The plan submitted did not, in our opinion, reflect It fp a basic understanding of engineering hydraulics or the speci- fic hydraulic situation at the site. One of our requirements (see copy of memo attached) was to have the outlet system de- signed by a registered Professional Engineer. Therefore, that counterclaim is going to have to be dismissed without prejudice. Now, I say without prejudice because it's inconceivable to me that the City, by their action, can force the DefNPIPM endant into a position where he in no way could presery his right -to damages. I have not concluded he's entitled to any damages in the first place. 'In fact, _I have a serious question whether he is. However, by an injunctive action such as this where the Court has given special consideration to an early trial date, a Defendant could find it impossible to pursue a counter claim. If he,. --..as in this.case, failed to file his claill before filing his counterclaim, he is subjected to a motion to dismiss with prejudice. If he fails to file a counterclaim and it's a mandatory counterclaim, he is subject to a motion to dismiss. By previous memo, the attorneys' office had advised you that we had obtained a preliminary injunction against any further movement of earth or other materials at Dr. Park's residence on Olympic View just west of Perrinville. On July 22, 1981, trial was held before the Honorable Daniel Kershner of the Snohomish County Superior Court. After a u. two day trial, Judge Kershner granted the City's request for ti a permanent injunction. The Judge ruled that Dr. Park would z have to submit detailed engineered drawings showing how he proposed to remove the dirt with consideration for the env* ronment, etc. The City will have an opportunity to review these plans before any further work is done. The Judge did rule, however, that Dr. Park would not have to obtain a new conditional use permit, since the Board of Adjustment should not have relied merely upon the 2,000 cubic yard figure men- tioned in the application. The Court ruled that Dr. Park would be allowed to finish the project as shown on the draw- ings that ne submitted to the Board of Adjustment. Dr. Park had also counter claimed for approximately $30,000 allegedly due to the City using dirt from his project without paying for it. The City has adamantly maintained that the only dirt we took was "waste" dirt given to us by Dr. Park's contractor. The Judge dismissed the counter claim without prejudice because Dr. Park had not fully complied with the claim statute. Since the Judge ruled that the pre- liminary injunction was issued property, Dr. Park was not en- titled to any damages and therefore that portion of his claim was dismissed. Final orders have been entered in this case. This memo provides instructions and guidelines for the subject project only for aspects of the permit application reviewed by the Engineering Division. Specific instructions regarding the grading permit, at the time of original application, are contained in: the Uniform Building Code (UBC), 1976, Chapter 70; Ordinance 1714; and Ordinance 1924. UBC Chapter 70 7006 (c) Plans are to prepared, stamped, signed and dated by a Civil Engineer (-see also, 7014 (b) ) - 7006 (d) The scale used is to be an engineering scale at 1 inch equals 20 feet or less and is to show the entire properties comprising the site. 7006 (d) 2 Contours must include those for the site as it now exists. A five-foot contour interval is suggested. The drainage area is the area of land who's surface drainage does or could enter the site. The drainage area is to be shown on map of 'appropriate scale. Park has been referred to our office because of the special circumstances. This particular claim was the subject of litigation in Snohomish County Superior Court, Cause Number 81-2-01135-5. That case had beel filed by the City as an action to enjoin Dr. Park's excavation on his property without first properly obtaining a city permit. In response to the City's suit for an in - Junction, Dr. Park filed a counter -claim for damages which is the same claim referred to by your letter of November 3, 1981. Judge Kershner dismissed this counter -claim without prejudice because Dr. Park failed to file a claim with the City at least 60 days before bringing his counter -claim in this particular action. The Judge held that this was "without prejudice", i.e. that an action might be brought on this claim in the future, even though there is an argument that such an action would be barred since it was a compulsive counter -claim which should have been brought properly in the injunction action. Judge Kershner found that such a result would be unjust due to the accelerated nature of the injunction proceeding. Nevertheless, this may be a defense to this par- ticular claim. These materials include a plan for the removal of some 33,000 cubic yards of sand from the property subject to the above referenced Permanent Injunction. Mr. Meyring has indicated in these materials that stabilization of the backslope would be temporarily at a one-to-one slope pending the continuation of this excavation onto adjoining property pursuant to a yet to be applied for conditional use permit. This additional excavation has been described as in the neighborhood of 100,000 cubic yards. It appears that almost two years have elapsed from the date the above referenced Permanent Injunction was entered after which Mr. Park was permitted to proceed with his conditional use permit provided he submit the necessary engineered grading plans. As you are aware, conditional use permits under the Community Development Code, Section 20.05.020(C) places a time limit on the validity of a conditional use permit of one year. Unless Mr. Park filed an application for an extention before the one year anniversary of his conditional use permit that conditional use permit is deemed null and void and a new permit must be applied for before any work can be done. That anniversary date at least would be tb,e date the Permanent Injunction is entered, that is, July 31**',1981. ENVIRONMENTAL IMPACTS FROM PROPOSAL: SOILS/TOPOGRAPHY - Substantial alteration of the subject property's topography will result from the huge amount of grading proposed. Addi- tiona•1 grading is proposed, but no amounts or plans are called out. Also, some of the proposed grading is on City property. WATER/DRAINAGE - The proposal will alter the existing drainage pattern. A detailed drainage plan and erosion control plan.is needed. AIR QUALITY - The grading is proposed over a one to two year -period. Be- cause of•the residential development nearby, the impact of construction equipment emissions needs to be addressed. CIRCULATION - The amount of heavy truck traffic will cause significant congestion and place a severe impact on the road system, which was not built for such traffic. VEGETATION - The proposal will remove all the existing vegetation and i:s inconsistent with the goals and policies of the Comprehensive Plan. NOISE - The proposal will impact the existing ambient noise level. This impact must be mitigated. This declaration is based upon information prepared by Mr. Max Meyring, Dr. Park's engineer. Pursuant to the requirements of the State Environmental Policy Act, the environmental review considers all potential activity con- templated for the applicant's property. 8. The finding of a potentially significant adverse impact on the environment requires that an Environmental Impact State (EIS) be prepared prior to any activity on the site. The cost of the EIS is the responsibility of the ap- plicant; the preparation of the document is to be done by a consultant of the City's choice. The details of the arrangement will need to be worked out between the City and the applicant. In addition to demonstrating the need for an EIS,.the submitted document clearly describes commercial activity, which is prohibited in a residential zone without a home occupation permit. No commercial activity will be al- lowed unless the necessary permit is obtained. Based upon my interpretation of the text of the Edmonds' Community Development Code, I am writing to advise you of Dr. Park's obligation to act upon the subject permit in accordance with the provisions of Section 20.05.020(c) of the Community Development Code. The above cited provision reads as follows: Time Limit: The approved Conditional Use Permit must be acted on by the owner within one year from the date of approval, or the Conditional Use Permit shall expire and be null and void, unless the owner files an application for an extension of time before the expiration date and the Hearing Examiner approves the application. As you are aware, Judge Kershner entered his last Order on this matter on March 26, 1984, Under the most liberal interpretation of our code possible, Dr. Park has until March 26, 1985, to complete all required submittals$ obtain all necessary approvals; and commence work under the Conditional Use Permit.
