The City is in receipt of your alternate design request on behalf of PCC Markets for the building located at
9803 Edmonds Way to create a yard to the south of the building (approximately 129.8 feet by 41 feet) in
order to allow openings on the south exterior wall. Section 704 of the 2003 International Building Code
includes Table 704.8 that restricts and limits openings in exterior walls based on location to property lines.
PCC Markets has provided a legal Agreement entitled Agreement Creating Yard for Fire Exposure that
ensures that the yard will be maintained such that openings may be permitted and continued during the lease
of PCC Markets. In the event that PCC Markets terminates the lease agreement the building will be
converted back to a solid masonry wall unless the City enters into a similar agreement with a future building
tenant/property owner or the building codes change such that the requirement is no longer applicable.
Based on the Agreement that creates and maintains a yard (as defined in the building code) it is my
determination as Building Official for the City of Edmonds that the request to allow openings in the south
exterior wall of the existing building located at 9803 Edmonds Way (to the maximum extent permitted in
Section 704) is hereby Conditionally Approved.
This approval is subject to the following:
.. The signed Agreement will be held by the Edmonds City Clerk and released far recording only after
PCC Markets has signed the lease or, if PCC Markets is unable to secure a lease at 9803 Edmonds
Way the City Clerk shall destroy the document
• PCC Markets is responsible to pay the recording fees for the Agreement
• The City shallnot issue a building permit allowing openings in the exterior south wall until the
Agreement is recorded and a copy of the recorded document is provided to the City
• PCC Markets shall be required to adhere to all applicable building code provisions and obtain all
required permitting approvals including obtaining a permit prior to the start of work
