The proposal protects the critical area functions and values consistent with the best available science and results in no net loss of critical functions and values; and 6. The proposal is consistent with other applicable regulations and standards. Unfavorable Critical Area Decision. The proposed project is not exempt or does not adequately mitigate its impacts on critical areas and/or does not comply with the criteria in ECDC 23.40.1,60 and the provisions of the City of Edmonds critical area regulations. See attached findings of noncompliance. Favorable Critical Area Decision. The proposed project as described above and as shown on the attached site plan meets or is exempt from the criteria in ECDC 23.40.160, Review Criteria, and complies with the applicable provisions of the City of Edmonds critical area regulations. The utility extension requires the construction of a 3 -foot deep by 3 -foot wide trench along the existing access to the residence from the intersection of 8th Ave N. and Hindley Lane. This trench must be constructed within the existing developed buffer of Hindley Creek. It is my understanding that the trench will be excavated and backfilled on the same day and will not require the removal of any significant native vegetation. It is my recommendation that to avoid any potential sediment from entering the creek the construction should only occur during dry weather. In addition, in those areas where the trench would be installed through lawn, the sod should be stripped, set aside, and then replaced following backfilling. Conclusion There should be no impacts to Hindley Creek or its buffer from the utility trench installation if constructed per the site plan and if the above recommendations are followed. What you are doing doesn't appear to fall into that category. The other options are that it is an allowed activity that doesn't require a critical area report per 23.40.220 or it's an alteration that requires a critical area report. If you are installing a new gas line within the critical area/buffer of the stream, it might be an allowed activity under the minor utility projects category but BMPs and restoration measures are still required in that case: "5. Minor Utility Projects. Utility projects that have minor or short -duration impacts to critical areas, as determined by the director in accordance with the criteria below, and which do not significantly impact the function or values of a critical area(s); provided, that such projects are constructed with best management practices and additional restoration measures are provided. Minor activities shall not result in the transport of sediment or increased storm water. Such allowed minor utility projects shall meet the following criteria: a. There is no practical alternative to the proposed activity with less impact on critical areas; b. The activity involves the placement of utility pole(s), street sign(s), anchor(s), or vault(s) or other small component(s) of a utility facility; and c. The activity involves disturbance of an area less than 75 square feet;" If your scope is outside that, a critical area report is required. What's the scope of the gas line project?
