As you may know, I am a huge proponent of Low Impact Development and have done a
couple of LID projects in the City of Shoreline. I am really happy to see that on this Cedar
Street site, a compromise has been reached that will allow the developer to implement
sensible LID strategies 'that are compatible with the terrain thus unburdening the piped
storm system from most of the water that will land on this property.
A maintenance covenant that gets recorded on title for any type of storm system is pretty
Much standard fare these days, in all jurisdictions. In fact, without agreements of this type,
City officials would carry -too much liability when owners don't properly care for these
systems,
The LID storm components and maintenance agreement for this site need to get spelled
out on a document that will get recorded on title, but I believe that the actual recording of
the document should not take place until the system components have been installed for
two reasons.
'I . An as -built drawing after construction will reflect what the system really looks like.
rhere are always variables in the field and until the storm water assembly is
complete, the drawing will not be accurate.
2. If the economy doesn't improve enough to justify the construction of this new home,
the recording of the document becomes irrelevant. Having a cloud on a title on
something that MAY happen is generally not done. I
In Shoreline, they have a policy of getting the Covenant recorded after the work is
complete. They have leverage because they will not sign off permits or permit occupancy
until the documents are filed with the county.
So, we will have the documents prepared for your approval, but request that you place a
condition on the permit and plans that the covenant be recorded after installation and
before.finals are issued.
