Waiver Criteria (all criteria must be found to apply):

XXX The development proposal will not impact the Critical Area in a manner
contrary to the goals, purposes, objectives and requirements of the
Critical Areas ordinance;
XXX The development proposal meets the minimum standards of the Critical
Areas ordinance;
XXX The above findings are based on the following conditions of approval:
During review and inspection of the subject site on March 22, 1994 it was found that the site
contains Alderwood-Everett Series Soils, has been identified as one which has Steep and
Unstable Slopes on the Critical Areas Map, and is considered Geologically Hazardous pursuant
to Chapter 20.15B of the Edmonds Community Development Code. Based on these findings,
a Critical Areas Study will be required to determine the extent of the Geologically Hazardous
Area. There are two categories of Geologically Hazardous Areas present (see
20.15B.070.A3): Erosion Hazard Areas, and Steep Slope Hazard Areas.
The preliminary report that the Planning Department requires prior to submission of any
developent permit application is a topographic survey prepared by a Licensed Land Surveyor
combined with a soils report prepared by a Geotechnical Engineer which delineates the two
categories of Geologically Hazardous Areas on site.
1. Erosion Hazard Areas occur with Alderwood Soils located on slopes greater than 15 %.
2. Any slope over 30% with more than 10-feet of rise will be classified as a Steep Slope
Hazard Area. A 50-foot buffer is required from both the top and the toe of the slope.
• All Critical Areas Studies must be completed under a three party contract where the City hires
the professional required, and the applicant pays for the study (pursuant to ECDC Section
20.15B.150. The applicant may suggest qualified professionals for the City's approval.
After the Critical Area Study(ies) are complete, and the location and classification of the
Critical Areas are mapped, the applicant may move forward with their development plans.
Each Geologically Hazardous Area category has a specific level of information which must be
submitted before any development may occur in those areas.
1. Erosion Hazard Areas: An Erosion Control Plan approved by the City
of Edmonds Engineering Department.
2. Steep Slope Hazard Areas: Any development which is not identified as an
exception pursuant to ECDC Chapter 20.1513
must receive a Reasonable Use Exception
(Variance process pursuant to ECDC
20.15B.180A).
If the property owner wishes to apply for a specific development permit which they feel
would not impact the Critical Areas located on the site, they may submit their proposal to
the Planning Department for review. If the Planning Department finds that the proposed
development permit will not adversely impact a Critical Areas or its buffers, a conditional
waiver maybe issued on a project by project basis.

This letter is in response to your request for a Critical Areas Review conditional
waiver. I have reviewed the proposed project to do an interior remodel and small
• addition (98.75 sq.ft.) within an existing covered patio area at 18226 Olympic View
Drive. Because the project is within the boundaries of the existing structure and does
not appear to affect the Steep Slope Hazard Critical Area on the property, no Critical
Areas Study will be required for this project.
Please be advised that work in addition to that which is described for this project in
your letter dated March 28, 1994 may require further review to determine if a study is
required.
When submitting for the subject permit, please bring a copy of this letter with your
application for reference.

Subject: Request for conditional waiver.
Dear Ms Bulhs;
I am hereby requesting that the Planning Department review the
proposed project at the above -referenced site for the purpose of
granting a conditional waiver from the requirements of the Critical
Areas Ordinance.
Project Description: The proposed project consists of an interior
renovation and a small addition of 98.75 square feet. The addition
involves enclosing an existing covered patio area. The entire addition
is to take place under the existing roof. The existing roof, gutters and
down spouts will not be altered except to perform maintenance and
repairs. The existing finished grade will not be altered. The amount
of impervious surface will not be increased. The new spread footings
will be ten feet further from the top of the bank than the existing
basement footings
Enclosed please find a copy of the site survey, a site plan of the
proposed project, and a photocopy of photographs of the project area.
As you know the project area is quite visible and accessible from the
adjoining park should you wish to visit the site.
If you require any additional documentation to conduct your review
