Mr. Hoang,
I have reviewed the Traffic Mitigation report from Gibson Traffic Consultants submitted to the City
on September 18, 2009. In this report, the engineer proposes that Modern Nails land use to be
considered “specialty retail” for trip generation purposes. “Specialty retail” does fit this business if it
was a stand alone business on it’s own property. However, this business is located within a property
that has a land use type of “shopping center”, therefore all businesses within this property must be
considered the same land use of “shopping center”.
While we cannot accept the proposal put forth in the submitted Traffic Mitigation report, it appears
that the previous business was a check cashing business. This business also had to be classified as a
“shopping center”. Therefore, since both businesses were of the same classification and both were of
the same square footage (1200sf), there will be no increase of anticipated traffic and no mitigation
fee required.
