W Dear Mr. Sundquist: I have reviewed the above building permit applicationfor the Planning Division,and it was found that the following information, corrections, or clarifications will need to be addressedbefore review can continue: HeightCalculations: Please indicate the elevations of the maximum allowed height and proposed 1. heighton the site plan. Nonconforming Regulations: 2.Thesite plan indicates that the existing residencedoes not comply with the minimum required 7.5-foot side setback from the southernproperty line nor does the existing covered patio comply with the minimum required 15-foot rear setback from the western property line as required by the RS-8zone. According to Snohomish County Assessor records, the residence was constructed in 1954,which was prior to annexation of the subject site into the City of Edmonds in 1961.A permit was issued for acarport in 1967 (Permit No. BLD19670400),which is a portion of the proposed garage. The site plan indicatesthat the covered patio was constructed in 1967; however, a permit was not found in our records for the covered patio. It appears that the existing residence and carport meet the definition of a nonconforming structure pursuant to ECDC 17.40.020; however, the covered patio does not meet the definition of a nonconforming structure since it was not permitted.Thus, the existing residence and carportare subject to the nonconforming structure regulations of ECDC 17.40.020, but the covered patio is not and must comply with current code requirements, including setbacks. Although the City’s code requirements related to nonconforming structuresallows for the maintenance of an existing nonconforming structure, ECDC 17.40.020.Dspecifies that any alterations to a nonconforming building must comply with current site development standards and must not expand any nonconforming aspect of the building.Therefore, the residence and carport may not be altered in any way that expands the nonconformity. For example, the height of the roof over the portion of the building that extends into the southern side setback cannot be increased, with the exception that Interpretation No. 2003-2(enclosed for reference) allows for the minimum necessarypitch to be added to a flat roof in order to enable to roof to drain properly. In order to ensure compliance with the current site development standards of ECDC 16.20.030 as well as the nonconforming regulations of ECDC 17.40.020, please conduct the following: a.Revise the location of the covered patio so that it will comply with all required setbacks, including the minimum required 15-foot rear setback measured from the western property line. b.Revise the roof design above the portion of the existing structure that projects into the minimum required 7.5-foot side setbackin order to be consistent with the provisions of Interpretation No. 2003-2.The new roof over this portion of the residence mayonly be increased by the minimum pitch necessary to enable toroof todrain properly(i.e. a 2:12 pitch).
