Critical Areas Checklist
The Critical Areas Checklist contained on
this form is to be filled out by any person
preparing a Development Permit
Application for the City of Edmonds prior
to his/her submittal of a development
permit to the City.
The purpose of the Checklist is to enable
City staff to determine whether any
potential Critical Areas are or may be
present on the subject property. The
information needed to complete the
Checklist should be easily available from
observations of the site or data available at
City Hall (Critical Areas inventories, maps,
or soil surveys).
An applicant, or his/her representative,
must fill out the checklist, sign and date it,

and submit it to the City. The City will
review the checklist, make a precursory site
visit, and make a determination of the
subsequent steps necessary to complete a
development permit application.
With a signed copy of this form, the
applicant should also submit a vicinity map
or plot plan for individual lots of the parcel
with enough detail that City staff can find
and identify the subject parcel(s). In
addition, the applicant shall include
other pertinent information (e.g. site
plan, topography map, etc.) or studies in
conjunction with this Checklist to assist
staff in completing their preliminary
assessment of the site.

A site inspection has revealed an undeveloped site on the east side of 75th Place West. The site
slopes up steeply from 75th Place West, has a nearly flat area and then slopes up steeply for more
than 100 feet. The site contains slopes that are greater than 40% with a vertical elevation gain of
more than 20 feet.
Based on the above findings, it is determined that there is potentially a steep slope critical area on
or adjacent to the site. A Critical Areas Study is required to delineate the boundaries of this
potential critical areas, the buffers and setbacks. For the steep slopes, a licensed surveyor must
create a topographic map of the site which indicates all areas which slope 40% or more and have
a vertical gain of 20 feet or more within the 40% slopes. The map must also show the location of
the steep slope buffers and setbacks.
In this case, the slopes have been delineated by a licensed surveyor as a part of file 5-8-87. In
addition a Geotechnical Engineer evaluated the slopes and required a 50 foot combined buffer
and building setback from the toe of the slope. Therefore, the City accepts the studies and
proposed buffers prepared as part of S-8-87 as completion of the required Critical Areas Study.

HOLD HARMLESS AGREEMENT
Owner, and all persons having any present or subsequent ownership interest in these
lands, and the successors and assigns of owners or other parties having any said interest,
hereby agree that the City of Edmonds shall be held harmless in all respects from any and
all claims for damages for injunctive relief which may be occasioned now or in the future
to adjacent land or improvements by reason of the construction, operation and
maintenance of the drainage system and hereby waive and release the City of Edmonds
from any and all claims for damages, excluding damage caused solely by an act or
omission of said City and injunctive relief which the owners, or their successors or
assigns, may themselves have now or in the future by reason of the construction,
maintenance and operation of said drainage system.

20.75) File No. S-8-87 subject to the following conditions and requirements:

3. Covenants for ingress and egress and utility access; and for construction and
maintenance of all development shown on the utility development plan as
described below in paragraph number 4. Recorded as Numbers 9410250017
and 9410250018 in Volume 2970, pages 2673 through 2680.
4. The plan drawn by Group Four stamped 5/18/90 entitled "Carl Pearson Grading
and Drainage" and accepted and approved by the City of Edmonds Engineering
Division on May 14, 1991, satisfies the requirements of a drainage plan as
defined by ECDC 18.30.020 and as a utility development plan as defined by
ECDC 18.40.000(4). This plan is considered the Utility Development Plan.
This approved Utility Development Plan is considered a condition of the
subdivision and thus is exempt from the requirement of a building or grading
permit according to ECDC 18.40.000(4)..

All improvements shown on the approved Utility Development Plan must be
complete prior to the issuance of any permits except those already issued prior
to July 1, 1994, and those necessary to complete improvements required by the
approved utility development plan. Therefore these improvements are
considered deferred subdivision requirements. No other permits shall be issued
on any lots of the short plat until all deferred improvements have been
constructed, completed, and approved by the City of Edmonds Community
Services Department.
6.
A turn -around built to the City of Edmonds Engineering Division standards is
required on the plans of a building permit for a new single family dwelling, and
must be completed prior to occupancy.
The building setbacks shown on the map recorded with this recording are

established by a modification and shall be the required setbacks.

No swimming pools shall be located on the subject property unless the design is
specifically approved by a licensed geotechnical engineer subject to review
according the City of Edmonds Landslide Hazard Ordinance (ECDC section
19.05).
12.
All work on the property, including clearing, grading and installation of utilities
shall be conducted under the supervision of a licensed geotechnical engineer.
13. The applicant shall follow all requirements of the Engineering Division as found
in the City of Edmonds Planning Division file S-8-87, and as required by the

approved utility development plan. Any inconsistencies shall be based on the
utility development plan.
14. Owners and purchasers of lots shall be informed of the risk of landslide hazards
as set forth in the report by the Applicant's consulting engineer, Terra and
Associates, in their report dated August 19, 1987 and in section 19.05 of the
Edmonds Community Development Code.
