• The facility shall be operated in accordance with the 1986 retirement home agreement (AFN 8605020097). If any other use is
proposed in the future, all zoning requirements must be met including the parking requirements applicable at that time.
• Final approval on a project or final occupancy approval must be granted by the Building Official prior to use or occupancy of
the building or structure. Check the job card for all required City inspections including final project approval and final
occupancy inspections.
• Any request for alternate design, modification, variance or other administrative deviation (hereinafter "variance") from
adopted codes, ordinances or policies must be specifically requested in writing and be called out and identified. Processing
fees for such request shall be established by Council and shall be paid upon submittal and are non-refundable.
• Approval of any plat or plan containing provisions which do not comply with city code and for which a variance has not been
specifically identified, requested and considered by the appropriate city official in accordance with the appropriate provision
of city code or state law does not approve any items not to code specification.
• Sound/Noise originating from temporary construction sites as a result of construction activity are exempt from the noise limits
of ECC Chapter 5.30 only during the hours of 7:00am to 6:00pm on weekdays and 10:00am and 6:00pm on Saturdays,
excluding Sundays and Federal Holidays. At all other times the noise originating from construction sites/activities must
comply with the noise limits of Chapter 5.30, unless a variance has been granted pursuant to ECC 5.30.120.
• Applicant, on behalf of his or her spouse, heirs, assigns, and successors in interests, agrees to indemnify defend and hold
harmless the City of Edmonds, Washington, its officials, employees, and agents from any and all claims for damages of
whatever nature, arising directly or indirectly from the issuance for this permit. Issuance of this permit shall not be deemed to
modify, waive or reduce any requirements of any City ordinance nor limit in any way the City """"s ability to enforce any
ordinance provision.
THIS PERMIT AUTHORIZES ONLY THE WORK NOTED. THIS PERMIT COVERS WORK TO BE DONE ON PRIVATE PROPERTY ONLY. ANY CONSTRUCTION ON THE

THIS AGREEMENT is made and este-'+ into the 12 day of. February,
1986 by Edmonds Retirement Associates, a General Partnership hereinafter;
referred to as "Owner(s)",
WITNESSETH:
WHEREAS, the Owners are the titleholder(s) of certain real property
located at SR 104 Opposite 95th Avenue SW the
^ 1 Property"), the same being legally described as follows:
COMMENCING at a point on the South line of the North half of the
Northeast quarter of the Northeast quarter of Section 36, Township
V`+ 27 North, Range 3 East, W.M.:
THENCE South of 88°14'33" West 677.14 feet from the Southeast corner of
said North half;
THENCL along said South line South 88"74'33" West for 123.07 feet;
THENCE North 1.2°40'21" East for 510.23 feet, more or less, to the
Southwesterly margin of State Hiway as conveyed to the State of
Washington by deed recorded under Auditor's File No. 2185470;
THENCE along said Southwesterly margin on a curve to the right to a
point which bears North 13°18'19" East from the Point of Beginning;
THENCE South 13°18'19" West for 440.75 feet, more or less, to the Point
of Beginning.
Situated in the County of Snohomish, State of
Washington; and
WHEREAS, the Owners propose to develop the Property for Retirement
Housing
WHEREAS, Snohomish County has found that said site plan revision and
variance for parking is in the public interest, provided that the development
of the Property is planned and implemented in accordance with certain
standards, conditions and requirements which shall be documented herein and
hereafter considered to be an integral part of the site plan revision and
variance for parking applicable to the Property; NOW THEREFORE,
THE OWNERS HEREBY AGREE AS FOLLOWS:
1.
a. development and use of the subject property solely for retirement
housing for so long as on-site parking does not meet code requirement
of whichever municipal agency has jurisdiction over the subject
property.
b. provision by the owner/operator of the retirement housing of a van
transportation system for use by 'the residents of the complex.
C. instaiiation of aauitional parking to meet then curreut tvulug code
regulations of whatever municipal government has jurisdiction over tl
subject property within 90 days of use change or van transportation
system elimination.
V. Legal Requirements: The Owners, and their successors and assigns,
shall comply with all County laws and regulations applicable to the development
and use fo the Property, and nothing herein shall be construed as superceding
said laws and regulations.

X. Enforcement: Any violation of this agreement by the Owners, their
successors or assigns, shall be considered a violation of the Snohomish County
Zoning Code ans shall be subject to all applicable penalties. In addition to
fs,_ said remedies, Snohomish County may also elect to bring such action or actions
C N as will accomplish the specific performance of this agreement.
Y. Construction of Agreement: This agreement is concomitant with the
CD action of Snohomish County for a site plan revision and variance for parking to
N the Property. Nothing herein shall he construed as being agreed to in consideratio,
for said site plan revision and variance for parking, nor does the County relinquis'
lil its legislative power with respect to said site plan revision and variance parking
to consideration for this agreement.
00 Z. Effective Date: This agreement shall become effective upon final
approval by Snohomish County of the site plan revision and variance for parking
to the Property.
