Dear Mr. Burke,
As has been discussed with you by phone and in writing to the Woodway Gas & Mart, there are restrictions on the parking and storage
of large commercial vehicles in residential zones, adjacent to residential zones and in the right-of-way. The Woodway Gas & Mart’s
conditional use permit restricted unrelated commercial parking at that site. Parking on the right-of-way has similar restrictions.
The Edmonds City Code (ECC) regulates the parking of trailers in the public right-of-way as follows:
8.48.180 Overnight parking prohibited in residential areas. It is unlawful and a violation of the traffic code to park or
otherwise leave overnight, or between the hours of one minute after 12:00 midnight and 6:00 a.m., on any street or
highway in the city of Edmonds within or abutting an area classified as residential (RS, RD, RML, or RMH) or open space
All types of trailers designed
(OS) by the official zoning ordinance the following types of trailers and/or vehicles: A.
to be drawn by a motor vehicle
including but not limited to boat trailers, trailer homes and mobile homes;
The Edmonds Community Development Code (ECDC) requires a Street Use Permit to use the public right-of-way for storage as
follows.
ECDC 18.70.000.B Permits required. Street Use Permit. A street use permit is required to use any portion of public space
or city right-of-way for objects which are temporary in nature.
1. To “use” means to place or maintain in, over or under any public place, right-of-way, roadway, parking strip and/or
sidewalk, including the air space above them, any temporary or movable object.
2. “Temporary in nature,” in reference to street use permits, means not having or requiring permanent attachment to the
ground, or involving structures which have no required permanent attachment to the ground.
Neither of the above definitions shall be interpreted to prohibit the parking of a properly licensed vehicle within the
parking strip adjacent to their property line of sight, and street plantings. \[Ord. 3485 § 2, 2004\].
ECDC 18.70.020 Applications. Applications for street use or encroachment permits shall contain, in addition to the
information required under any other applicable city code, the following information:
A. Street Use Permit.
1. Architectural design board approval, when applicable.
2. Certificate of insurance.
3. Complete street use permit application.
Corrective actions required by August 4, 2006:
Any trailers must be removed from the City right-of-way between the hours of midnight and 6 a.m. If you desire to store
your trailer temporarily on the City right-of-way, please make a full application for a Street Use Permit. However, due to
the restriction between midnight and 6A.M., that would appear to be a limited daytime option.
