On behalf of the Planning Division, I have reviewed the above building permit revision. During review of the
subject submittal, it was found that the following information, corrections, or clarifications need to be addressed.
Please respond to the following items, so that I can complete my review:
Tree Removal
1.: The revised building permit requests the removal of three trees that were previously identified
as trees that were to be retained. The two trees within the eastern property line building setback (Trees A and B
on the revised site plan) are subject to a condition of the short plat for the property. Condition of approval 1.e
for short plat S-02-199 states:
The trees in the setbacks shall be retained during plat and home construction and shall only be removed by
future homeowners as part of their landscaping choices. Trees to be retained shall be protected with
barriers around the drip line prior to any site work. Any tree can be removed if an International Society of
Arboriculture certified arborist can determine that it is a hazard. The applicant is encouraged to preserve
additional trees where possible.
In order to approve the removal of Trees A and B, the City needs a report from a certified arborist which
identifies Trees A and B as hazardous trees. The arborist should use the International Society of Arboriculture’s
Tree Hazard Evaluation Form in evaluating the hazardous nature of Trees A and B. Tree C is not one of the
trees identified in Condition 1.e above; however, the condition does encourage the preservation of additional
trees where possible. Tree C is about 15 feet from the foundation according to the site plan. If Tree C can be
reasonably protected during construction, it should be retained.
ECDC 18.45.050.H provides tree protection measures for trees on construction sites.
H. When tree cutting or land clearing will occur pursuant to a building, permit protection measures
should apply for all trees which are to be retained in areas immediately subject to construction. The
requirements listed may be modified individually or severally by the city if the developer demonstrates
them to be inapplicable to the specific on-site conditions or if the intent of the regulations will be
implemented by another means with the same result.
Where the drip line of a tree overlaps a construction line, this shall be indicated on the survey and the
following tree protection measures shall be employed:
1. The applicant may not fill, excavate, stack or store any equipment, or compact the earth in any
way within the area defined by the drip line of any tree to be retained.
2. The applicant shall erect and maintain rope barriers on the drip line or place bales of hay to
protect roots. In addition, the applicant shall provide supervision whenever equipment or trucks
are moving near trees.
3. If the grade level adjoining a retaining tree is to be raised or lowered, the applicant shall
construct a dry rock wall or rock well around the tree. The diameter of this wall or well must be
equal to the tree’s drip line.
4. The applicant may not install ground level impervious surface material within the area defined by
the drip line of any tree to be retained.
5. The grade level around any tree to be retained may not be lowered within the greater of the
following areas: (a) the area defined by the drip line of the tree, or (b) an area around the tree
equal to one foot in diameter for each one inch of tree caliper.
6. The applicant may prune branches and roots, fertilize and water as horticulturally appropriate for
any trees and ground cover which are to be retained.
If you wish to remove trees A and B, please submit an arborist report which documents trees A and B as
hazardous trees. Tree C may be remove, but if possible, should be retained.
