I have reviewed the above building permit application and revised site plan for the Planning Division.
Before I can sign off on it I still need the following:
1.Setbacks: Thank you for showing that the deck, as cut back, will maintain a 21 foot setback to the
street. As I mentioned earlier, in order not to meet the required 25-foot setback in the RS-8 zone, you
need to show how you meet the provision that states, “Uncovered and unenclosed porches, steps,
patios, and decks may project into a required setback not more than one-third of the required
setback, or four feet, whichever is less; provided that they are no more than 30 inches above ground
level at any point.” This would allow a deck and steps no higher than 30 inches to maintain only a 21-
foot setback. I still need the following:
a.Show steps to the deck on the site plan (see attached example). (If these steps will no longer be
provided, they will need to be taken off the floor plans.)
b.State if the deck is less than 30 inches at all points (see attached example). Note that we do allow
the deck to be less than 30 inches from ground level, and ground level (finished grade) can be
brought up provided it is no higher than three feet above the original grade as shown in the plat
topography survey. So if your ground level currently matches the original grade, and your deck
was 4 feet above ground level, you could back fill 1.5 feet so that it was no more than 30 inches
above ground level.
c.Show the exact setback to the steps (see attached example).
d.The steps must meet the required 21-foot setback.

Please make all submittals to the Development Services Permit Coordinator, and provide two copies of
any revised plans or elevations and three copies of any site plans. Your existing plans and elevations may
also be red-lined.
