Subject: Satisfying conditions imposed in Conditional Use Permit for Outdoor Seating and Extended
Indoor Hours (PLN -2010-0028)
Dear Ted,
I wanted to touch base regarding the conditional use permit granted to you last year (PLN -2010-0028).
There were several conditions associated with the Hearing Examiner's decision which must be complied
with in order to maintain the permit. Conditions #I and #2 addressed the extended hours of operation and
the outdoor seating aspect at the site. Condition #3 stated:
The Applicants must obtain building permit approval to increase the occupant load of the
outdoor dining area. At the time of building permit review, the Applicants shall present plans for
improving the arrangement of the southern site access from 22e Street SW including, but not
limited to, providing additional landscaping, reconfiguring the trash enclosure, and restricting
parking in that area to employees and disabled patrons.
The conditional use permit was granted on June 17, 2010. In order to maintain the conditional use permit,
you must apply for a building permit prior to that date. Failure to apply for the building permit in a
timely manner will result in expiration of your conditional use permit and loss of the extended hours as
well as the additional outdoor seating.
