The City did not require review under the SEPA for BLD20090664 because of the
exemption in WAC 197-11-800(1)(b)(i) --

They are putting a stormwater outfall into the creek (discharge from their detention
system). In there initial submittal, I suggested they dispersion trench for the
discharge from their detention system instead of the discharge into the creek (avoid
the whole JARPA thing). They said they wanted to discharge into the creek. This
requires a JARPA application for an HPA permit per WDFW.
The SEPA is your call.

Hi Jerry and Jennifer,
I received a voicemail this afternoon from Ginger Holser with Dept. of Fish &
Wildlife regarding a JARPA application she received for an outfall to Fruitdale
Creek at 9531 Forest Dell Drive. I'm not sure if this is something associated with
the application they have in for a new house (BLD20090664). Ginger's question is
that the applicant stated in the JARPA form that the City is not requiring SEPA
review, but she wanted to verify that with us because the applicant did not submit
any evidence of an exemption from us. I talked to Gina, and she is not aware of any
work being proposed in the stream, so we are not sure what the JARPA application
would be for.
I'll be out of the office tomorrow, but could you give Ginger a call back if you
know anything about this. Gina will be in tomorrow, so you could always chat with
her about it. Ginger's number is (425) 379-2305.
If none of you are able to figure it out, let me know and I can call Ginger when I'm
back in the office on Monday.
