The City is in receipt of your request for Alternate Materials and Methods of Construction Equivalency
in accordance with Section 301.2 of the 2006 Uniform Plumbing Code for installation of self-
contained water supply and waste units for the espresso machine and hand sink for Beehive Espresso at
23830 Highway 99, Suite 199B.
Your request sets forth reasons why it is prohibitive to provide piped water supply and waste systems
to the tenant space from the existing systems. In reading your request, you appear to clearly
understand and take seriously the issues of sanitation in your business operations. You have provided
written approval from Snohomish County Health District for use of the self-contained hand sink and
espresso machine units. You have provided a Commissary Agreement Letter (part of approval from
Snohomish County Health District) to provide water and waste service for the self-contained units.
The business is subject to the ongoing regulation by Snohomish County Health District.
The request for installation of a self-contained water supply and waste units for espresso machine and
hand sink is hereby approved with the noted conditions below.
• The installation and use of the self-contained units is subject to approval by Snohomish County
Health District.
• Terminationlrevocation of approval by the Health District to use the subject self-contained
hand sink and espresso machine units shall simultaneously terminate the approval of this
Alternate Materials and Methods of Construction Equivalency, requiring a code compliant
plumbing system to be installed or another request for Alternate Materials and Methods of
Construction Equivalency to be approved by the City of Edmonds Building Official.

Dear Ms. Bullis:
We are pleased to submit this alternate methods and materials report for the
proposed Beehive Espresso project in Edmonds. This report will explain how the
proposed installation of a self contained water supply system is equivalent to the
provisions of the Uniform Plumbing Code within the City of Edmonds.
This report was compiled by analyzing Chapter 3 of the Uniform Plumbing Code,
as well as the current standards set in place by the National Foundation of Sanitation and
The Snohomish County Health Department.
This report was prepared in response to an email from Leif Bjorback, Assistant
Building Official for the City of Edmonds, requesting additional information regarding
our water supply system; asking for a formal alternate methods and materials request.
Existiniz Conditions
The Beehive Espresso will be located at 23830 Highway 99 Suite 119b within
The Edmonds Central Plaza. The leased unit (119b) is located on the northeast side of the
plaza and occupies 249 square feet of the plaza.
Unit 119b was an existing drive-thru dwelling previously occupied by Checkmate
Pay Day Loans. In it's current state, the dwelling does not have a water supply line or
drain line available.
Between June 1St and 10Th, we contacted several local Journeyman Plumbers to
determine the best method to provide a constant water supply and sewer drain to the
existing suite 119b. We scheduled appointments with Beacon Plumbing based out of
Seattle and Henry's Reliable and Affordable Plumbing based out of Everett.
. On June 10th 2009, Beacon Plumbing conducted an examination of the Edmonds
Central Plaza. Using a device called a locator, they determined the nearest water supply
and sewer drainage line is 160 feet away from our unit_ In addition, they determined that
the water line and sewer drain both head away from our unit, towards 76`' Ave West.
Beacon Plumbing stated that our proposed plumbing of0100cicinimum
s not possible.
They said that for every one foot of pipe that was traveled, one of
downward sloping soil was needed to remain complaint with the current standards in
place, in order to prevent a clog of the sewer drain line. They determined that this was not
possible given the 160 foot distance.
Given the fact that we are a coffee company, and that water is our number one
ingredient, we were disappointed and sought a second opinion.
On .lune 11th 2009, Henry's Reliable and Affordable Plumbing conducted an
examination of the Edmonds Central Plaza. He determined the nearest water supply and
sewer drainage line is 175 feet away from our unit. In addition, he confirmed that the
water line and sewer drain both head away from our unit, towards 76th Ave West.
Henry's Reliable and Affordable Plumbing confirmed that our proposed plumbing
of the unit was not possible. In addition, he stated that the water line and sewer line is
located inside a neighboring business, which would render that business inoperable.
In conclusion, it is determined that the excavation of a 160 foot trench that travels
through a neighboring business and lacks the sufficient depth to allow proper drainage is
not feasible or reasonable. Because of this an alternate method has to be put in place.
Alternate Method
The Beehive Espresso proposes the use of a self-contained water supply and
wastewater disposal system inside unit 119b. The use of these types of systems is
common place for smaller food business establishments and is used in hundreds of small
businesses statewide.
In choosing a system for our coffee business we considered a variety of items. We
wanted to make sure that the system that we chose was of equivalency or of superior
quality, and strength, fire, as well as effectiveness, durability, and safety to the current
plumbing systems in place.
We also wanted to assure that the system satisfied the conditions of Chapter 3 of
the Uniform Plumbing Code (UPC) for the City of Edmonds. In addition, we made sure
that the system was approved by the National Sanitation Foundation. Finally, we wanted
to assure that the system in place passed the rigorous testing of The Snohomish County
Health Department.
Chapter 301 of the Uniform Plumbing Code is called Materials, "Standards and
Alternates." It sets the minimum standards for City Approved Plumbing Approvals,
Plumbing Markings, Plumbing Standards and Plumbing Existing Buildings. The content
of the UPC is cited below:
301.1.1 Approvals
All pipe, Pipe fittings, traps, fractures, material, and devices used in a plumbing
system shall be listed or labeled (third party certified) by a listing agency (accredited
conformity assessment body) and shall conform to approved applicable recognized
standards referenced in this code, and shall be fie*ffects. Unless otherwise provided
for in this code, all materials, fixtures, or devices used or entering into the construction
of plumbing systems, or parts thereof, shall be submitted to the Authority Having
Jurisdiction for Approval.
3011.2 Marking
Each Length of Pipe and each pipe fitting, trap, fixture, material, and device used
in a plumbing system shall have cast, stamped, or indelibly marked on it the
manufacturers mark or name, which shall readily identify the manufacturer to the end
user of the product when such marking is required..64 the approved standard that
applies_ When requiredtd the approved standard that applies, the product shall be
marked with the weight and the quality of the product. All materials and devices used or
entering into the construction of plumbing and drainage systems, or parts thereof, shall
be marked and identified in a manner satisfactory to the Authority Having Jurisdiction.
All such marking shall be done by the manufacturer_ Field marking shall not be
acceptable.
301.1.3 Standards
Standards listed or referenced to in this chapter or other chapters cover materials
that will conform to the requirements of this code, when used in accordance with the
limitations imposed in this or other chapters thereof and their listing. Where a standard
covers materials of various grades, weights, quality, or configurations, there may be only
a portion of the listed standard that is applicable. Design and materials for special
conditions or materials not provided for herein may be used only by special permission of
the Authority Having Jurisdiction after the Authority Having Jurisdiction has been
satisfied as to their adequacy. A list of accepted plumbing materials standards in
included in Table 14-1. All LIPMO Installation Standards are included in Appendix I for
the convenience of the users of this code. They are not considered as apart of this code
unlessformally adopted as such by the Authority Having Jurisdiction.
301.1..4 Existing Buildings
In existing buildings or premises in which plumbing installations are to be
altered, repaired, or renovated, the Authority Having Jurisdiction has discretionary
powers to permit deviation from the provisions of this code, provided that such a
proposal to deviate is first submitted for proper determination in order that health and
safety requirements, as they pertain to plumbing, shall be observed.
According to the approvals section of the UPC, our water supply and wastewater
disposal system conforms to those requirements. The system also conforms to the
marking requirements set forth in the UPC.
In reference to the Standards and Existing Buildings sections of the UPC, it is
clear that the intent of the code is to set standards in an effort to provide safety,
sanitation, and health standards for the public_ The Snohomish County Health
Department has standards set in place for food and beverage businesses in Snohomish
County and according to them, our water supply and wastewater disposal system meets
this criteria.
Chapter 3 section 1.2 (301.2) of the Uniform Plumbing Code discusses the need
for equivalency and the process of testing systems in an effort to meet the approved
standards in place. It reads as follows:
301.2 Alternate Materials and Methods of Construction Equivalency
Nothing is this code is intended to prevent the use of systems, methods, or devices
of equivalency or superior quality, strength, fire resistance, effectiveness, durability, and
safety over those prescribed by this code. Technical documentation shall be submitted tot
the Authority Having Jurisdiction to demonstrate equivalency. The Authority Having
Jurisdiction shall approve the system method or device when determined to be equivalent
or superior.
However, the exercise of this discretionary approval by the Authority Having
Jurisdiction shall have no effect beyond the jurisdictional boundaries of said Authority
Having Jurisdiction. Any alternate material or method of construction so approved shall
be considered as conforming to the requirements and /or intent of this code for any
purpose other than that granted by the Authority Having Jurisdiction when the submitted
data does not prove equivalency.
301.2.1.1 Testing
The Authority Having Jurisdiction shall have the authority to require tests, as
proof of equivalency.
301.21.2
Test shall he made in accordance with approved standards, by an approved
testing agency at the expense of the applicant. In the absence of such standards, the
Authority Having Jurisdiction shall have the authority to specify the test procedure.
301.21.3
The Authority Having Jurisdiction shall have the authority to require tests to be
made or repeated if, at any time, there is reason to believe that any material or device no
longer conforms to the requirements on which its approval was based.
Section 301.2 of the UPC states, "Nothing in this code is intended to prevent the
use of systems, methods, or devices of equivalent or superior quality". The intent of the
code is clear in that alternate materials and methods are acceptable as long as they show
equivalency.
National Sanitation Foundation
Founded in 1944, the National Sanitation Foundation is a non-profit,
non-governmental organization dedicated to developing standards, product certifications
and risk -management practices for public health and safety. NSF focuses primarily on
food, water, indoor air quality and the environment while developing its standards.
Though food service equipment does not have to bear the NFS mark, those
models that do are easier to clean and ensure a safer commercial environment. Many
local health codes require the use of NSF certified equipment. This is designed to reduce
the risk of harmful bacteria reproducing.
The NSF mark on food service equipment means that everything from the product
design to materials used to create the product have been tested and conform to food
equipment safety and sanitization standards. In order to achieve the mark, products
undergo a rigorous inspection in three key areas:
Product Design: The product is physically evaluated to assure that it meets proposed
specifications.
Material Review: Toxicologists inspect the manufacturing materials to assure that they
are safe for use in commercial businesses. Materials used must also be corrosion
resistant.
Cleaning Ease: The product is tested to assure that it is easy to clean and sanitize.
Manufacturing facilities are also subject to annual audits to assure that the production
processes and materials used still conform to NSF standards.
Currently, there are over 120,000 individual food service products that carry the
NSF certification. In addition to the aforementioned design, material and cleaning case
tests, more complex pieces of food service equipment have specific performance
requirements.
Commercial refrigeration equipment must be able to keep stored foods at the
appropriate temperatures (below 40°F for refrigerators and at or below 0°F for freezers),
and the thermometers must display accurate readings, as well. Hot beverage dispensing
equipment must keep beverages above 140 °F, and cold beverage dispensers must keep
fluids below 40 °F.
Frozen Drink and Dessert Dispensers. Equipment that dispenses frozen items like
smoothies or soft -serve ice cream must keep foods appropriately cold even at the
dispensing head or spout.
Explanation of Water Supply and Wastewater Supply
Listed below are the items that are needed for the complete setup of a State
Certified Espresso Cart according to the Rules and Regulations of the State Board of
Health and in concert with The National Sanitation foundation (NSF).
The Beehive Espresso's Cart system contains these exact items and has been
approved by The Snohomish County Health District. In fact, the self-contained system is
the preferred method of providing water and wastewater among Espresso establishments
countywide and statewide.
For better understanding of how our system operates, please reference the
attached diagram in Appendix A, which demonstrates the flow of water and wastewater
disposal. To allow better understanding of each individual component, please reference
the attached listing which can be found in Appendix B.
Equivalency
Given the information we have provided, we believe that we have taken every
precaution and responsible measure to provide a sanitary water supply and wastewater
disposal system that is at minimum equivalent and (in our opinion) superior to the
conditions put forth in Chapter 3 of the Uniform Plumbing Code.
The Uniform Plumbing Code provides for government regulation and discretion
for a regulatory body to decide if systems are safe and sanitary. The Snohomish County
Health Department has provided us with instruction and approval for a safe and sanitary
water and wastewater disposal system. Their approval is reevaluated annually and testing
is performed annually which conforms with section 301.2 of the UPC.
In considering our customers, which are very important to our business, we make
sure that our equipment is of the highest standard. We find that the National Sanitation
Foundation is the most credible and respected source in the country for food and
beverage establishments owners to educate themselves about which equipment to
purchase.
Conclusion
To sum up, this is why we stand by our decision to purchase and operate a self
contained water supply and wastewater disposal system. We request that it be allowed to
be used in providing the citizens of Edmonds with years of great espresso and joy.

provided they are not mixed with ice in a blender. Blenders maybe used to crush ice and then the
ice maybe added to a drink and stirred in with a stirring device.
3. All water and waste water must be serviced at the approved commissary.
4_ Energy drinks may only be prepared drinks that are commercially sold in ready to drink
containers, such as Red Bull_ The use of drops or powders and the like to add to a drink is not
allowed as these items contain ingredients that are not on the FDA Generally Considered as Safe
list. Many of this products carry warning labels in small print advising that this items may be
hazardous to people's health if not used properly or should not be used by some people.
5. Water heaters must be of sufficient size to provide hot water to dishwasher and/or scullery sinks
and at the same time provide hot water to all handwash sinks.
6. All food service equipment, both new and used, trust be listed by the National Sanitation
Foundation (NSF) or equivalent for its intended use. Used and new refrigeration must be capable
of holding potentially hazardous food at 41'F or below.
T Used equipment is subject to on site inspection to determine acceptability for use in the proposed
food service establishment. Used equipment must be clean, in proper operating condition, and in
good repair. Used refrigeration must be capable of holding potentially hazardous foods at a
temperature of 41°F or below.
8_ Extra wall protection is required on walls behind all sinks, including restroom handwash sinks,
and food preparation counters and tables. A 16 -inch high backsplash of plastic laminate,
fiberglass -reinforced plastic or equal is acceptable. A backsplash higher than 16 inches is required
on the wall behind counter top equipment taller than 16 inches. Floor to ceiling protection is
required on the wall behind dishwashers. Wall protection behind mop sinks must cover the entire
splash zone. Plastic coated hardboard is not acceptable.

9. All floors in the kitchen, food preparation, food service, food storage, and dishwashing areas must
be surfaced with a durable, nonabsorbent, easily cleanable material. Expansion joints, seams, saw
cuts and the like in concrete floors in all areas, including customer seating areas, must be filled
and sealed so as to provide a smooth and cleanable surface.
10. The ceiling above the food preparation areas must be nonperforated, nonabsorbent, smooth and
easily cleanable_
11. All light fixtures in food preparation and storage areas must be provided with covers or
shatterproof bulbs_ Hot hold unit heat lamps must be provided with shatterproof bulbs.
A preoperational inspection is required prior to operating permit issuance and approval to
open for business. At the time of inspection the construction of the food service establishment must
be complete and all equipment must be in place and in proper operating condition. Incomplete
construction or equipment operation will result in a $150.00 reinspection fee. Requests for a
preoperational inspection must. he received at least one week in advance of the date being
requested for the inspection. Contact the Food Program office a minimum of one week in
advance to schedule an appointment for the preoperational inspection. The preoperational
inspection will ensure compliance with the Rules and Regulations of the State Board of Health for
Food Service Sanitation.
Changes or additions to the approved plans or equipment require pre -approval from the Snohomish
Health District prior to implementation of the changes.
