RE: RESTORATION PLAN FOR 17035 76TH AVENUE WEST (CU -2008-0040)
Dear Mr. Mendez,
The September 14, 2010 landscaping submittal from Urban Forestry Services, Inc. (Exhibit B dated
July 2010), which describes restorative planting and landscape maintenance at the Strand's parcel, is
approved. Such a plan was originally part of the Strand's conditional use permit (Condition 3 of CU -
08 -40) and was subsequently required as part of corrective action associated with a Notice of
Violation issued to Mr. Hathaway on May 7, 2010. A separate building permit (BLD -2010-0573)
was submitted for a drainage improvement on the eastern portion of the Strand's property; this
feature, identified as Exhibit C in the September 14 submittal, was approved by the Engineering
Division with conditions on September 21, 2010.
As noted in the conditions of approval for the associated conditional use permit (CU -08-40), the
following erosion control practices must be implemented as part of the restoration plan (Condition
4):
a. All planting must be done by hand using hand shovels.
b. No mechanical equipment shall be used in the rear yard.
c. Excess soil must be removed during replanting shall be removed from the site.
d. Three to four inches of wood chip mulch must be placed over the exposed soils below each
plant.
In addition, as Condition 5 of CU -08-40 states: all cuttings must be removed from the site except
that any wood chips created from any trees removed from the subject parcel may be spread as mulch
to enhance erosion control as discussed in (4d) above.
As noted in Condition 6 of CU -08-40, two years from the date of final installation of the new
vegetation, the applicant (or his designee) must contact the Planning Division to schedule a final site
inspection to ensure compliance with the approved replacement and maintenance plans. If the
inspection determines the landscaping to be in compliance with the approved replacement plan, the
maintenance bond will be released. Using the cost estimate submitted on August 16, 2010, a bond of
$12,350 is required. You will find enclosed two bond forms to be used depending on the type of
bond selected.
Finally, the stand of 34 deciduous trees at the northeastern corner of the Strand parcel shall not be
removed at this time. The trees are healthy, as indicated in the September 14 report (Exhibit B), and
therefore are not candidates for removal according to ECDC 23.40.220.C.7.b. The September 14
report also recommends against pruning or topping the trees in order to maintain their health and so
they must remain as they are until such time that the trees satisfy code requirements for removal and
a subsequent permit is obtained (Condition 7 of CU -08-40).
The approval granted in this letter does not affect the other requirements, including without, limitation
the imposition of civil penalties, imposed pursuant to the May 7, 2010 Notice of Violation and
Monetary Fine that was issued to Michael Hathaway.
