolphin piles to control positioning of the ferry while docked, is consistent with the above stated Shoreline Master Program goals and policies which support the continued use and function of the terminal. 4. a. Facts: ECDC Section 15.37.020 outlines the "Circulation" goal and policies set forth in the SMP. (1) Section 15.37.020.A. defines this element in the following manner: "This element is concerned with assessing the location and extent of existing and proposed major thoroughfares, transportation routes, terminals and other public facilities, and correlating those facilities with the shoreline use elements. This element deals with the structures and activities involved in the movement of people, goods, and services, and with their relation to the shoreline." (2) Section 15.37.020.B. states that it is the goal of the "Circulation" element of the SMP to, "Develop safe, convenient and diversified circulation systems to assure efficient movement of goods and people with minimum disruption to the shoreline environment ad minimum conflict between various modes of circulation." (3) Section 15.37.020.C. provides the general policies to implement the goal of the "Circulation" element of the SMP. The relevant policies that apply to the proposed development are provided below. (a) Section 15.37.020.C.1 states the following as a general policy of the SMP: "Locate, design and develop systems to provide for multiple modes of circulation (i.e., bike and pedestrian as well as automobile, local traffic as well as through and commuter traffic." (b) Section 15.37.020.C.2 states the following as a general policy of the SMP: "Locate, design and develop systems with respect to existing rails, highway and ferry facilities." (4) Section 15.37.020.D.1. provides specific policies related to implementing the "Circulation" element in the "Urban" shoreline environment. Facts: (1) RCW 90.58.320 stipulates the restriction on limitation on height of the structures covered by the SMA. Specifically, the SMA provides for a maximum limit of thirty-five feet above average grade level. (2) Section 173-14-030(3) of the Washington Administrative Code (WAC) provides the definition of the term "Average Grade Level". In the case of a structure which is located over -water, "average grade level" is measured from the "ordinary high water." (3) The elevation of "Ordinary High Water" has been established as 14.75 feet above MLLW. The maximum permitted height for an overwater structure as established in RCW 90.58.320 is 35-feet above "ordinary high water", which translates to a specific elevation at the subject site of 49.75 feet above MLLW. b. ConcIusion: The proposed development complies with the maximum permitted height of a structure under RCW 90.58.320. 3. a. (1) Size and Shape The subject property, which is Washington State Ferries right-of-way, is approximately 37,800 square feet (.87 acres) in area and cornprised of upland and waterward property; and is generally rectangular in shape with frontage on Main Street (see Attachment 4). (2) !&ad : The subject property is currently used as a ferry terminal loading dock with accessory structures to support employ= and pedestrian customers (see Attachment 4). (3) Zoning: The subject site is unzoned ferry right-of-way and therefore is not regulated by the City Zoning Ordinance and performance standards (see Attachment 1). 2. Neighboring Development and Zoning: a. E99W. (1) North: The property is owned by the City and is developed with the Brackett's Landing North public park. The site is zoned Public Use - "1111 (see Attachment 1). (2) South: The property is owned by the City and is currently undeveloped, however, the site will be developed with a public park (Bracketts Landing South). The site is currently zoned "CW"(sce Attachment 1). (3) East: The properties are currently developed with the Burlington Northern Railroad Tracks immediately to the east of Railroad Avenue which, lies adjacent to and cast of the subject property. To the cast of the Burlington Northern Railroad tracks, the area is developed with a mixture of commercial uses and restaurants. The area is zoned Community Business - "BC" (see, Attachment 1). (4) West: Puget Sound (see Attachment 1). B. STATE ENVIRONMENTAL POLICY ACT (SEPA) 1. a. Facts: (1) Pursuant to Washington Adt-iinistrative Code sections 197-11922 and 197- 11-924 the Washington State Department of Transportation (WSDO`I) has the ability to act as the lead agency for the purposes of issuing an environmental determination on the proposal. The specific definitions which are applied to this element are: (a) "this element is concerned with the location and design of industries, transportation facilities (emphasis added), port facilities, tourist facilities, commercial and other developments that are particularly dependent upon or oriented to shoreline locations." (b) "Shoreline dependent uses shall mean those developments requiring shoreline location by the nature of their activity." (c) "Shoreline oriented uses are those that realize comparative benefits from shoreline locations, are consistent with existing and planned use patterns, and in the public interest." (2) Section 15.37.000.B. states that it is the goal of the "Economic" element of the SMP to, "Provide the development of "shoreline dependent" and "shoreline oriented" commercial and industrial activities with the minimum disruption of Edmonds shoreline." ECDC Section 15.37.060.C.I Lb identifies "Ferry and passenger terminals" as a "shoreline dependent use. (3) Section 15.37.000.C. provides the general policies to implement the goal of the "Economic" element of the SMP. The relevant policies that apply to the proposed development are provided below. (a) Section 15.37.000.C. states the following as a general policy of the SMP: "In commercial development, priority should be given to shoreline dependent uses." (b) Section 15.37.000.C.3 states the following as a general policy of the SMP: "Prevent the potential adverse effects of commercial and industrial development on the environment through compliance with environmental quality regulations." (e) Section 15.37.000.C.4 states the following as a general policy of the SMP: "Prevent the potential adverse effects of commercial and industrial development on other activities through local performance standards." (4) Section 15.37.000.D.1. provides specific policies related to the implementation of the "Economic" element in the "Urban" shoreline environment. Specifically, it states the following: "Industrial and commercial developments shall be encouraged in these areas at the locations designated, planned for, and zoned in accordance with the intensity of uses expected in these areas" (5) The ferry terminal facility and all related improvements to ensure the safe operation of the system is very clearly a "shoreline dependent use". The following are highlighted statements which have set forth in this section. (a) "It is the policy of the state to provide for the management of the shorelines of the state by planning for and fostering all reasonable and appropriate uses. This policy is designed to insure the development of these shorelines in a manner which, while allowing for limited reduction of rights of the public in the navigable waters, will promote and enhance the public interest. This policy contemplates protecting against adverse effects to the public health, the land and its vegetation and wildlife, and the waters of the state and their aquatic life, while protecting generally public rights of navigation and corollary rights incidental thereto." (b) "In the implementation of this policy the public's opportunity to enjoy the physical and aesthetic qualities of natural shorelines of the state shall be preserved to the greatest extent feasible consistent with the overall best interest of the state and the people generally. A Jumbo class vessel will be assigned to the Edmonds/ Kingston run mid -summer, the existing dolphins are in disrepair and cannot hold a jumbo class vessel, it is imperative we have these dolphins replaced prior to the autumn storms. We intend to remove the south outer 100 creosote treated pile dolphin and replace it with two steel pile dolphins with 19 piles in the outer dolphin and approximately 12 piles in the intermediate dolphin. On the north side we will be replacing the floating dolphin with the same type of dolphins that will replace the south outer dolphin. The north inner dolphin which is made up of 51 creosote treated piles and 12 plastic piles will be replaced by a 6 steel pile dolphin. We are hoping that the dolphin replacement could be covered under a maintenance permit, as we are reducing shading by removing the floating dolphin and reducing the amount of piles in the water from 163 piles to approximately 68 steel piles. There is also the possibility due to funding constraints that the dolphins might have to be replaced in two separate contracts. A Jumbo class vessel will be assigned to the Edmonds/ Kingston run mid -summer, the existing dolphins are in disrepair and cannot hold a jumbo class vessel, it is imperative we have these dolphins replaced prior to the autumn storms. We intend to remove the south outer 100 creosote treated pile dolphin and replace it with two steel pile dolphins with 19 piles in the outer dolphin and approximately 12 piles in the intermediate dolphin. On the north side we will be replacing the floating dolphin with the same type of dolphins that will replace the south outer dolphin. The north inner dolphin which is made up of 51 creosote treated piles and 12 plastic piles will be replaced by a 6 steel pile dolphin. We are hoping that the dolphin replacement could be covered under a maintenance permit, as we are reducing shading by removing the floating dolphin and reducing the amount of piles in the water from 163 piles to approximately 68 steel piles. There is also the possibility due to funding constraints that the dolphins might have to be replaced in two separate contracts. Should you have any questions please contact me at 515-3720.
