The subject site is located within the Neighborhood Business, BN, zone. The applicant obtained a conditional use permit for the business to be open 24 -hours a day (File No. PLN20150068). The majority of the work proposed under the subject application (BLD20160850) includes interior improvements to the tenant space; however, the proposal also includes a new metal panel facade on the southern side of the building, repainting the building, a new outdoor dog run, new trash enclosure, additional lighting on the northern side of the building, and various other minor site improvements. Signage will be reviewed under a separate building permit application and is not being reviewed at this time. A site plan is provided for reference at Attachment 2. An elevation view and cut sheet indicating the proposed new metal panel facade on the southern side of the building and paint colors are included as Attachment 3, and a narrative from the applicant describing the new metal panel facade is included as Attachment 4. The landscape plan for the outdoor dog run is included as Attachment 5. A photometric plan and lighting detail are provided as Attachment 6. An email from the applicant regarding noise mitigation measures is provided as Attachment 7. The site is located within the Neighborhood Business, BN, zone, which is subject to general design review under ECDC Chapter 20.11. Page 1 of 5 Design review for projects within the BN zone that do not require a threshold determination under the State Environmental Policy Act (SEPA) may be reviewed by staff as a Type I decision subject to the requirements of ECDC 20.01.003. Pursuant to ECDC 20.11.020, staff must find that the proposal is consistent with the zoning ordinance as well as relevant design criteria within ECDC 20.11.030 and the design objectives contained in the City's Comprehensive Plan. Findings & Conclusions 1. Scope. According to ECDC 20.10.020, design review is intended to apply to all development including any improvement to real property open to exterior view, including but not limited to buildings, structures, fixtures, landscaping, site screening, signs, and parking lots. Thus, the subject design review focuses on the exterior changes identified in the scope of work under BLD20160850, which are summarized in the project description above. 2. Environment. The project is exempt from review under the State Environmental Policy Act (SEPA) pursuant to WAC 197-11-800(3). A critical area determination conducted in 2016 under file number CRA20160072 found that no critical areas exist on or adjacent to the site. As such, a "Waiver" from the critical areas requirements of ECDC Chapters 23.40 through 23.90 was issued. 3. ECDC 20.11.030 Design Review Criteria 1. ECDC 16.45 — Neighborhood Business (BN) Zone The BN zone requires a 20 -foot street setback and 15 -foot side/rear setbacks from property lines adjacent to R -zoned property. The proposed outdoor dog run is shown to comply with the 20 -foot street setback from the eastern property line adjacent to 84th Ave. W. The proposed trash enclosure is located within the existing developed area as it is taking the place of four existing parking stalls. The new metal panel fagade on the southern side of the building will comply with setback requirements from all property lines. The maximum allowed height within the BN zone is 25 feet. The new metal panel facade is below the height of the existing roof screen. Thus, no change is proposed to the existing building height. 1. The BN zone requires a Conditional Use Permit for businesses open to the public between the hours of 11:00 p.m. and 6:00 a.m. A Conditional Use Permit was approved on March 4, 2016 in order for the proposed clinic to be open 24 -hours a day. The Conditional Use Permit is subject to the conditions set forth in the Hearing Examiner's decision, which includes conditions requiring sound attenuation measures to be incorporated into the tenant improvement work, limits use of the outdoor dog run, and restricts the clinic to being open to the public only for emergencies between the hours of 11:00 p.m. and 6:00 a.m. In addition to the sound attenuation measures indicated on the tenant improvement plans, the applicant sent an email on October 27, 2016 clarifying the sound attenuation measures that were incorporated into the project design (Attachment 7). Upon review of the project plans and the additional clarification in Attachment 7, it was found that the applicant has reduced noise impacts to the maximum extent practicable through building design measures as well as the business' management practices. Page 2 of 5 2. ECDC 20.11.030 — Design Criteria Design criteria for properties subject to general design review are contained within ECDC 20.11.030. Because this is a small exterior remodel of an existing building, complete code compliance like that for a new building cannot be obtained. In projects like this, the intent is to achieve a greater level of compliance than that of the existing building and to improve the visual aesthetic of the site. Staff has reviewed the design criteria of ECDC 20.11.030 as related to the subject proposal. The design standards that are most applicable to the subject proposal include the following: 20.11.030.A. Building Design. No one architectural style is required. The building shall be designed to comply with the purposes of this chapter and to avoid conflict with the existing and planned character of the nearby area. All elements of building design shall form an integrated development, harmonious in scale, line and mass. 20.11.030.A.4. Long, massive, unbroken or monotonous buildings shall be avoided in order to comply with the purposes of this chapter and the design objectives of the comprehensive plan. This criterion is meant to describe the entire building. All elements of the design of a building including the massing, building forms, architectural details and finish materials contribute to whether or not a building is found to be long, massive, unbroken or monotonous. 20.11.030.8.2. Landscape treatment shall be provided to enhance the building design and other site improvements. 20.11.030.B.8. Exterior lighting shall be the minimum necessary for safety and security. Excessive brightness shall be avoided. All lighting shall be low-rise and directed downward onto the site. Lighting standards and patterns shall be compatible with the overall design theme. The subject proposal will bring the existing building closer towards compliance with the applicable design standards by creating a visually distinct top and base and by clearly identifying the main entries to the tenant spaces through the use of various colors and materials on the southern building facade. Landscaping will be provided around the new outdoor dog run. Additionally, as required by the conditions of approval, additional landscaping will be provided on the northwestern side of the site between the parking area and property lines in order to help provide a visual screen between the parking area and adjacent residentially -zoned properties. The new lighting on the northern side of the building will provide safety while being directed downward onto the site in order to minimize glare onto the adjacent properties. B. Comprehensive Plan Corn fiance 1. Location —The site is located within the "Neighborhood Commercial' designation of the Comprehensive Plan. Urban design goals and policies are located on pages 122 —127 of the Comprehensive Plan and are intended to encourage the development of high quality, well-designed projects that reflect the values of the citizens of Edmonds. Page 3 of 5 Staff has reviewed the general design objectives of the Comprehensive Plan as related to the subject proposal. The design objectives that are most applicable to the subject proposal include the following: Building/Site Identity. Improve pedestrian access and way finding by providing variety in building forms, colors, materials and individuality of buildings (pg. 123) Lighting. Provide adequate and appropriate illumination in all areas used by automobiles, bicycles and pedestrians — including building entries, walkways, parking areas, circulation areas and other open spaces — to support activity and security. (pg. 124) Site Utilities, Storage, Trash and Mechanical Systems. Minimize the noise, odor and visual impacts of utility systems using such features as landscaping, building forms, or integrated design (pg. 124) Massing. Reduce the apparent bulk and mass of buildings by encouraging human scale elements in building design and/or by subdividing building masses vertically or horizontally. (pg. 124) Wall Modulation. Variation in materials, decorative elements, or other features should be employed to support pedestrian scale environments and streetscapes, or to help break up large building masses to keep in scale with the surrounding environment. (pg. 124) Variation in Fagade Materials. Employ variation in materials, colors or design elements on building facades to help define the scale and style df ttie structure. Variation in fagade materials can help reduce the apparent bulk of larger buildings while allowing variety and individuality of building design. (pg. 124) The proposal meets the applicable design objectives of the Comprehensive Plan by adding visual interest to the existing building through the use of additional materials and colors on the main building facade. The new metal panel facade will create a visually distinct top and base and will help to improve way -finding to the two separate tenant spaces through the use of varied colors and materials. In creating well-defined entrances to the two tenant spaces, the project will create a pedestrian -friendly environment and will improve pedestrian connections to the subject site. New lighting on the northern side of the building will help to provide security, but will not be excessively bright to spill off onto the adjacent residential properties to the north. The proposed fence and landscaping around the outdoor dog run will help to screen this area from street view. In order to help to screen the new trash enclosure, a condition has been added to this approval requiring landscaping including shrubs that will grow to a minimum of 3 feet in height to be established on the western side of the site within the available landscape area between the parking lot and the NW and NE property lines where adjacent to the parking lot and new trash enclosure. Page 4 of 5 Decision Staff finds that the proposal is consistent with the Zoning Ordinance, applicable design standards, and Comprehensive Plan. Therefore, staff finds that the design of the exterior changes to the existing building and minor site improvements proposed under permit BLD20160850 are APPROVED with the following conditions: 2. All conditions of approval set forth in the Hearing Examiner's decision on the associated Conditional Use Permit (PLN20150068) shall be followed. 3. The sound attenuation measures identified by the applicant in Exhibit 12 of the Conditional Use Permit (PLN20150068) and as set forth on the project plans shall be met. This includes, but is not limited to, the management practices identified in Item 3 of Exhibit 12. 4. Landscaping including shrubs that will grow to a minimum of 3 feet in height shall be established on the western side of the site within the available landscape area between the parking lot and the NW and NE property lines where adjacent to the parking lot and new trash enclosure. 5. Individual elements of this project are required to meet all applicable city codes, and it is the responsibility of the applicant to apply for and obtain all necessary permits. In years past, a vertical facade was installed which consisted of two-tone canvas stretched over a metal frame supported on a horizontal canopy which covers a concrete walk and spans the entire front of the building. The underside of the canopy is approximately 9'-6" above the finished surface of the front walk, with the highest portion of the facade measuring approximately 9'-6" above that. The existing canvas facade and supporting structure is aged, outdated, and has deteriorated to a state of disrepair. Part of the scope of this submittal includes the removal of this existing canvas facade and the installation of a new metal panel facade in its place. As this property is located in the Neighborhood Commercial zone, and specifically in the Five Corners neighborhood, the design of the new metal panel facade structure is meant to align with the intent of the City of Edmonds Comprehensive Plan in its layout, material, and color choices. The massing of the new facade is designed in such a way to "break up" this long, low front elevation of the building, incorporating a variety of heights, widths, and depths. As there will be two tenants in the building, the largest of the facade elements are used to designate the entrances of the two spaces (it would be the intent that primary building signage for these two tenants, under separate permit, are located on these largest surfaces). Furthermore, the panels will vary in color and texture to further help the break-up of this elevation. Color selections are meant to compliment the individual tenant identities (cafe and vet clinic), while still working together in an overall building palette. Metal panel material is being selected due to its durability, low -maintenance, and its variety of color and profile choices. We believe this proposed design encompasses the "unique character" of the revitalized Five Corners neighborhood. The proposed design does not increase the apparent mass of the building any further than the current canvas facade did when it was installed, maintaining the reserved development design that is appropriate for the B -N zone. Additionally, we believe this revitalized building facade will add to the "gateway" feel of the Five Corners intersection. In this phase of construction, that includes the Exam Rooms and the holding cages. Additionally, under a separate permit, there will be an enclosed concrete room (used for radiology services) that will be located within the building adjacent to the rear wall that will help to block much of the noise emanating from within the clinic. - Surrounding all sides of the Exam Rooms and adjacent to the holding cages will be "sound wall" construction, with full -height walls to the roof structure above, acoustic sealant at the top and bottom connections, drywall on both sides of the studs, and batt insulation within the wall cavity. - These noisy areas will include suspended acoustic tile ceiling. - Doors at the Exam Rooms will have sound seals and door bottoms that will further mitigate noise emanating from these areas. We believe these specific construction elements address those concerns of potential noise coming from the building. And we feel we are meeting the intent of the original letter and the expectations from the City of Edmonds. Furthermore, it is the owner's understanding that these or similar noise -mitigation measures shall be included in future phases of construction as the clinic continues to expand within the tenant space.
