On behalf of the Planning Division, I have reviewed the above building permit application.
During review of the subject submittal, it was found that the following information, corrections,
or clarifications need to be addressed. Please respond to the following items, so that I can
complete my review:
Outdoor Seating
1.: The plans indicate the project will result 62 interior seats and 28 exterior
seats. Pursuant to ECDC 17.75.020, a conditional use permit is required for outdoor dining
that exceeds 10 percent of the existing interior seating or more than eight seats. Conditional
use permits for outdoor dining are Type III-A decisions approved by the hearing examiner.
For the outdoor seating area proposed, a conditional use permit is required. See the

for information on the application requirements and process for a conditional use permit.
The cost to apply for a conditional use permit is $1375 ($1350 for the conditional use and
$15 City surcharge).
The City of Edmonds is in the process of updating its outdoor dining regulations which may
result in a less complex and less expensive process. The update is still at the planning board
stage and may take a few months before the update is completed.
The Type III-A conditional use process generally takes two to three months to complete.
You may wish to modify your outdoor seating at this to only eight seats and no conditional
use permit would be required, and then revisit outdoor seating once the code has been
updated. However, I cannot predict what the changed code will look like or whether it will
result in a more simple and less expensive process.
So there are two options: 1) Submit for a conditional use permit for the outdoor seating as
proposed, or 2) revise the outdoor seating to no more than eight seats and revisit outdoor
seating once the code has been updated.
