Before I address the code issues that you have referenced in your letter I am concerned that some of your statements suggest that Mr. Crozier has already made improvements and/or moved new tenants into spaces that would have required permits and/or advanced City occupancy approval. If this is the case Mr. Crozier shall immediately identify to the City in writing, which tenants are a change of occupant group/use based on the last permitted occupancy approval for each space and also indicate what work has been performed without first obtaining a building permit. No further construction work may be performed on his building until a valid building permit is issued. Regarding existing buildings, as you may know the State Building Code Council is considering adopting the 2006 edition of the International Existing Building Code (IEBC) in July of 2007. Public hearings this summer may provide an early indication of whether or not the Council will adopt this code which may ultimately address some of your building code issues. In the meantime, International Building Code (IBC) Section 104.11, entitled Alternate Designs allows the Building Official to consider alternate materials, designs and methods for code equivalency, for example using the IEBC in lieu of the IBC or reviewing a floor -ceiling assembly that has not been specifically tested, etc. However, please be advised, an alternate design request requires the design professional demonstrating that in his/her professional opinion, equivalency to the code requirement is met with the proposed alternate design. Sometimes equivalency is proven with testing and/or reports by certified individuals. The Building Official reviews the request and concurs or disagrees with the argument of code equivalency. As with all alternate design requests the City suggests that property owners consult with legal advisors and their insurance company regarding liability associated with alternate designs. The change of B2 occupancy to B & M occupancies occurred in the 1994 edition of the Uniform Building Code, not the 2003 IBC; however, the 2 hour fire barrier requirement was introduced in the 2003 IBC. The 2003 IBC is the current adopted code by the State and City and is the code which Mr. Crozier's project is subject to. The basis for the fire barrier requirement between B and M occupancies is primarily because mercantile occupancies normally involve certain quantities of combustible merchandise and the fuel load is considered to be substantially higher than an office. This higher degree of fire hazard is certainly a key reason for the code requirement and for added protection between M and other occupancies. Also, M occupancy customers are less familiar with the means of egress systems as opposed to an office building primarily occupicd,by regular employees. The non -separated uses section attempts to address mixed use occupancies up to a certain area in size. Lastly, for clarification, Ms. Bullis did not suggest to you to write a letter to the City Building Official rather when you wanted to discuss basing the use on previous codes rather than current code, she informed you that your could write a tetter to the Building Official explaining your position. She also explained the alternate design review process. Mr Crozier and I have met with Ann Bullis, and at her suggestion we are sending you this letter. Last fall, Mr. Crozier changed tenants in his building. This required some repartitioning on the main floor, which in tum required applying for a building permit. During the plan review, Ann Bullis has determined that we have had a 'change of occupancy', and therefore we are now required to provide occupancy separation between tenants. This was the reason for our meeting With Ann, and also this letter to you. Here is a brief history of the property: 'The Old church" was moved to the site in 1983 and permitted as a B-1 / B-2 occupancy under the 1982 UBC. The structure is a two-story wood frame structure with a basement, Type V -N: The main floor was B-2, retail and offices. The second story was B-2, offices. The basement was B-2, storage and B-1, garage. The only occupancy separation required was one-hour between the B-1 and B-2, which exists. Over the years the tenants on the main floor have changed. The space has been retail (furniture sales), offices, publishing co., and beauty salon. These have all been B-2 occupancies and were allowed under the current certificate of occupancy. The proposed change of tenants, by Mr. Crozier, under the definitions of the original permit and current certificate of occupancy, are only that — a change of tenant — not a change of occupancy. The previous tenants, a beauty salon and publishing co., changing to retail are stili B-2. it is only under the new IBC that this has become a change of occupancy which in tum is requiring a 2 -hour separation between the office (B) and retail (M) We feel that this is causing excessive hardship on Mr. Crozier. In similar situations to this one, other jurisdictions have allowed tenants to change based on the existing certificate of occupancy and code requirements under which that certificate was issued. Additionally, IBC section 3496.1 allows the building official to permit a 'change' without all of the requirements of the code being met, if the change is less hazardous than the existing. We do not feel that two small retails spaces are of any greater risk than was existing in this structure for the last 20 years, with previous retail tenants. Two-hour partitions separate the tenants on the main floor. The floor -ceiling assemblies are not specifically 9ested' assemblies, but they are Gose, and they exceed 1 -hour fire ratings. (We have enclosed a sketch of the floor -ceiling assemblies.) To provide 2 -hour rated construction on the walls, columns and beams which support a 2 -hour floor / ceiling assembly would not be economically feasible. The exterior walls of the building would need to be stripped and completely sheathed and resided. it was suggested that per IBC 302.3.1 Nonseparated Uses could be used to eliminate the need for fire separation. For this to be applied, the building would need to be 1 -hour rated. This also would require the exterior walls to be stripped, sheathed and resided. We are asking you to consider this situation. is this really a higher risk? A risk any different than it has been for the last 20 years? Or can the 'existing certificate of occupancy' be considered to continue allowing the original B-2 occupancies? 1 have been retained by Mr. Crazies to assist him with this situation, and we will work to resolve all other concerns noted in your plan review such as exiting, accessibility, area calculations and project information, and properly prepared and 'stamped' drawings.
