Your application is also known as City of Edmonds file number PLN20110002. I have determined that your application is COMPLETE; however, additional information is requested at this time. I am the Planner assigned to your project, so kindly direct any correspondence through me so that it can continue to be processed in a timely manner. Please respond to the following issues in writing at your earliest convenience so that I may continue to process your application: 1.Please let me know if any of the following dates for a public hearing will work with your schedule: Thursday April 7 or Thursday April 21? We have just hired a new Hearing Examiner, so I’ll thst need to coordinate with him as well. 2.Please confirm the outdoor seating figures provided in your application. The land use application lists 40 outdoor seats proposed, however the Equiptment Plan (Sheet EQ-2.1) lists 104 indoor seats and 39 outdoor seats. Also, when I counted the outdoor seats, I came up with 39. 3.The address of the property provided on the land use application does not match the County Assessor’s records nor ours. We show the address as 7929 244 Street SW. Sometimes this street is th known as Lake Ballinger Way, as well, but for the sake of this application, I’ll just need to change your application from 7935 to 7929. Please confirm that this is okay with you (7935 is the Lakeside- Milam Recovery Center next door adjacent to this site). th Development Services Department –Planning Division | 121 5Avenue North, Edmonds WA 98020 | 425.771.0220 All code citations can be found on the City of Edmonds website:www.ci.edmonds.wa.us. 4.The parcel number (tax account number) provided on the land use application does not match the site. The County Assessor’s records show that we should use parcel number 00491100001302 which correlates to the Barlee’s Restaurant site. Please confirm that this is okay with you. You listed 00491100001306 and 00232 on the land use application. 5.Please confirm the property owner’s contact information. The County Assessor’s records indicate that the property owner is “Suzan LLC” and the Taxpayer is “Lee & Barbara Agelopoulos” while you show “SHD Associates” on the land use application. Please explain who I should add as an official party of record on this application (I recognize that if the ownership has recently changed, then the County’s website may not yet be up to date, or maybe they’re all one in the same). 6.Please submit a Critical Areas Checklist at your earliest convenience along with the $155 review fee. I will then be able to officially determine if there are any critical areas on or adjacent to the property. This is required prior to your building permit submittal and will substantially help with your conditional use proposal if we can determine that there are no environmental issues. Please note that the property owner must sign this application and that the determination does not expire, so you will be able to use it for all future City of Edmonds permits. 7.Please submit a completed State Environmental Policy Act (SEPA) checklist, along with the $485 review fee. I will then be able to issue an environmental determination on the property (this review is triggered because the building is shown at just over 4000 square feet as well as containing over 20 parking spaces). The SEPA determination will be mailed, posted, and published as required. See also Washington Administrative Code (WAC) 197-11-800. Also, Edmonds Community Development Code (ECDC) 20.15.A.210 requires the determination for the proposal to accompany the city’s staff recommendation to the Hearing Examiner. WAC 197-11-055 also requires the determination to be made at the earliest possible point in the decision making process so that any environmental impacts can be reasonably identified. 8.Please confirm that you are not seeking design review approval at this time. Design review can be conducted concurrently with your conditional use permit, if you so choose. Otherwise, you may wait until your building permit submittal. 9.Department Comments: a.The Fire District noted that access and utility requirements may require alterations to your site proposal. This is consistent with my recollection of the discussion at the pre-application meeting. Contact Fire Marshal John Westfall at 425.551.1200 with any questions. b.The Building Division noted that a building permit will be required for the proposed work. c.The Public Works Department noted that this property is contributing to downstream flooding. It needs drainage improvements. Low Impact Development (LID) should be encouraged for this project including the use of pervious asphalt for the parking areas. d.The Engineering Division has not yet commented on your proposal. e.The Economic Development Department noted that this was a great use for the site. f.The Parks and Recreation Department noted no issues with your proposal. th Development Services Department –Planning Division | 121 5Avenue North, Edmonds WA 98020 | 425.771.0220 All code citations can be found on the City of Edmonds website: www.ci.edmonds.wa.us. Now that the application is considered “complete” I will issue a “notice of application.” And once we collectively decide on a public hearing date, I’ll issue a “notice of hearing.” All notices will be mailed to property owners within 300 feet of the subject site and posted on a large white land use action sign at the site. A legal notice will be provided to the Everett Herald and a notice of your project will be published in the newspaper. I will issue a staff report and make a recommendation to the Hearing Examiner, who will issue the decision two weeks after the close of the public hearing. First, we’ll need to coordinate your public hearing date, so please contact me to coordinate our schedules. I cannot continue to process your application until we’ve agreed upon a hearing date. Hearings are held across the street from City Hall in the Council Chambers of the Public Avenue North, Edmonds at 3:00 PM on the first or third Safety Complex located at 250 5 th Thursday of each month. Please let me know immediately if you or a representative will not be able to attend. If an applicant or his representative is not present when the hearing begins, the item may be moved to the end of the agenda or continued to a future hearing date.
