Greetings,

Thank you for submitting a building permit application for a at in the
zone. I have reviewed the above building permit application for the Planning Division and it was found that the
following information, corrections, or clarifications will need to be addressed before the Planning Division review
can continue.
1.Setbacks:
I have requested the setback adjustment file from archives, file A-23-1981.Please plan on
redesigning the second story to meet the required setbacks (10’ minimum, 35’ total from each side).There is the
slight possibility that the language of the approval would allow you to proceed as planned, but in most
situations, a variance is approved based on the plans submitted at the time of construction and does not carry
over to future additions. Fingers crossed!
10/16/2012:Please apply for and obtain a variance for the proposed addition, or modify the proposal to meet the
required setbacks. The previous variance does not applyto future construction, which is required to meet the
various codes in place at the time of a complete buildingpermit application. You are proposing to modify a legal
nonconforming structure, and per ECDC 17.20.020.Baltering the structurewithin the setback area (most of the
second story) is not permitted.I’m sorry that this isn’t the news that you wanted to hear.
2.Land Use:
Please clarify the use of this new studio addition.Please state if you plan to use this as an accessory
dwelling unit (ADU) and I will be happy to guide you through the ADU process.If this space will not be an
ADU, please label “not anADU” on the plans (redlining them with your initials and the date is acceptable).
10/16/2012:If you are not creating an ADU, what use will be conducted within the “studio”?Please clarify.
