Mr. McKinley:
I have been forwarded your file for review because the building and
planning staff believe that problems still exist on your site. A
review of the file shows that originally a deck had been constructed
without a permit. It was found that the deck was in the building
setback. You took action to correct that, and, later, another
problems still
inspection by the Building Department revealed that

contacted you and visited your site, but no permit has yet been issued
for construction of a deck. The file indicates the following items
still need to be resolved before this matter is closed.
1. A balance of S138.50 is due for the building permit and plan
review.
2. Once the fees are paid, a building permit can be issued.
3. A final inspection must be conducted to insure that the deck
structure is in compliance with the Edmonds Community
Development Code.

Re: DECK
A site inspection on 2/21/90 revealed that the existing deck meets the
required side yard setback; however, the deck is deficient with regard
to the building code in two areas:
1. The guardrail must be a minimum of 36" in height.
2. The intermediate pipe railing cannot be spaced greater than a 6"
sphere can pass through.
Please correct these items and recall the Building Division for a
compliance inspection.

I am writing to inform you that a site inspection was made on your
property, located at 18921 Olympic View Drive. This inspection
revealed a violation of the Edmonds Community Development Code (ECDC),
sections 16.20.030, specifically the placement of an elevated deck
within the required 10 foot side setback area.
The Planning Division notified you of this violation on October 23,
1989. At this time you were informed of the methods to correct this
violation and given a deadline of November 20, 1989 to make the
appropriate corrections. This inspection revealed that no corrections
were made as ordered. Therefore, this office is requiring that you
correct these situations no later than December 4, 1989. Failure to
comply by the aforementioned date shall force this office to take the
necessary legal action to obtain compliance.

REPORT
A site inspection was made on 11/22/89 at 2:45 pm. This inspection
revealed a violation of ECDC 16.20.030, specifically an elevated deck
with a 4 foot setback where a ten foot setback is required. Mr
MicKinley was notified of this violation of 10/23/89 and was required
to correct no later than 11/16/89. The inspection revealed that no
attempt had been made to comply with the order.
CONCLUSION: A violation of the CECDC 16,20,030 exists. Notify by
letter to correct no later than 12/04/89, If correction is not made by
the ordered date, request that the City Attorney issue a citation.
