Dear Mr. Hegyi,
In response to your request to meet with City officials, members from the Development Services
Department including the Director and the Assistant Building Official met with you on
September 10, 2007 to discuss outstanding building division plan review comments. During the
course of that meeting, it was explained in great detail how the existing building (altered by you
without first obtaining a building permit) has created non -conventional roof to floor framing
violations as well as non-structural violations that must be resolved in order for the permit to be
issued. Based on this meeting and prior plan review comments the following shall be required:
• You are required to adhere to the STOP WORK Order issued on September 10, 2007 until a
valid building permit is issued to you.
• You are required to submit State Licensed professionally engineered framing plans (stamped
and signed) in order to show minimum code compliance to framing provisions of the
building code OR, submit complete framing and section plans (showing conventional
framing) from the foundation through the roof, showing all structural loads carried to the
foundation in a continuous path.
• Regarding the entry doorway width of 61 inches the Building Official concurs that the
overall openable width met the intent of the 1958 Building Code for minimum doorway size.
• Regarding the door at the top flight of the interior stairs; the door is permitted to be a 32 inch
door however a 36 inch landing is required in the direction of door swing and it is unknown
whether or not 36 inches can be provided. If a 36 inch landing cannot be provided the door is
not permitted.
• Regarding your claims that you have a permitted Accessory Dwelling Unit (ADU) please
refer to the enclosed building permit (reference 930270) for the basement remodel which
references a covenant entitled Statement of Accessory Dwelling Unit and includes a floor
plan. The significance of the covenant is that you are the signatory stating that there would
be no ADU in the basement. The significance of the 1993 floor plan is that it does not show
a kitchen and you have admitted that there is an existing kitchen. Single family property is
zoned and intended for one dwelling, special approvals must be granted in order to have an
ADU. A check of City Planning records does not indicate ADU approval; therefore you are
required to remove the second kitchen in the basement (stove, oven, counters, fan,
appliances, cabinets, etc.).

Regarding the kitchen addition according to City building permit records there are no permits
for this work. Please contact the Snohomish County Assessor to obtain real property records
to determine the year that the kitchen addition was added. If no County or City permit exists
you will be required to obtain a permit for this work.
