I have reviewed the above building permit application for the Planning Division. Before I can sign off on
it I need the following:
1.Fireplace: Please show the fireplace on the site plan.
2.Decks to the south: Elevated decks typically have to maintain setbacks, though there is a provision in
ECDC 16.20.040.C. for low level decks to extend into the setback as follows: “Uncovered and
unenclosed porches, steps, patios, and decks may project into a required setback not more than one-
third of the required setback, or four feet, whichever is less; provided, that they are no more than 30
inches above ground level at any point.” The rear decks are currently shown with an 8-foot setback.
Given the required 15-foot rear setback, one-third of the setback (5 feet) is more than 4 feet, so the
decks can only intrude 4 feet into the setback. In other words, they must maintain an 11-foot setback
to the rear property line. And they can only go into the setbacks at all if they are no more than 30
inches above ground level at any point. The ground level can be manipulated somewhat to meet this
requirement, but fill over three feet is not allowed in the setbacks.
a.Please show how the decks meet setbacks.
3.Datum Point: Several possible datum points have been shown in the manhole covers in Daley Street.
a.Please state which manhole (or other item) is considered the datum point.
4.Height:
a.The height shown on the building elevation makes it appear that the proposed height is over a foot
less than the maximum height, when actually it is less than two inches below the maximum height.
Please show the maximum allowed height accurately on the building elevation.
b.Does the elevator require a penthouse that would extend above the roofline? If so, please include
it in your drawings.
5.V-06-116: Thank you for providing the bid from Earth First Landscaping for the installation and
maintenance of the buffer mitigation plan. By my calculations, their bid totals $41,340 which includes
three years of monitoring and maintenance. In order to comply with the requirements of the decision
for your critical areas variance and reasonable use exception, I will also need the following:
a.Please provide two copies of Landau’s buffer mitigation plan for the building permit file.

b.Provide a financial guarantee, such as a bond, for 120 percent of the cost per ECDC 23.40.290.
With a cost of $41,340, the bond or frozen fund must be in the amount of $49,608. Marie
Harrison will e-mail you the forms for the frozen fund account. If you prefer to go through a
bonding company, Marie could also send you the forms for that.
c.Make sure your plans meet the requirements of the geotechnical report by Dennis Bruce.
d.Grading shown on the civil grading plans shows grading for the driveway intruding into the
agreed-upon stream buffer area, as shown on the site plan.
(i) All grading shall be done outside of the stream buffer area.
(ii)Temporary erosion control fabric fences shall be installed so as to protect the entire buffer
area.

any revised plans or elevations and three copies of any site plans. Your existing plans and elevations may
also be red-lined.
