ADB -2008-58: The Elm Place Homeowners Association proposes to remove one Red Maple tree
planted in the Elm Place PRD common area and replace it with a smaller tree
better suited to its location.

B. Introduction
The applicant is proposing to remove a Red
Maple planted as part of the Elm Place
planned residential development (PRD) in
1983 (PRD -1-83 & P-9-83). The tree is
located within the Homeowners
Association's common area between
parcels addressed as 604 and 606 Elm
Place. While trees on individual lots are
regulated through ECDC 18.45, changes to
landscape plans are subject to design
review. The subject application does not
trigger SEPA review because as it is an
amendment to an existing plan; therefore,
the proposal may be approved by staff as an
Administrative Staff Decision, subject to
the requirements of ECDC 20.95.040.
C. Findings and Conclusions
The tree in question is located in the
open space area associated with the Elm
Place PRD. The PRD is zoned RS -6.

2. The PRD site consists of relatively mature landscaping as the project was approved in the
early 1980s. While Norway Maple, Sweet Gum and Oak trees were originally planned for
the PRD, it appears that Red Maples were used throughout the development both as street
trees and as ornamental plantings in the PRD open space.
3. The maple in question is located in the common open space area between 604 and 606 Elm
Place but the roots of the tree are pushing up portions of the Helene Spangler's driveway at
606 Elm Place (see attached photos).
4. Given the presence of the mature landscaping in the PRD, the overall landscaping of the site
will not be dramatically altered by this proposal.
5. While Norway Maple, Sweet Gum and Oak were trees originally anticipated for the PRD
landscaping plan, these have not been consistently installed. The applicant shall work with a
certified arborist to determine the type of replacement tree appropriate for the space in
question.
F. Technical Review
The Engineering Division, Fire Department, Public Works Department, and Parks and Recreation
Department have reviewed this application and none of the Departments/Divisions raised any
concerns with the proposal.
G. Decision
Based on the findings, conclusions, and attachments to this report, staff finds that the design
review for file number ADB -2008-58 is APPROVED.

1. Reconsideration and Appeals
Per 20.95.040, a permit applicant may request a reconsideration of the this decision by either the
original decisiomnaker o the planning manager. If the applicant requests reconsideration by the
planning manager and the planning manager is not available to render a decision with the time
limits required by the ECDC, the planning manager shall designate a supervisor of the original
staff decisionmaker to rule on the reconsideration. The request for reconsideration shall be filed
in writing with the planning manager within 14 working days after the date of the decision being
appealed. The requested decisionmaker for the reconsideration shall approve, conditionally
approve, or deny the application. The decision shall be in writing, and shall be appealable to the
hearing examiner under Chapter 20.105 ECDC.
