Mr. Wallis said that this item and the following are very similar
so he addressed his comments to both in order to avoid repetition.
He read a portion of the fence regulations and asked for clarification.
He said it appeared to be in conflict with the intent of the RS Zone.
Mr. Wallis then went through the criteria for granting a variance.
He said the proposed use is a technical violation of the code, so
the question before the Board is, "Does the proposed use conform to
the intent of the code?" It was his opinion that it will not be
detrimental so long as the view, setbacks, etc. are protected. He
said that as long as the fence did not inhibit the views it would be
an asset and probably contribute to the property values in a given
neighborhood. He then showed slides of the proposed location for
the tennis court and he did recommend approval. Mr. Wallis commented
that the decision might be something of a precedent and it might be
appropriate to recoimnend some legislation regarding tennis courts.
There was some discussion with respect to handling these applications
as a conditional use. The comment was made that these go with the
owner and not the land. Mr. Wallis said he would rather it be
considered on a conditional use basis where certain criteria is looked
at, and if it is not an offensive type thing, it could ride with the
property. Following some comments, Mr. Wallis said that in taking a
look at this specific case, he would recommend that it be considered
s a variance, but to consider additional legislation for future
applications. Mr. Whitcutt remarked that fie did not think we would
have too many such applications as it takes too much land for a tennis
court. The Board and Mr. Wallis said they would like to determine
the impact of this particular tennis court on the view, trees and
neighbors. Mr. Hans Gehrig responded saying that he would not have
attempted to put the tennis court in if the neighbors objected, and
there is no objection, lie said that on the long side of the court
there is an existing 121 laurel hedge on the adjoining property and
therefore the fence will not be seen. On the short side, which is
60', it would merely stick up four feet higher than the 6' wooden
fence. He said there would be some of the smaller trees removed.
He said it would be a cyclone fence without slats so that it will
be open. The public portion of the hearing was then opened. No
one wished to comment, and the hearing was closed.
MR. ROY MOVED, SECONDED BY MR. KHOKE THAT V-10-75 BE APPROVED WITH THE
CONDITION THAT NO SLATS BE ADDED. MOTION CARRIED.

Mr. Wallis projected a map on the screen showing the location of this
proposed tennis court, which is in a vacated portion of 84th Ave. W.
He said that all the neighbors would see is about three feet of the
fence. lie then showed various views of the site. It was pointed out
that the neighbors have no objection and the fence will not obscure
anyone's view under any circumstances. Approval was reconmiended.
The public portion of the hearing was then opened. No one commented
and the hearing was closed.
MR. ALLEN MOVED, SECONDED BY MR. DRArE THAT V-12-75 BE APPROVED SINCE
IT IS NOT DETRIMENTAL TO THE NEIGHBORHOOD AND THERE IS NO OBJECTION,
AND THAT IT MEETS THE BASIC INTENT OF THE CODE AS PERTAINING TO THE
RESIDENTIAL LIVING AND THE OPPORTUNITY TO ENJOY THE SPACE PROVIDED
AND THE ACTIVITY PROVIDED BY THE GAME OF TENNIS; SUBJECT TO THE
FENCE BEING AN OPEN WIRE FENCE WITH NO SLATS INSERTED TO FURTHER
OBSTRUCT THE LIGHT OR VIEW. MOTION CARRIED.
Mr. Allen said that the Board would like to go on record and request
the Planning Department to present future requests for tennis court
