In response to your letter dated May 27, 2008 the City has the following comments:
• Thank you for the address correction it is now noted in City records.
• Please refer to an enclosed copy of the original building permit (reference permit 670152
issued in April of 1967 to George Cole). Please note that the permit indicates a total number
of one dwelling unit. Also note that the zoning is RS -6 which indicates a single family not
multifamily zone.
• Please refer to the enclosed copy of building permit 730190 obtained by Paul Benthall in
April of 1973. Please note that the permit indicates a total of one dwelling unit.
• The City has no record of when the structure was complete and inspection records indicate a
rough -in plumbing inspection in 1974 but no other progress inspection approvals. It does not
appear that the City performed a final occupancy inspection.
• Please refer to Building Official policy dated July 1, 2004 regarding enforcement of illegal
dwelling unit kitchens and removal of kitchen features including 220 wiring and circuit
breakers. The City Planning Manager allows two kitchens in a single dwelling unit provided
a `Statement on Accessory Dwelling Unit' Covenant is recorded against the property (please
refer to enclosed form). If more than two rooms have features that define a kitchen as
indicated in the Building Official policy, the noted features including the 220 wiring and
circuit breakers must be removed.
• Existing storage rooms are not permitted to be used as sleeping rooms unless compliance for
emergency egress, smoke alarms, etc. are provided.
• The City Building Inspector noted sheetrock work performed albeit minor in nature.
• The permit fees paid by the Ashby -Michels' include investigation fees (fees paid in addition
to normal permit fees) because work had started/or was complete prior to permit issuance.

On behalf of the Ashby -Michels I would like to thank you for your assistance
during the past few weeks in resolving the various issues at the above referenced address.
As we discussed in our various voice -mail exchanges, because the 220 volt lines at issue
are not placed in conduit, you will consider it acceptable if they disconnect the wire from
the breaker box, cut it back three-four feet, remove the associated circuit breaker, remove
the outlet, cut the wire back three-four feet at the outlet, and patch over the remaining
hole.
However, there is still some uncertainty with respect to the Ashby-Michcl's desire
to pace a bar in one of the rooms. !n yc r mer! recent voice mail, vo'.e advised tha!
they would have to obtain an Accessory Dwelling Unit in order to install a wet bar. I am
confused, because my review of Edmonds Municipal Code indicates that, since the
Ashby -Michels do not reside in this house, they are not eligible for an Accessory
Dwelling Unit.
To clarify, the Ashby -Michels desire to create a wet bar by installing a small,
single -basin sink in one of their rooms, along with 6-8' of counter and cabinets. This
room will not have a 220 volt outlet, nor will it have any special ventilation. While a sink
and counter could be construed as indicia of a second kitchen, it is not necessarily so.
Furthermore, during one of his visits a certain "Mike" with code enforcement
indicated that wet bars were unregulated, and could be installed without limitation.

I represent Brian and Barbara Ashby -Michel, the owners of the above -referenced
property. I have been retained to assist the Ashby -Michels in working with the
Development Services Department (the "Department") in addressing the issues raised in
the Order to Correct Violation, dated May 9, 2008, and the letter of the same date.
As an initial matter, my clients contest the Department's assertion that the property
contains "four separate illegal units". Nevertheless, in a spirit of cooperation, the Ashby -
Michels are prepared to take reasonable and appropriate measures to ensure that the
structure is compliant with all applicable codes.
BACKGROUND
The residence located at 120 9th Ave. N. (the "Residence", which is incorrectly
referred to as "1209 91h Avenue North" in your May 9 letter), was constructed in 1967 or
1968 by George Cole. Ms. Ashby-Michel's grandfather, Paul Benthall, purchased it
partially complete in 1972 as a retirement project. He worked on it for approximately
four years before he and Ms. Ashby-Michel's grandmother moved in. To the best of my
client's knowledge, Mr. Benthall obtained all necessary permits and approvals, and the
configuration of the Residence is the same as it was in 1976.
In recent years, the Residence has been used as a rental where all areas of the
house were freely used by all the residents. All the tenants in the history of the house

have been members of an extended family who have freely communicated between all
areas of the Residence.
The utilities for the whole house have always been in one name, and all residents
have been covered by a single lease. There is a single water meter, and a single electrical
meter. There has never been "four separate illegal units" as alleged by the Department.
While the house is large and unusual, it has not been significantly modified since its
original construction.
DISCUSSION
The City has requested several repairs and/or modifications to the Residence,
many of which the Ashby -Michels do not contest. Specifically, the Ashby -Michels have
already obtained a permit to install the gas piping for the two fireplaces, and have a
building application acceptance letter for the repair of the existing deck. They have also
applied for a permit to build the two sets of exterior stairs. They have already incurred
$719.00 in permitting costs.
Furthermore, the Ashby -Michels will remove the 220 volt plugs located in the
office and in the wet bar and put cover plates over them. However, they question the
need to remove the wiring back to the box. It is possible that some future buyer may
consider the 220 volt outlets to be advantageous. Air compressors, tanning beds, kilns,
and numerous other devices can require 220 volts. Indeed, a future buyer/resident could
legally construct a mother-in-law apartment, or the building could legally be utilized as a
group home.
Neither 1, nor the Ashby -Michels are aware of any limitation on the number of 220
volt outlets that a house can have. If such a statute exists, please provide the reference
and we will, if necessary, reconsider our position. Otherwise, it would appear that your
position with respect to removing the wiring amounts to a deprivation of property without
due process, in violation of the United States and Washington constitutions.
The Ashby -Michels question your designation of one of the basement rooms as a
"kitchen", based solely on the fact that it has a kitchen -type sink. In point of fact, there is
no 220V outlet, no stove, and no exhaust hood. This does not appear to meet the
definition of a "kitchen" per Edmonds Municipal Code 21.50.020, and no modifications
appear to be needed.

With respect to the other room in the basement with a kitchen -type sink, this sink
will be replaced with a wet bar, and the 220 volt outlet will be removed and capped off.
There is no exhaust fan in this room.
The Ashby -Michels are unaware of any need to modify the egress requirements
for any of the designated sleeping rooms. The Ashby -Michels speculate that you may be
referring to a basement storage room that has a high window. If so, that particular
window is the original window from when the house was built. This room has never
been used for anything but storage, has no door, and has a cement floor. No one has ever
used it as a bedroom.
Your May 9 letter also makes reference to eliminating "doors, walls, etc." to create
"freely communicating spaces". While admittedly unusual, this property has never been
utilized as four separate units. The interior walls and doors perform a very important
function of managing the house's significant energy needs. The Residence is equipped
with baseboard heat, and each room has its own thermostat. The interior doors enable the
residents to shut off those areas of the house that they do not wish to heat. In this era of
energy conservation, your suggestion that interior doors and walls should be removed
runs contrary to common sense, especially given the house's size. Furthermore, the
interior doors are non-locking. As stated earlier, all of the renters throughout the history
of the house have had access to all areas of the house, save a small storage area in the
basement maintained by the owners. Similarly, the numerous exterior doors are unusual,
but do not appear to be a violation of any code section.
F..dmonds Municipal Code does not define "dwelling unit" in terms of doors or
access, but rather in terms of "complete housekeeping facilities." EMC 7.30.010(A).
Thus, it appears that Department is without authority to demand the removal of any
doors, internal or external. Requiring the Ashby -Michels to deconstruct the building as
suggested amounts to a deprivation of property without due process, in violation of the
United States and Washington constitutions.
Finally, there are no plans to abandon any plumbing as the only kitchen sink being
removed will be replaced with a wet -bar. There is also no need to remove any stove
hoods or venting, as none of the spaces thought to be "kitchens" by the Department, other
than the main kitchen, arc equipped with any ventilation. Since no sheetrock repair is
proposed, aside from minor blemishes to be touched up pursuant to painting, no

sheetrock permit appears to be necessary. Finally, since no remodeling is proposed, no
remodeling permit appears to be needed.
Enclosed is a floor plan, showing the uses to which each room is put and the
proposed changes. It is hoped that this proposal is acceptable to the Department. It is
also hoped that the Department will note the prompt action taken by the Ashby -Michels,
and the fact that they have already applied for the necessary permits. Clearly, the Ashby -
Michels are responsible owners, and are taking appropriate actions in response to the
Department's concerns.
Please let me know at your earliest convenience whether this proposal is
satisfactory to the Department.

Thank you for arranging a site inspection with the City Building Inspector. The purpose of this
letter is to outline what additional information the City requires in order to ascertain what must
be done to dissolve the four separate illegal units within the referenced residence. As you are
aware the zoning for the property only permits one dwelling unit. There are provisions in the
Edmonds Community Development Code for Accessory Dwelling Units but they are not
permitted if the house is not your primary residence (which the City understands it is not).
Please provide a scaled floor plan indicating the existing rooms. areas and uses of all spaces on
each floor. Then provide a second plan indicating what uses are to be eliminated (for example
the three kitchens) and what doors, walls, etc. will be removed to create freely communicating
spaces. With this information the City can determine whether or not the proposed configuration
is appropriate for a single family dwelling. Of concern are the existing seven separate exterior
entrances and the lack of free movement between all parts of the residence, please specifically
address these issues on your proposed floor plans. Also note it is only permitted to have one
working kitchen in a single family dwelling unless a Second Kitchen Covenant is approved and
recorded with the Snohomish County Auditor.
Regarding permits that are required we have the following information based on the walk-
through inspection:
• Permit required for deck repair/alteration, replacement and guardrail (note guardrail required
to be replaced to meet current code). Please immediately secure the deck area from use as it
has been structurally altered and is not structurally sound.
•
Permit required for abandoning plumbing (for example the kitchen plumbing)
• Stove wiring shall be removed back to the electrical box (State Electrical permit required,
note all other wiring is also required to be under a State Electrical permit)
• Other than the upper floor designated kitchen, all other stove hoods and venting shall be
removed (mechanical permit required to abandon)
• Permit required for exterior stairs (note handrails required)

The City has received a complaint, with supporting evidence, that the single family home has undergone a
conversion to create up to four separate units. According to Edmonds Development Ser ices records, no
accessory dwelling unit (ADU) or building, mechanical or plumbing permits related to a conversion, have
been obtained.
The subject property is zoned Single Family Residential (RS -6). Accessory Dwelling Units arc a permitted
secondary use in single family zones but do require a conditional use permit and any associated
construction permits. Please note that an accessory tAvelling unit permit requires the owner of the property
to lire at the property
A building remodel permit is also required for the construction changes usual in developing an ADU or an
apartment(s) in a single family structure. Due to the ADU regulation requiring the property to be owner
occupied, certain construction developments, such as those separating the residence into separate units may
not be approved.
Corrective actions required'
• The most expedient method to ascertain what options are feasible to bring the property into code
compliance would be to arrange an inspection. The City requests to inspect the interior of the
structure.
• Please contact me at your earliest convenience at 425-771-0220 x 1716 by April 15, 2008 to
respond to this letter, arrange an inspection and convey your plan. Please note that I will be out of
the office from March 31 through April 8, 2008.
The enclosed Work Exempt handout notes the type of construction work that is exempt from permit
